Re: Optional Premises Cultivation Operation @38150 Frontage Rd. Unit 3D, New
Castle
On March 11, 2013, the Board of County Commissioners provided local verification to
the Medical Marijuana Enforcement Division for MML, LLC's Optional Premises
Cultivation Operation (OPCO).
Community Development Director, Fred Jarman sent a letter March 20, 2013 informing
the owners of this Optional Premises Cultivation Operation (OPCO) that the operation
was considered a pre-existing nonconforming use because it was in existence prior to the
County's June 21, 2010 moratorium. That letter also requested that the owners arrange
for an inspection with Community Development staff to address building code and permit
application requirements for alterations to the structure.
Staff met with a representative of LEAF on March 29, 2013 for a site inspection. A
building permit application was submitted on January 15, 2014 and building permit
number BLCO-1-14-3099 was issued on January 29, 2014. A framing inspection was
done on June 26, 2014 and resulted in a partial approval for the framing work to date.
Additional electrical and framing work needs to be completed as well as other work, but
it appeared some progress has been made with work on this project.
Considering the time frame outlined above, and the fact that the building is occupied, staff
would suggest a reasonable deadline (30-45 days) be determined to complete the work
related to this permit.
