BOARD — 6/16/03 Public Hearing TP PROJECT INFORMATION AND STAFF COMMENTS TYPE OF REVIEW: Special Use Permit ("SUP") SUMMARY OF REQUEST: The Applicant requests a SUP for the storage of vacuum trucks and frac tanks, office, and truck maintenance shop. APPLICANT/PROPERTY OWNER: Dalbo, Inc. LOCATION: The subject property is approximately 1.25 miles south on County Road 319. SITE INFORMATION: 35 acres WATER: Well SEWER: Individual Sewage Disposal System ACCESS: Driveway off of County Road 319 EXISTING ZONING: A/R/RD (Agricultural / Residential / Rural Density) ADJACENT ZONING: A/R/RD I. DESCRIPTION OF THE PROPOSAL: A. Summary of Request: The Applicant requests approval to locate a storage yard for vacuum trucks and frac tanks, an office, and a maintenance shop on the subject property. The Applicant indicated that that the proposed uses include the following: 1. Storage of 30 vacuum trucks 2. Storage of 200 frac tanks 3. Office and operations management 4. Maintenance of trucks inside shop 5. Washing of trucks 6. Potassium Chloride storage (or KCL is a week salt mixture, non-toxic and non- hazardous) used in down hole operation and maintenance of oil and gas wells) storage ( Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 2 B. Project Description: Dalbo, Inc. has been in the oil and gas service business since 1970. Dalbo, Inc. has operations in Utah, Wyoming, Colorado, and California. The home office is in Vernal, Utah. Dalbo, Inc. owns and operates vacuum trucks and rents frac tanks to oil and gas companies for the extraction of oil and gas natural resources. The primary function of the Applicant is the hauling of fresh water for drilling, renting frac tanks, filling frac tanks with fresh water and KCI water, and hauling of produced water (salt water) to disposal pits. Currently, the Applicant is operating from a recently purchased property in Debeque, Colorado, and a leased yard west of I-70 in Rifle. They are also leasing space in Grand Junction. The Applicant noted that the primary purpose of selecting the subject property, which recently has been purchased (see Exhibit L), was its location. Approximately 75% to 85% of the truck trips associated with the Applicant's operation are along County Road 319. In addition, the property allows the Applicant to consolidate some of its operations throughout the county into one location. A frac tank is a mobile water storage container commonly used during the completion stage in the oil and gas extraction process. A frac tank is typically 45' long, 8' wide, and 10' tall. The Applicant provided a close up photograph of a frac tank with the application. The photograph to the left, taken in the Hunter Mesa, illustrates the frac tanks in the field. The following structures, as represented on site plan provided with the application, will be erected on the currently vacant property: 1. A 50' X 100' metal frame maintenance shop. 2. An attached 26' X 40' office. 3. A 30' X 50' concrete wash bay for the vacuum tracks. 4. 4 upright metal storage tanks in concrete containment (50' X 50' X 3') for the KCL water. The dimensions of the 4 upright metal tanks are as follows: 1. Two (2) tanks will be 35' tall, 12' in diameter. Both tanks will hold KCI water (750 bbl. capacity). 2. One (1) tank will be 16' tall, 22' in diameter and will hold KCI water (1000 bbl. capacity). Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 3 3. One (1) tank will be 24' tall, 22' in diameter and will hold fresh water (1,500 bbl. capacity). The maintenance shop will have two 16' tall bay doors for the vacuum trucks to access the interior of the shop for light maintenance. Most of the major truck repairs will be done in Vernal, Utah. The shop will be designed for minor truck repairs and periodic maintenance. The attached office will be 26' X 40' and will have a main lobby, 3 offices for the secretaries, salesman and manager. Two restrooms will also be in the office area. To the south of the maintenance shop and office will be a tank battery. In the tank battery, there will be four tanks enclosed by a concrete containment wall. Three tanks will have KCl water and one will have fresh water, as described previously in this memorandum. Behind the shop is the truck wash bay. This structure will consist of a 30' X 50' concrete wash bay and a water and silt collection sump. The vacuum truck and frac tank storage will be south and east of the shop as shown in the site plan submitted with the application. Both photographs above were taken at the EnCana evaporation pit access looking north and east on the subject property. The photograph to the left shows the area of the maintenance shop / office, and truck wash. The photograph on the right shows the area where the 4 upright metal storage tanks, storage area of the vacuum trucks and the frac tanks will be located. It is anticipated that there will be two full time office employees and two full time mechanics at the facility five days a week, 8 hours a day. In addition, there will be a salesperson, a manager and a truck dispatcher who will be in the office 2 to 3 hours each day. The Applicant noted that the hours of operation would be 24 hours per day. However, generally the hours of operation will be during the daylight hours. The truck drivers will most likely be in and out of the property as often as once per day, 7 days a week. Weekends will be limited, however, this will be based Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 4 on the need of the oil and gas companies. It is also anticipated that deliveries could be as few as once a week to as many as once per day by means of UPS or postal service. Most necessary parts will be picked up by the salesperson, the manager, the dispatcher or the mechanics in the daily to and from travels to work. The Applicant noted that customer visits to the facility would be rare. The Applicant noted that some fencing along County Road 319, drilling a water well, and hauling of dirt will be necessary to complete the onsite improvements. Construction is anticipated to begin upon County approval of the SUP request. C. Site Description: As the Applicant noted, the property has two very distinct topographic areas. The first area, a flatter or slightly slope area, contains approximately 15 acres. This area will be used for the storage yard and maintenance shop. Intermittent small patches of native grass exist on this area. Sagebrush and other small native plants are sparse. Two sides of this area have existing fences. According to the Applicant, the fence was constructed for the purpose of keeping cattle on the adjacent property. There is also a very distinct drainage that traverses the property. The Applicant is purposing to culver this drainage. The second area of the property, along the northern boundary line, consists of the remainder 20 acres. This area is defined by a small hill. Sagebrush, cedar trees and intermittent small patches of grass sparsely cover this area. No disturbance of this hill is proposed. D. Zoning: The subject property is zoned A/R/RD (Agricultural / Residential /Rural Density). The type of use requested falls under the definition of "Storage" which is a Special Use in the A/R/RD zone district. "Storage" is a subcategory of "Industrial Operations Classification", therefore it is subject to the standard outlined in Section 5.03.07 of the Garfield County Zoning Resolution. The office, maintenance, and truck wash should be considered accessory to the storage yard. Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 5 Pursuant to section 2.02.011 of the Zoning Resolution, the definition of "accessory use" is as follows: Accessory Uses: Incident only to a lawful use, any use, which complies, with all of the following conditions may be operated as an accessory use: Is clearly incidental and customary to, and commonly associated with a lawful use; Is operated and maintained under the same ownership and on the same lot as the lawful use; Does not include structures or structural features inconsistent with a lawful use; and Does not include residential occupancy except by domestic employees employed on the premises and the immediate families of such employees. E. Relationship to the Comprehensive Plan: The subject property is designated on the "Proposed Land Use Districts, Study Area 2 & 3" map in the Garfield County Comprehensive Plan of 2000, as "Outlying Residential." Outlying Residential is consistent with the underlying zoning, which in the case of A / R / RD is a minimum lot area of 2 acres. The subject property is located within the 2 -mile sphere of influence for the City of Rifle (see Exhibit J). F. Adjacent Land Uses: The area surrounding the proposal is pre -dominantly rangeland with similar, oil and gas, type land uses. 1. North: Existing and recent being drilled gas well. 2. South: Evaporation Pit 3. East: Vacant 4. West: Vacant G. Road/Access: The access to the subject area will be by means of a driveway off of County Road 319. H. Applicability: Pursuant to Section 9.03.04 of the Zoning Resolution, an application for a Special Use Permit shall be approved or denied by the Board of County Commissioners after holding a public hearing thereon in conformance with all provisions of the Zoning Resolution. II. REVIEW AGENCY AND OTHER COMMENTS: Comments were received from the following agencies are have been integrated throughout this memorandum as applicable. Dalbo, Inc. Colorado Division of Wildlife: No comment. 5. Colorado Department of Public Health and Environment: No comment. 6. Colorado Division of Water Resources: No comment 7. Garfield County Road and Bridge Department: Exhibit G 8. Garfield County Vegetation Management: Exhibit M. 9. Garfield County Oil and Gas Auditor: Exhibit H III. REVIEW CRITERIA FOR SPECIAL USE PERMITS (SECTION 5:03) Pursuant to Section 5.03, as listed under the Zone District Regulations, special uses shall conform to all requirements listed thereunder and elsewhere in the Zoning Resolution, as well as the following standards: 1. Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Response: The Applicant noted that water for the office, shop and truck wash will be acquired by drilling a water well. A septic system will be designed to accommodate the wastewater from the two restrooms in the office / shop. The Applicant has provided a copy of the well application and septic permit application. An actual well permit shall be submitted prior to the issuance of the actual Special Use Permit. In addition, the application shall provide documentation regarding the physical quantity of the water for the proposed uses. The following is a summary of water usage of the project: 1. Office restrooms and hand washing in the shop. The water for the office and the shop will be from the propose water well. Any wastewater would be put into the septic system to be installed on the property. The Applicant anticipates that water usage will be minimal, less than 250 gallons per day. 2. Truck washing facility. The water for the wash bay will also come from the water well. The Applicant noted that water usage will be minimal, less than 500 gallons per day. The wastewater will be recycled. Any silt from the wash bay would be collected and hauled to the local landfill. 3. KCL Storage tanks. It is anticipated that this water would have to be hauled for a fresh water source. If the water well can produce more water than used by the office and truck - washing facility the excess water will be sue for the KCL storage tanks. Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 7 The Applicant asserted that the Department of Water Resources indicated that a well can be drilled on 35 acres and there will be no need for a water allotment or a water augmentation plan. However, the well allowed to be drilled is an exempt domestic well. The Applicant may need to obtain an exempt commercial well permit from the State for the proposed uses. 2. Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. Response: Access to the property will be off of County Road 319. The Applicant has had discussions with Jake Mall of the Garfield County Road and Bridge Department with respect to safe and convenient access to the site from CR 319. Mr. Mall provided the following comments (see Exhibit G): A. The Road and Bridge Department has no objections with the SUP, as it locates this type of industry closer to the drilling fields and eliminates a considerable amount of traffic on certain roads. B. A 30 -foot right-of-way shall be deeded to the County from the centerline of County Road 319, east onto the property. No fences or structures shall be built within this deeded right-of-way. C. The Road and Bridge Department will issue a driveway permit upon approval of the SUP with provision specific to the permit. D. A stop sign shall be placed at the exit of the driveway. The stop sign shall be of the size and located as required by the manual on Uniform Traffic Control Devices. E. Truck turning signs shall be located on County Road 319 on either side of the driveway access for traffic going both north and south. The signs shall be of the size and located as required by the Manual on Uniform Traffic Control Devices. F. A sign showing the name of the company shall be in a visible location for emergency purposes. 3. Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. Response: The area surrounding the property storage yard is vacant except for gas wells to the north and one of EnCana's evaporation pit and storage yards to the south. There are no homes, subdivisions, irrigated lands, and retail or commercials operations in the area. Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 8 Currently along the south property line and the east property line there is a 5' field fence or combination wire fence. The Applicant is proposing to retain this fencing. The Applicant is proposing to install a 5' security fence along the north and west boundary line. However, due to the hill along the north side of the property, the Applicant noted that fencing will follow the base of this hill to prevent disturb of this hill area and keep it in its nature form.. A photograph representing the type of fencing proposed has been included with the application. The Applicant indicated that lighting will be installed to light up the area around the shop and the office. This lighting will be on an electric eye to turn on at dark. The lighting used will be directed to minimize any off-site glare. The Applicant is proposing to install a 4' X 8' non - lighted sign will be erected to identify the facility. The sign shall comply with the county sign standards. No additional screening or landscaping of the site is proposed. The Applicant feels the fencing proposed is adequate and that no additional screening is necessary. The Applicant feels that the more visible the property is from the public right-of-way, the less likely there will be any vandalism or problems. Pursuant to Section 5.03.10, uses listed as Special Uses shall be permitted only: 1. Based on compliance with all requirements listed herein, and; 2. Approval by the County Commissioner, which Board may impose additional restrictions on the lot area, floor area, coverage, setback and height of proposed uses or required additional off-street parking, screening fences and landscaping, or any other restriction or provision it deems necessary to protect the health, safety and welfare of the population and uses of the neighborhood or zone district as a condition of granting the special use. Response: Staff sees no reason for the Board to impose any special conditions. Section 5.03.07 [Industrial Operations]: Pursuant to Section 5.03.07 of the Zoning Resolution, a permit for Industrial Operations requires the submittal of an impact statement on the proposed use describing its location, scope, design and construction schedule, including an explanation of its operational characteristics. The impact statement is required to address the following: Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 9 (A) Existing lawful use of water through depletion or pollution of surface run-off streamflow or ground water. The Applicant noted that water for the office, shop, and truck wash will be acquired by drilling a water well. A septic system will be designed to accommodate the wastewater from the two restrooms in the office / shop. The tank farm south of the shop will be surrounded by a concrete containment wall with a concrete floor. A 4' diameter culvert will be placed in the wash to allow surface run-off to continue through the property. The Applicant noted that the yard will be graveled and the property will slope away from County Road 319, so that little or no water, dirt, or mud will be carried onto the county road. The Applicant does not propose to change the general topography of the property. A concrete pad will be constructed to catch the wastewater from the truck wash and the water will be reused similar to a car wash. The water and silt will flow to a concrete collection sump. When it becomes necessary to remove the silt from the collection sump, a backhoe and dump truck will be used to collect and haul the silt to the landfill. The truck wash is a concrete self- contained unit. The Applicant asserted that no truck wash water would impact the ground water or the surface runoff. Frac tanks and vacuum trucks will be stored on site empty. (B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or other emanations. Response: The Applicant noted that the maintenance shop will normally have its doors closed. Any noise, smoke, dust, vibration, or other emanations from the shop should be minimal. No painting, sandblasting, or manufacturing of new equipment will take place at the shop. Storage of maintenance fluids (motor oil, antifreeze, transmission fluid, etc.) will be stored inside the shop. The Applicant indicated that when a truck is started a minimal amount of smoke and noise will be created. A minimal amount of welding, for minor repair only, will be done in the shop. All manufacture of trucks and tanks is done off site. A used oil containment tank will be placed outside of the shop to hold used oil. Use oil will be collected periodically. In the event of potential violations with respect to vapor, dust, smoke, noise, glare or vibration, the Applicant will be required to provide proof of compliance with applicable Federal, State, and County laws, regulations and standards. Special Use Permit BOCC — 6/16/03 Page 10 (C) Impacts on wildlife and domestic animals through the creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions. Response: The application did not contain an analysis of wildlife impacts on the property. There is existing fencing that has been installed on the property by the previous property owner which has probably disrupted the migration routes or use patterns by wildlife habitat if it existed. The proposed use should not result in increased adverse impacts to wildlife or domestic animals through creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions. The activities of the business will not result in the generation of products or waste products that will attract wildlife or domestic animals. This application was referred to the Colorado Division of Wildlife, however, no comments were received. (D) Affirmatively show the impacts of truck and automobile traffic to and from such uses and their impacts to areas in the County. Response: The Applicant has noted that County Road 319 is one of the main roads being used by EnCana to access their gas extraction activities. The Applicant feels that there are some distinct advantages to locating on the subject property. These include: 1. Currently, all of Dalbo's vacuum trucks are traveling into the Rifle area via I-70 from Grand Junction and Debeque. The vacuum traffic should decrease on the freeways and secondary roads. The truck drivers will drive their personal vehicles to the yard each day, pick up the trucks and go to work. 2. The tank storage yard is currently located in a leased yard on the west Rifle I-70 frontage road. Winch trucks travel to the yard to retrieve our tanks and move them to various oil field locations. If the tanks were located in the new yard, the winch truck traffic would also decrease, because access to the oil field locations would be closer to the new storage yard. 3. The KCI storage tanks are also located in the leased yard on the west Rifle I-70 frontage road. Vacuum trucks travel on this frontage road to load the KCI water and haul to various oil field locations. The across town traffic on secondary roads should decrease. (E) That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use(s). Response: Much of the adjacent land is vacant except for EnCana's evaporation pit to the south and gas wells and tanks to the north. There are no homes or neighborhoods adjacent to the Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 11 property. The Applicant noted that the SUP request coincides with the current land uses on adjoining properties. (F) Mitigation measures proposed for all of the foregoing impacts identified and for the standards identified in Section 5.03.08 of this Resolution Response: Mitigation measures for all of the foregoing impacts identified have been addressed throughout this memorandum. Mitigation measures for the standards identified in Section 5.03.08 [Industrial Performance Standards] of the Garfield County Zoning Resolution are addressed in this memorandum. Special Use Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use will be issued; Response: The Applicant asserted that the following steps will be followed for "partial" rehabilitation of the property: A. All frac tanks will be hauled away. B. All vacuum trucks will be driven away. C. All KCI storage tanks will be hauled away. D. Building and structures will stay and be sold to other industrial uses. E. Restoration of grade to approximate original conditions. F. Replacing stockpiled topsoil. G. Complying with all prevailing COGCC and Garfield County regulations governing final reclamation. For "full" rehabilitation of the site, the Applicant indicated that the following steps will be taken: 1. All frac tanks will be hauled away. 2. All vacuum trucks will be driven away. 3. All KCI storage tanks will be hauled away. 4. Propane tanks, used oil tanks, and new fences will be removed. 5. Concrete containment wall and concrete wash bay will be demolished. 6. Maintenance shop and office will be demolished. 7. 4' culvert will be dug out and removed. Staff is of the opinion that the proposed "partial" rehabilitation plan of the property is the preferable plan. Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 12 Steve Anthony, Director of Vegetation Management, noted that the primary concern is that the storage facility could act as a vector that will facilitate the spread of weed seeds throughout the County as various items will be stored on site and than transported to other areas (Exhibit M). Mr. Anthony noted that weeds on the Garfield County Noxious Weed list are not common on this site, however, cheatgrass (bromus tectorum) is found in the area. Cheatgrass is not a county - listed noxious weed, however, it is a State of Colorado listed noxious weed. Cheatgrass is an invasive species that quickly spreads and it poses an immediate fire hazard once it has been established. The seed of cheatgrass has a very long awn and will attach itself to vehicles and other items. The obvious concern is the potential of cheatgrass to attach itself to any of these items that are stored on site and to be carried to a previously cheatgrass free site. Mr. Anthony indicated that the Applicant shall provide to the County a commitment to minimize the spread of cheatgrass through any activities on site. This may include, but is not limited to, 1) a plan to wash items before they leave the site, and 2) a plan that details how cheatgrass seed production will be eliminated. (B) The County Commissioners may require security before a permit for special or conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable by the County Commissioners in the amount calculated by the County Commissioners to secure the execution of the site rehabilitation plan in workmanlike manner and in accordance with the specifications and construction schedule established or approved by the County Commissioners. Such commitments, bonds or check shall be payable to and held by the County Commissioners; Response: The Applicant shall comply with this provisions if deemed necessary by the Board of County Commissioners. The Applicant asserted that if any bonds, commitments, or other security is deemed necessary, the Applicant will comply. (C) Impacts set forth in the impact statement and compliance with the standards contained in Section 5.03.08 of this Resolution. (A. 93-061) Response: See responses in Section 5.03.08 below. Section 5.03.08 !Industrial Performance Standards/: Pursuant to section 5.03.08 of the Zoning Resolution, all Industrial Operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, Dalbo, Inc. Special Use Permit BOCC — 6/16/03 Page 13 glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards: (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. Response: Volume of sound generated by the proposal has been addressed previously in this memorandum. The Applicant noted that the proposed operation shall comply with the maximum standards established in the CRS 25-12-103. Upon a receipt of a legitimate allegation of a violation with respect to noise, the Applicant will be required to provide proof of compliance with State dB levels. (2) Vibration generated: every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. Response: No vibration is anticipated with the proposed use. Upon a receipt of a legitimate allegation of a violation with respect to vibration, the Applicant will be required to provide proof of compliance with applicable Federal, State, and County laws, regulations and standards. (3) Emissions of smoke and particulate matter: every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations and standards. Response: No emissions of smoke and particulate matter are anticipated as part of this project. Upon a receipt of a legitimate allegation of a violation with respect to smoke or particulate matter, the Applicant will be required to provide proof of compliance with applicable Federal, State, and County laws, regulations and standards. (4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. Response: No emission of heat or radiation is anticipated as part of this project, aside from the emissions from the trucks. Upon a receipt of a legitimate allegation of a violation with respect to the emission of heat and radiation by the proposed use, the Applicant will be required to provide proof of compliance with applicable Federal, State, and County laws, regulations and standards. (5) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas: (A) Storage offlammable or explosive solids or gases shall be in accordance with accepted standards and laws and shall comply with the national, state and local fire codes and written recommendations / comments from the appropriate local protection district regarding compliance with the appropriate codes; Response: The Applicant noted that any flammable soils or gases will be stored in accordance with accepted laws and standards. The Applicant shall comply with all Local, State and Fire Codes that pertain to the operation of this Facility. This application was referred to the Rifle Fire Protection District, however, not comments were obtained. (B) At the discretion of the County Commissioners, all outdoor storage facilities may be required to be enclosed by fence, landscaping or wall adequate to conceal such facilities from adjacent property; Response: The Applicant asserted that if required, fencing or landscaping of the facility from adjacent properties will be accomplished. (C) No materials or wastes shall be deposited upon a property in such form or manner that they may be transferred off the property by any reasonably foreseeable natural causes or forces; Response: No materials or waste are associated with the proposed use. All garbage generated will be stored within standard garbage receptacles and will be removed accordingly. (D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above and the following standards: 1. The minimum lot size is five (5) acres and is not a platted subdivision. 2. The equipment storage area is not placed any closer than 300 ft. from any existing residential dwelling. 3. All equipment storage will be enclosed in an area with screening at least eight (8) feet in height and obscured from view at the same elevation or lower. Screening may include berming, landscaping, sight obscuring fencing or a combination of any of these methods. 4. Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m., Mon. -Fri. Response: The subject property is 35 acres in size and is not part of a platted subdivision. There are no residential dwellings within 300 ft. pf the property. The Applicant noted that if deemed necessary, the storage area will be scree' All repairs and maintenance will be conducted within the shop. All loading and unloading of equipment will occur on the property. (E) Any storage area for uses not associated with natural resources, shall not exceed ten (10) acres in size. (A97-112) Response: The Applicant noted that the storage areas are associated with natural resources extraction. (F) Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property (A97-112) Response: As previously noted in this memorandum, lighting will be installed to light up the area around the shop / office and the tank farm. The locations of the proposed lights are delineated on the site plan. This lighting will be on an electric eye to turn on at dark. The lighting used will be directed to minimize any off premise lighting. The Applicant noted that electrical service is in place and available from Public Service Company (PSCo). The Applicant provided in the application a copy of a application for new gas and electric service. This application was referred to PSCo, however, no comments were received. (6) Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Health Officers must be met before operation of the facilities may begin. Response: The only chemical being stored on site will be a weak salt solution, that is non-toxic and non -hazardous, known as potassium chloride (KCl). The maximum amount to be store on site would be 2,500 bbls. The Applicant has provided a copy of the Material Safety Data Sheet on KCl. There is no real or potential impact to surface or ground water supplies. This application was referred to the State Health Office for comments, however, none were received. In the event of potential violations with respect to water pollution, the Applicant will be required to provide proof of compliance with applicable Federal, State, and County laws, regulations and standards. Special Use Permit BOCC — 6/16/03 Page 16 Section 9.03.05 [Periodic Review ofSUPJ: Pursuant to section 9.03.05 of the Zoning Resolution: Any Special Use Permits may be made subject to a periodic review not less than every six (6) months if required by the County Commissioners. The purpose of such review shall be to determine compliance or noncompliance with any performance requirements associated with the granting of the Special Use Permit. The County Commissioners shall indicate that such a review is required and shall establish the time periods at the time of issuance of a Special Use Permit. Such review shall be conducted in such manner and by such persons as the County Commissioners deem appropriate to make the review effective and meaningful. Upon the completion of each review, the Commissioners may determine that the permit operations are in compliance and continue the permit, or determine the operations are not in compliance and either suspend the permit or require the permittee to bring the operation into compliance by a certain specified date. Such periodic review shall be limited to those performance requirements and conditions imposed at the time of the original issuance of the Special Use Permit. Response: At the discretion of the Board, this SUP may be subject to periodic review no less than every six months. Shall the Board feel that periodic review is required, the Board shall indicate that such a review is required and shall establish the time periods at the time of issuance of this SUP. III. ADDITIONAL COMMENTS 1. Doug Dennison, Garfield County Oil and Gas Auditor provided comments with respect to the proposal (see Exhibit H). The Applicant responded to Mr. Dennison's comments (see Exhibit I). The Applicant's responses were forwarded to Mr. Dennsion for review, however, no additional comments were received from Mr. Dennison prior to the distribution of this memorandum. 2. Matt Sturgeon, Planning Director of the City of Rifle, noted in his comments that the subject property falls within the City of Rifle watershed boundary and that the proposed use is subject to the City's Watershed Ordinance (see Exhibit J). The Applicant has submitted the required application form and provided a copy of watershed study (see Exhibit K). IV. RECOMMENDED FINDINGS: 1. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07, 5:03.08 and 9:03) the Garfield County Zoning Resolution of 1978. V. STAFF'S RECOMMENDATION: Staff recommends that the Board APPROVE the Dalbo, Inc. Special Use Permit for the storage of vacuum trucks and frac tanks, office, and truck maintenance shop, subject to the following conditions: `" 1 boa5iik 1. All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Applicant shall comply with all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended. 3. The Applicant shall comply with all State and Federal regulations and standards, such as Noise Abatement, Water and Air Quality. 4. The Applicant shall provide a commitment to minimize the spread of cheatgrass through any activity on-site. This may include, but is not limited to, 1) a plan to wash items before they leave the site, and 2) a plan that details how cheatgrass seed production will be eliminated. These commitments shall be reviewed and approved by the Garfield County Vegetation Manager, prior to the issuance of the Special Use Permit. 5. The Applicant shall comply with the following recommendations from the Garfield County Road and Bridge Department: A. A 30 -foot right-of-way shall be deeded to the County from the centerline of County Road 319, east onto the property. No fences or structures shall be built within this deeded right-of-way. A stop sign shall be placed at the exit of the driveway. The stop sign shall be of the size and located as required by the manual on Uniform Traffic Control Devices. D. Truck turning signs shall be located on County Road 319 on either side of the driveway access for traffic going both north and south. The signs shall be of the size and located as required by the Manual on Uniform Traffic Control Devices. E. A sign showing the name of the company shall be in a visible location for emergency purposes. 6. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation shall comply with applicable Federal, State, and County laws, regulations and standards. 7. The Applicant shall comply with all Local, State and Federal Fire Codes that pertain to the operation of this type of facility. 8. Prior to the issuance of the Special Use Permit, the Applicant shall provide a copy of the actual well permit. In addition, documentation shall be provided regarding the physical quantity of the well for the propose uses. Should the physical water of the well not support the uses, the Applicant shall obtain additional water allotments or a water augmentation plan. 9. Any signage installed on-site shall comply with the County's sign regulations. 10. Any changes to the Special Use Permit for the storage of 30 vacuum tanks and 200 frac trucks, office / maintenance shop, truck wash bay and Potassium Chloride storage, will require a new Special Use Permit. 11. Rehabilitation of the property, shall the use terminate, shall consist of the following: A. All frac tanks shall be hauled away. B. All vacuum trucks shall be driven away. C. All KCI storage tanks shall be hauled away. D. Building and structures may stay and be sold to other industrial uses. E. Replacement of stockpiled topsoil. F. In the fall of 2002 I made a number of trips to the Garfield County. Again in the early spring of 2003 I began the search for a site in Garfield County. We believe that the site on County Road 319 will best serve the needs of all. Response to 1. Most gas producing wells also produce a small amount of production water. This water will need to be hauled away from the well site continually. If the drilling activity were to decrease in the Mamm Creek area truck traffic would decrease also. If drilling & producing activity in the area decreases, then truck activity would be scaled down accordingly. Drilling activity in other parts of the county are being serviced by use now. Dalbo has also purchased property in the Debeque, Colorado. When needed trucks and storage tanks will be transferred to that property to service the drilling and gas producing activity there. In conclusion, if the gas wells continue to produce in the Mamm Creek area this trucking facility will be utilized. Response to 2. Our original application for a water well included the use of water other than that of drinking and sanitary use. After a discussion with Dwight Whitehead, Colorado Division of Water Resources in Glenwood Springs, it was decided that we would first drill a well for the drinking and sanitary use. Storage Yard and Maintenance Shop 1250 County Road 319 Garfield County, CO Watershed Permit City of Rifle June 9, 2003 RECEIVED JUN 10 2003 GARFIELD COUNTY BUILDING & PLANNING Introduction Dalbo, Inc. has been in the water hauling business for over 30 years. They have hauled water primarily for the oil & gas industry. Dalbo, Inc.'s function in the drilling and production of oil & gas wells has been the hauling of fresh water to drilling rigs, hauling of produced water to waste water pits, and renting water storage tanks. Dalbo, Inc. is currently working in the Rifle area. They are renting a small truck maintenance shop in the Debeque, Colorado and a tank storage yard on the I-70 frontage road west of Rifle, Colorado. Dalbo, Inc. is looking forward to the purchase of property and the construction of a maintenance shop and office in Rifle, Colorado. Proposed Activity 1. Our current and future plans for the subject property is a storage yard for our trucks. Dalbo has about 30 trucks working in the Debeque and Rifle areas. Typically these trucks haul fresh water to the drilling rigs. They also haul produced water from gas wells to the water evaporation ponds. On occasion, they will haul a weak salt solution to the well locations, known as Kcl water. Trucks will be empty while parked or stored at the subject property. 2. A 50' X 100' maintenance shop will be built with a 26' X 40' office attached to the shop. This shop will be used for light duty repair and periodic maintenance of the trucks. All fabrication, welding, and painting of trucks is done at the main shop in Vernal, Utah. Restroom facilities will be available for the employees. A septic system would be installed to handle the restrooms. Included is a copy of the engineers report for the septic system and a report on the types of soils in the area. A water well would be drilled for water for the restrooms. Two full time mechanics and two full time secretaries will work at the subject property. No permanent living facilities are planned at the subject property. Drivers would drive their personal vehicles to the yard and get into their assigned truck to go to work. 3. About 200 water storage tanks are currently being used by various oil & gas companies in the Rifle and Debeque areas. These water tanks a stored and moved when they are empty. The water trucks put water in them when they are placed on drilling locations. 4. A truck washing facility would be built to wash trucks. It would operate much like a carwash except the wash water would be recycled. All silt and dirt washed from the trucks would be collected and hauled to the county landfill. 5. Kcl storage tanks would be built to hold a weak salt solution known as Kcl water. A copy of the MSDS sheet is included for KCL. It is a non-toxic and non -hazardous solution. It is used to reduce the swelling of clay in the underground formations. Usually a 2% Or 3% solution is used. The Kcl storage tanks will be place in a concrete containment pond. It is hoped that the water well will produce enough water for Kcl water. If the well will not produce enough water for our needs then fresh water will be hauled to mix the Kcl water. Water Use After a discussion with Dwight Whitehead, Colorado Division of Water Resources in Glenwood Springs, it was decided that we would first drill a well for the drinking and sanitary use. About 450' east of County Road 319 on the subject property there is a dry gulch. We propose to install a 4' culvert in this dry gulch to gain access to the back part of the property. It is not our intent to impede the flow of surface water. No trash, silt from the truck wash, or foreign matter will be deposited on site. All of these items will be taken to county landfill. Approximately 4.5 acres will be gravel yard, used for the truck storage, shop and office, truck wash, and the Kcl storage tanks. An additional 3-4 acres will be used to park the water storage tanks. The remaining acreage will be Left in native grasses. About 20 acres of hillside will remain as is, with no change. Best Management Practices All servicing of trucks will be done in the maintenance shop, all truck washing will be done at the truck wash facility, all silts and dirt from the truck wash will be taken to the county landfill, all trash and foreign matter will be taken to the county landfill, all maintenance shop practices will be in accordance to standard OSHA work practices, all Kcl water will be properly stored in the concrete containment pond, all tanks used for Kcl water will be new or in good working condition, and all access to the subject property will be through the access granted by the Garfield County Road Permit. Drainage is approximately 1% to the north. A percolation test/soils evaluation was conducted on the property of reference on 05/13/03 by Tom A. Cronk, registered professional engineer (R.P.E.). The perc excavation trench (excavation C) was located approximately 30' south of the north property line and approximately 255' east of the west property line. Additional perc holes were located 85' west of the trench (excavation B) and 155' west of the trench (excavation A). The perc test was intended to provide subsurface design parameters for design of an individual sewage disposal system (ISDS) for commercial use. As based on results from this subsurface investigation, the following ISDS design has been prepared. Results from the 05/13/03 perc test/soils evaluation are attached for reference as Appendix A. 2.0 Development of Design Parameters A perc excavation trench (excavation C) was extended to a depth of 120" below ground surface (BGS). There was no evidence of ground water or high seasonal water table in the open excavation to a depth of 120" BGS. The soils evaluation indicates three distinct soil horizons underlie the site. A lithological description follows: depth (in.) description 0" - 18" sandy clay loam, light brown; grainy and friable 18" - 60" sandy clay, tan; blocky; friable; moldable 60" - 120" clayey sand and sand, tan; medium dense; smeared; friable As based on the perc test results (Appendix A), a weighted design perc rate of 40 min/inis chosen for overall system sizing for subsurface discharge below a depth of 18". Page 2 of 9 3.0 System Design A trench absorption field is proposed for discharge of septic effluent at the site. As shown in the attached graphics, the absorption field will consist of three trenches 2' wide and 57' long. The trenches will be excavated to a depth of 72". After excavation, 48" of gravel fill (1.0"-2.5" screened rock with aggregate components of uniform size) will be used to construct a level seepage bed in each trench. Adjacent trenches shall be separated by a minimum horizontal distance of 6' (10'-12' separation recommended for ease of construction) of undisturbed soil. Septic effluent distribution piping in the absorption field will consist of a 4" perforated discharge line placed level (end-to-end) down the center of each trench. As shown in the attached graphic, the perforated line will terminate 18" from the ends of each trench. The perforated line will be embedded in the gravel seepage fill with a minimum of 42" of gravel under, and 2" of gravel over each pipe. Ends of the perforated lines will be looped with solid piping to adjacent trenches. As shown in the attached graphics, septic effluent will be delivered from the septic tank to each of the three trenches through a distribution box to assure equal distribution of septic effluent to each trench. As shown in the attached graphics, floor drain effluent from the shop area will plumbed separately from the solid waste building sewer. Floor drain effluent will be discharged to a 1,000 gallon oil/water separator (a 1,000 gallon septic tank may be used for the oil/water separator). Effluent from the oil/water separator will be combine with septic tank effluent for discharge to the absorption field. Native soil will be used to fill the remaining 18" of trench excavation and construct a soil cap over the absorption field. Before placing the soil cap, synthetic filter fabric ("myrafi", 140-200 mesh), hay, or untreated building paper will be placed over the gravel bed to prevent intrusion of fine soils. The native soil backfill will be mounded 5% over each trench to promote surface flow runoff in the vicinity of the absorption system. The installer should confirm the feasibility of gravity discharge of sewage effluent from the structure to the absorption field by field verification of assumed design parameters. Assumed design parameters with respect to gravity discharge include: • distance from exit of sewage pipe at foundation line to absorption field - 60' or less, • elevation of ground surface at entry to absorption field must be no more than 14" above the invert elevation of sewage pipe at exit from foundation line. If field measurements do not confirm these design assumptions, gravity discharge of septic effluent from the proposed structure can not be assured and a lift station may be required. Please contact the design engineer to address any design modifications necessary if these design assumptions are not upheld. The installer must also confirm the setbacks from property lines, building envelopes, and existing easements shown in the attached graphics are maintained. Additionally, any unknown utility lines, easements, or other adverse conditions disclosed during construction must maintain the required setbacks listed on page 6 of this document. Sewage loading for the ISDS will include lavatory and water closet service for 3 employees and customers associated with a 1,000 sq. ft. office area and 5,000 sq. ft. shop. As discussed above, a trench absorption field is proposed to discharge septic effluent to the underlying sub -soils. As shown in the attached graphics, the absorption field will consist of three trenches, each 2 ft wide, 72 in. deep, and 57 ft long. If at any time during construction, subsurface site conditions are encountered which differ from the design parameters developed in Section 2.0 construction activities will stop and the design engineer will be contacted to address any necessary design modifications. • Installation procedures including grade, location, setbacks, septic tank size, and absorption field size shall conform with the attached graphic details. Construction activities and system components will not encroach upon existing easements or utility corridors. A minimum of 6 ft of undisturbed soil shall be maintained between individual absorption elements and the septic tank and/or adjacent absorption elements. Diversion ditches necessary to divert surface flows around the new absorption bed must maintain the minimum setbacks listed above. • All sewer lines and effluent distribution piping shall be 4 inches in diameter, have glued joints, and shall be looped at termination of discharge. Septic tank effluent lines shall be placed level in the absorption field. All lines discharging sewage from the residence to the septic tank shall maintain fall of between 1/8 in. and 1/4 in. per foot and shall employ sweep 90's or 2-45's at all turns. Sewer lines from the dwelling to the septic tank and at least 6 ft from the septic tank outlet must meet minimum standard ASTM -3034. Sewer lines under driveways shall always meet minimum Schedule 40 PVC standards and shall be encased with corrugated metal pipe when covered with less than 24" of soil. Page 6 of 9 • The installer shall not place fill in the open excavation until inspected and approved by the design engineer. Additionally, the final cover shall not be placed on sewer lines, septic tank, or the absorption area until the system has been inspected and approved by the design engineer. Provide 48 hour notice for all required inspections. • A non -corrodible Orenco filter (model # FTW0444-36MA) shall be installed at the final outlet Tee of the septic tank or in the effluent line between the septic tank and the absorption field to limit the size of solids and sludge passing into the absorption field. The filter must be accessible for cleaning and replacement from the ground surface. • The distribution box shall be set level on undisturbed native soil or a structural pad (e.g., compacted fill or concrete) to prevent settling and promote uniform distribution of flow to the absorption field. A 45 degree bend shall be turned down on the septic influent line to damp surge flows from the septic tank and promote equal distribution. • The seepage trenches shall be constructed with a 48 in. layer of 1.0 in. to 2.5 in. screened rock spread evenly over each trench. The effluent distribution lines will be placed level in the seepage beds with 42" of gravel under, and 2" of gravel over each line. A covering of untreated building paper, hay, straw, or synthetic filter fabric (e.g., "myrafi", 140-200 mesh) shall be placed on top of the gravel absorption trenches before placing the surface cap. The surface cap shall be mounded 5% over the absorption trenches to promote surface runoff. • The system contractor shall be aware of the potential for construction activities to reduce soil permeabilities at the site through compaction, smearing, and shearing. The following precautions and construction procedures should be employed during installation to minimize disturbance to native soils: Excavation should proceed only when the moisture content of the soil is below the plastic limit. If a sample of soil forms a rope instead of crumbling when rolled between the hands it is too wet and should be allowed to dry before excavation continues. i. Excavation and backfill equipment should work from the surface where at all practical to avoid compaction of the soils at depth. The bottom and sidewalls of the excavation should be left with a rough, open surface. The appearance should be that of broken or ripped soil as opposed to a sheared, smeared, or troweled surface. Any smoothed or smeared surfaces should be removed with a toothed rake or shallow ripper taking care to remove loose residues from the bottom of the trench by hand if necessary. v. Care should be taken in placing fill materials in the excavation to avoid damaging the exposed soil surfaces. Page 7 of 9 4.2 Operation - Maintenance and Inspections • The owner shall install a structural barrier if necessary and take precautions to prevent vehicular traffic, excessive surface watering, accidental flooding, or other activities in the vicinity of the absorption field which may compact, saturate, or otherwise alter the subsurface soil parameters used in designing the septic system. • The owner will plant and maintain grass or other shallow rooted cover crop to prevent erosion and promote evapotranspiration over the absorption field. • The owner will inspect and maintain the required mounding and drainage away from the absorption field to prevent saturation from precipitation and surface flows. • To mitigate the generation of preferential flow channels which may compromise the operation of the system, the owner will inspect and prevent intrusion of burrowing animals and deep rooted plants into the absorption field. • The septic effluent filter shall be inspected and cleaned as necessary every six (6) months. • The owner will conduct periodic maintenance of the septic system by removing accumulated sludge from the septic tank every 3-4 years to prevent clogging of the absorption field. Weeds on the Garfield County Noxious Weed list are not common on this site, however cheatgrass (bromus tectorum) is found in the area. Cheatgrass is not a County -listed noxious weed, however it is a State of Colorado listed noxious weed. Cheatgrass is an invasive species that quickly spreads and it poses an immediate fire hazard once it has become established. The seed of cheatgrass has a very long awn and will attach itself to vehicles and other items. The obvious concern is the potential of cheatgrass to attach itself to any of these items that are stored here and to be carried to a previously cheatgrass free site. I am requesting that the applicant provide to the County a commitment to minimize the spread of cheatgrass through any activities on this site. This may include, but is not limited to: 1. A plan to wash items before they leave the site. 2. A plan that details how cheatgrass seed production will be eliminated.
