LOCATION: 3627 County Road 100 ZONING: Rural (R) TYPE OF APPLICATION: Administrative Review for Accessory Dwelling Unit I. GENERAL PROJECT DESCRIPTION The Applicant is proposing the addition of an accessory dwelling unit on their property. The site is 3.99 acres in size and is improved with an existing home approximately 2,000 sq.ft. in size. Two wells are located on the site both approved for household use only. The Applicant's goal to share the wells between units may require additional review by the Division of Water Resources. A new septic system would be required for the ADU and may require engineering based on soils and drainage in the area. The proposed unit is anticipated to utilize an existing foundation on the property and would likely be constructed as a second floor unit above a garage. The proposed accessory unit size is approximately 1,900 sq.ft. The property is served by an existing access drive off of the County Road. A variety of uses currently are conducted on the site some of which temporary or pre- existing and nonconforming. The Applicant will need to document that all uses are in compliance with the Land Use and Development Code as part of the Administrative Review Process. In addition, The proposed size of the ADU does not meet the code limitation in Section 7-701 as the lot is slightly less than 4 acres in size resulting in a maximum ADU size of 1,500 sq.ft. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS Garfield County Comprehensive Plan 2030 as amended • Garfield County Unified Land Use Resolution of 2008 as amended o Article 111, Zoning • Rural Zone District - Lot/Building Requirements (Table 3-201) and Use Table (Table 3-403) o Article IV, Application and Review Procedures • Administrative Review (Section 4-103) • Common Review Procedures (Section 4-101) • Table 4-102 Common Review Procedures and Required Notice • Table 4-201 Application Submittal Requirements • Description of Submittal Requirements (Section 4-203) • Section 4-118 Waiver from Standards • Section 4-202 Waiver from Submittal Requirements 0 Article VII, Standards — Division 1 General Standards, Division 2 General Resource Protection Standards, Division 3 Site Planning — as applicable • Standards Applicable to an Accessory Dwelling Unit (Section 7-701) 111 COMPREHENSIVE PLAN 2030 1n Chapter 2, Future Land Use, the Garfield County Comprehensive Plan 2030 indicates that ADU`s shall be included in the Comprehensive Plan density recommendations. The property is designated Residential Medium, RM (6 to < 10 Acres/DU). Analysis of the density calculation and general conformance of the Application to the Comprehensive Plan will be part of the development review process, IV. REVIEW PROCESS In summary, the Application will follow the Administrative Review Process contained in Sections 4-101 and 4-103 and Table 4-102: 1. Pre -application Conference 2. Submittal of Application (3 copies plus a copy on CD) 3. Determination of Completeness 4, If Technically Complete the Applicant will be notified and the request scheduled for a Decision by the Director, If it is not Technically Complete the Applicant will be advised of the deficiencies. 5. Additional copies of the Application are provided for referral agencies_ 0. Applicant completes public notice mailing by certified mail to adjacent property owners within 200' and mineral rights owners on the property. The mailing is required to be a minimum of 15 days prior to the Director's Decision 7. Staff prepares a report including public and referral comments 8. Director's Decision 9. Ten day call-up period after which the action becomes final provided there are no requests for a call-up by the Board of County Commissioners or requests for reconsideration. 10, Once all conditions of approval are met the Director can issue the Land Use Change Permit. V. ADDITIONAL DETAILS ON PROCESSING AND SUBMITTAL REQUIREMENTS In addition to the submittal requirements documented in Table 4-102 and Section 4-203 the following clarifications are provided. • The pre-application discussion included the Review Procedures and Public Notice requirements. • A fist of property owners within 200 ft. will have to be provided and said owners will receive public notice of the date set for the Director's Decision. information on mineral rights ownership on the site will also be required and owners of mineral rights will also receive public notice. also needs to be • A copy of a deed confirming the Applicant's ownership of the property provided along with any authorizations to represent and statements of authority (typically required for LLC's and Corporations). • The Application will need to demonstrate a legal and physical supply of water (water supply plan). Water pump tests and water quality testing will be required. • The access driveway will need to comply with the County Roadway Standards contained in Table 7-107 or waivers from specific standards may be requested. • An updated County Road and Bridge access permit may be required. • A waste water treatment plan with information regarding on-site waste water treatment (formerly known as an ISDS) will be required. • The Application will need to address any natural hazards or soils constraints on the site, • The Site Plan needs to show improvements on the site including proposed locations for access driveways, parking areas, proposed infrastructure, existing structures, and the proposed ADU. • The Applicant may request waivers from submittal requirements in accordance with Section 4-202. Submittal waivers for a Development Agreement, Improvements Agreement, and elements of the Impact Report may be appropriate. Landscaping submittal requirements may be addressed as part of the Site Plan with an indication where existing vegetation is found on the site. Traffic study requirements and potential waivers may be complicated by the other pre-existing uses operated on the site and how that traffic is to be evaluated. • A waiver from the size limitations contained in Section 7-701 would be required if the applicant chooses to propose an ADU larger than 1,500 sq.ft. The waiver criteria contained in Section 4-118 will need to be addressed, VI. APPLICATION REVIEW a. Planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing body which in the case of Administrative review is the Director of the Building and Planning Department. Our Building Lot is 3.994 acres. i request that a floor area not to exceed 3000 square feet be the standard for this project. • I believe this subject standard achieves the same intent due to the high percentage of usable ground and negligible shortfall below 4 acres of subject property. • This standard imposes no greater impact on adjacent properties because the number of bedrooms will remain the same at 3 bedrooms. This will allow us to make bedrooms a better size and allow for some modern passive energy design elements to utilities and utility rooms (laundry, mud, and kitchen) to make this dwelling more efficient and innovative. To clarify my intent on this project as explained in the pre -app meeting. I intend to use this dwelling for my family of 3. We love our 1970's tri -level home but a more modern and efficient home is what we are working towards. Article 7: summary 7-101— Zone district and use regulations - This application is for a dwelling which falls under allowed uses. We have grandfathered non -conforming uses on subject property that support important economic events in our valley such as the ESPN X -Games_ We support projects and contractors working on our hospitals and highways to improve them and make them safer for the general public. We have excellent relations to our closest neighbors and keep our property clean and quiet. We are in contact with zoning officials. 7_102 —We are in general conformance with the Garfield County Comprehensive Plan. 7 -103 --This use is in balance with area. 7-104 — We have 2 wells. Please refer to application for details. 7-105 --We intend to use a septic and leech field for this and have the necessary room to comply with required setbacks. 7-106 — Electrical service is already in place and we intend to extend natural gas from existing dwelling and service lateral is sized to have an additional meter. 7-107 — Access off county road already exists in 3 locations on private driveway large enough for all sized vehicles including fire engines. 7-108 — No natural hazards exist. See maps. 7-109 — Fire protection is already provided. 7-201— No changes in agricultural improvements. 7-202 — No changes to wildlife habitat. 7-203 — No water bodies on land. 7-204— Drainage and erosion control already exist and the project will improve this in landscaping by dwelling. 7-205 — No environmental quality issues on this project. 7-206 — Low wildfire hazard area see map. Line item 1= Surface Use Leases and Easements and encumbrances. These are on new contour map and site plan. A Holy Cross easement with reception # 250811 Book 422 Page 77 is on new site plan. No other lease, easements or encumbrances exist. Line item 2 = Mineral rights. See attached search and results. Line item 3 = Grading and Drainage. Subject property is gradually graded from Northeast to Southwest corner with irrigation ditch capturing any surface water from rain or snowmelt with mature natural grasses and trees to control erosion. Snow storage mostly occurs along Southern edge of Lot. See contoured Site Plan. Line item 4 = Impact Analysis. Section 4-203(G) The determination of this impact analysis concludes that this project will be in harmony with what exist on and around subject property. It is also determined that the addition of this dwelling will enhance the overall long term conditions on property. 1. Adjacent Land Use —Varies from commercial to residential with multiple PUD's within 1500 foot radius. 2. Site Features - Include mostly gentle to flat grass and gravel lands with many trees. It has dwelling and assessory structures. 3. Soil Characteristics - Soils on this site are not problematic for building. See map 4. Geology and Hazard - No geologic hazards exist on subject property. See map 5. Groundwater and Aquifer Recharge Areas - Subject property is not in a floodplain area. This area supports septic tank and leech field systems well with no impact on groundwater aquifer. 6. Environmental Impacts— The determination is this development will be in harmony with what exists on and around property. a. The determination is that the flora and fauna will be improved in short and long term from nuisance weeds to native grasses and trees. b. The determination is that the resources will be increased for wildlife with increased native grasses. c. No changes in impacts on wildlife or domestic animals will be created with this dwelling. d. No radiation hazards exist on subject property and Radon gas levels are low in existing dwellings on property. 7. Nuisance - The determination is this dwelling will not cause or be a nuisance with vapor, dust, smoke, or undue noise, glare or vibration. 8. Hours of Operation - This dwelling will used for living space and the hours of operation considered normal for this use. Line item 5 = Access and Roadways.
