At a meeting of the Board of County Commissioners for Garfield County, Colorado,
held in the Commissioners' Meeting Room, Garfield County Administration Building, in
Glenwood Springs on, Monday, the 5Ih day of June 2006, A. D. there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION No. 2006-69
A RESOLUTION CONCERNED WITH A ZONE DISTRICT AMENDMENT FOR A 8.49
ACRE PROPERTY LOCATED AT 335 VILLAGE DRIVE, RIFLE, COLORADO
OWNED BY BRIAN AND TANNI RUST
WHEREAS, the Board of County Commissioners of Garfield County, Colorado,
received a Zone District Amendment application from Brian and Tanni Rust for an 8.49
acre property located at 335 Village Drive, Rifle, Garfield County, State of Colorado; and
WHEREAS, the Zone District/Text Amendment proposes the following changes to
the property as follows: to Amend the zone district of the Rust property from Residential
Limited Urban Density (RLUD) to Agricultural Rural Residential Density (ARRD).
WHEREAS, on May 10th 2006, the Garfield County Planning Commission, in a
public meeting, recommended that the Board of County Commissioners approve the Zone
District Amendment; and
WHEREAS, on June 5th 2006, the Board of County Commissioners held a public
hearing upon the question of whether the Zone District Amendment should be granted,
granted with conditions, or denied at which hearing the public and interested persons were
given the opportunity to express their opinions regarding the amendment; and

WHEREAS, the Board of County Commissioners, on the basis of substantial
competent evidence produced at the aforementioned hearing, has made the following
determination of facts:
1. Proper publication, public notice, and posting were provided as required by law for
the meeting before the Planning Commission and the hearing before the Board of
County Commissioners.
2. The meeting before the Planning Commission and the hearing before the Board of
County Commissioners were extensive and complete; all pertinent facts, matters
and issues were submitted and that all interested parties were heard at those
hearings.
3. The application is in compliance with the standards set forth in the Garfield County
Zoning Resolution of 1978, as amended.
4. That for the above stated and other reasons, the proposed Zone District
Amendment is in the best interest of the health, safety, convenience, order,
prosperity and welfare of the citizens of Garfield County.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County Colorado that based on the determination of facts set forth above, the
Zone District Amendment for the 8.49 acre property at 335 Village Drive, Rifle, Colorado is
approved as follows:
The zone district for the 8.49 acre property at 335 Village Drive, Rifle, Colorado
shall be zoned ARRD, all applicable land use regulations for that zone district will
be pursuant to§3.02 of the Garfield County Zoning Resolution of 1978, as
amended.
