COLORADO 61601 June 26, 1973 Mr. Lamont Kinkade Garfield County Sanitarian 2014 Blake Avenue Glenwood Springs, Colorado 81601 Re: Application for Zoning Variance of Wendell -and Judy Coats Dear Mr. Kinkade: POST OFFICE BOX 195 At the hearing on Thursday, June 21st, 1973, on the application of Wendell and Judy Coats for a zoning variance permitting the construction of a two-family dwelling on their property at Sutank, the Board of Adjustment inquired concerning the sewage treatment facilities on the Coats property and the situation with respect to domestic water. I informed them that you had personal knowledge of the type of sewage treatment facility that the Coats had installed and that you might have information concerning "their water. The Board asked that you write a letter to the Board explaining the type of system which the Coats have including the number of additional bedrooms which it will accommodate (as I recall you told me that the Coats' system would accommodate an additional 7 to 9 bedrooms). Furthermore, if you have any information concerning the Coats well, it would be appreciated. I would appreciate receiving a carbon copy of the letter you write to the Board of Adjustment. Coats Property near Carbondale Gentlemen: This letter will serve to certify that the sewage treatment facilities installed and currently in operation at the Coats residence near Carbondale are more than adequate to handle the additional proposed duplex unit. The system consists of an aerated package treatment unit with post -chlorination and subsurface discharge on lot. These facilities were installed under a permit designed to accommodate the proposed facilities and constitute one of the best systems in the county. The water supply is, in my opinion, adequate and safe to handle the proposed facilities also. Therefore, I would recommend approval of their request provided all other areas of concern have been as adequat- ely fulfilled as have water and sewer requirements. As a result of numerous housing problems in the area of Coats' residence, it should be noted that the dwelling they propose will in all probability be the best dwelling unit in the entire area, will help upgrade the area, and fill the need for such units. The minutes of meeting #34 were approved and signed. The application of Wendell R. and Judy Ann Coats for Zoning Variance was considered. A statement (Exhibit A) withdrawing signatures from the previous petition and a letter explaining the statement (Exhibit B) were presented to the Board by Mr. Jochems and were made part of the record. All of the Applicants' immediate neighbors signed the state- ment with the exception of Mrs. Ice, who refused to retract her name before the saw her lawyer. Mr. Stacey stated that all conditions had been met, the final issue being whether the Applicants must build two separate buildings with a ten foot separation distance or one dwelling unit. Mr. Jackson moved that "variance be granted to Wendell and Judy Ann Coats subject to all of the exhibits they presented" and Mr. Stacey seconded it. The motion was unanimously approved by the members in attendance. Mr. Weaver voted approval by proxy. COATS and JUDY A. COATS (hereinafter Coats) and ROGER B. JARBOE and GEORGIA A. JARBOE (hereinafter Jarboes). RECITALS: 1. Coats are the owners of Lots 7 through 14 inclusive, Block 8, Townsite of Cooperton, Garfield County, Colorado. 2. Coats are on this date conveying Lots 11 and 14 of said Block 8 to Jarboes and are retaining ownership of Lots 7 through 10 to themselves. 3. Lots 7 through 10, the retained property, contain a duplex. 4. Lots 11 through 14, the property to be conveyed, con- tain a single family dwelling. 5. Both the duplex and the single family dwelling are served by one water well and one septic tank and said well and septic tank are located within the Southerly 10 ft. of said Lot 10 and the Northerly 10 ft. of said Lot 11, all as shown on Exhibit "A" which is attached hereto and incorporated herein. 6. Despite the Coats - Jarboe conveyance which is occurring simultaneously with the signing of this agreement, it is the desire of the parties for themselves and their heirs, successors and assigns to provide for the con- tinued co -use and co -ownership of the septic tank and water well. NOW THEREFORE, the parties hereto do covenant and agree as follows: 1. There shall be reserved from the conveyance from Coats to Jarboes an easement to use, along with Jarboes, the Northerly 10 ft. of said Lot 11 and there shall be granted to Jarboes an easement to use, along with Coats, the Southerly 10 ft. of Lot 10. All as hereinafter provided. 2. The purpose of the easement is to maintain the exist- ing septic tank and water well as it now exists and may hereafter be modified and both the Coats and Jarboes agree that they shall do no act inconsistent with the purpose of said easement. 3. The parties shall have equal rights to use the water from the well and shall be deemed to be co-owners of the well and equal rights to use the septic tank and leech field and shall be deemed co-owners of the sep- tic tank and leech field. 4. The parties shall share equally in the expense of op- erating and maintaining the well and septic tank and if any modifications to said water well and septic tank are hereafter required by any governmental authority, or in order to keep the well and septic tank properly functioning, the parties shall share equally in said costs. 5. In the event of any disputes between the parties con- cerning the operation and maintenance of the water well and septic tank, the extent of use by either party of either the water well or septic tank or the sharing of costs for operating, maintaining or improving the water well and septic tank, the parties shall submit said controversy to the Garfield County Sanitarian who shall arbitrate and decide said controversy and the parties agree to be conclusively bound by his decision. 6. The parties hereto do covenant and agree that the ease- ments and rights and duties hereby established are coven- -2- ants running with the land which shall endure for so long as the well and septic tank and used by either of the properties and this agreement shall inure to the benefit of the heirs, successors and assigns of the parties hereto.
