With a few conditions, the DRC has approved your house design for Lot 25 based on drawings submitted May 12th, 2006. This letter will satisfy the requirements of the Garfield County building department. The following conditions will need to be addressed: 1. Construction fencing will be required around not only the Ponderosa in the front but also the groups of trees to the south and west of the house to prevent construction parking etc... 2. Commit to re -vegetation with native grasses etc...where Geo -thermal drilling is located. 3. Vegetable garden with fence is explicitly approved as fencing for a garden, not for privacy or dog containment. 4. Conditional approval is given for the photovoltaic roof panel system granted the final construction details will be provided. The DRC will insist on the adherence of the integration of the system into the roof to minimize the visual impact. 5. Removal of the crab apple trees was agreed upon to avoid attracting bears. 6. The construction of the driveway must adhere to the suggestions written in a letter dated May 11th, 2006 by Stephen Ellsperman relative to the large Ponderosa tree adjacent to the driveway. We recommend that the excavation observation mentioned in the letter be done by Stephen Ellsperman. Thank you for your time and attention to these matters, we look forward to a very handsome and high performance house on your site. Yours truly, Jeff Ellis BCR DRC Chairman RANCH Builders Bond Pursuant to Section 6.1 of the Blue Creed Ranch Design Review Guidelines, "Each builder, prior to beginning any construction shall post a cash bond in the amount of $10,000. In the event of action by the Association or the DRC to remedy any violation of these regulations, the cost of such remedy shall be charged against the bond. Following issuance by the DRC of a Notice of Satisfactory Completion of Improvements to Property, any funds held by the Association in said BuiIder's Bond shall be released to builder within fourteen (14) days of issuance of Notice of Satisfactory Completion or Notice of Conditional Satisfactory Completion" The builder, by placing his signature below, acknowledges that he has received a copy of the Design Review Guidelines and agrees to abide by the rules and regulations set forth in Section 6. The builder has also received a copy of the Schedule of Fines that outlines remedies that may be sought for non-compliance or violations of the regulations. The funds for said Bond shall be placed into an account at a federally insured band of the developer's choice and will only be released, less any costs charged against the Bond if applicable, within fourteen (14) days of issuance of a Notice of Satisfactory Completion of Improvements to Property or Notice of Conditional Satisfactory Completion of Improvements to Property.
