Purchaser's performance under thls contract is expressly coiltin-
gent upon accomplisfurent of each of the following by August 15,

Please consider this letter to be verihcation that the Board of klucation o[ Garfield Schoo]
District RE -2 consultcd with the Garfield Counly Planning Corrml,i*^ion rcgarding the
acquisiliort of a secouiJary rchool site on Highway 6 &.24, between Silt ancl New Castle. This
corrsultation w&s done pursuant to C.R.S. 22-12-124.
At their regular meeting on May 12, 1993, the Planning Commission reviewed the proposed
school site a-nC rcqucsted that the following comments be passad onto the Board ofEducatiorr:
The paroel lies within District C, Rural Areas/Minor Environrnental
Constraints;
Thc property is zoned A/R/RD, which requires a conditional use permit for
sc'hools. When the District is set ort their plans lor a school dcsign, application
for a conditioml use permit should be made to the Board, if the regulations still
rcquire the permit;
One of the stipulal,ions lor the purcham of the property is that a scptic system
permit be acquired prior to tlll5/93. There artr.Bome diffrculties in this
rcquircment. A septic system has to be dcsigned hasetl on projected flows ol
effluent. Garfield Coun ty can o nly issue an individual sewage system (ISDS) for
a sy$tem that ha.r a design capacity of 2,000 gallons per day (Spd) or less. A-uy
system larget than that must go through the site application approval proce$s
with theColorado Department of Heallh, WaterQuality Control Division. This
process can take up to 180 days from the tiate of application to a dccision.

than 54 pupils and teachers, a site application will be requi.ted. If a sewage
system is pl:nLuul at this site, it would he logical to design this system to
accommodate additional rlevelopment that will occur in the ilr€il. Thi.s systeur
would ned to be controlled by a special district with the authority to run a
public sewage treatment facility.
Any water system that provides water fqr 25 people or nrore, has to meet
Colorado Department of Heal th, Drinking Water Standanls. This may require
treatment of the walet beyond that notmally required for residential use. Them
are also additional requirements fortesting and Lhe subnrittal ofthose results on
al least a quartedy basis to the State.
ln the L'over lettcr, a number: of criteria are identified to evaluate the proposed
Iocations lor a new secondary school. One of thc criteria identified is "utilitia.;
avaiJability'. Thi$ site has rro utilitics available that are adequate for a public
school, without substantial costs up front to the District. The construction ofl
a strwage treatment facility will decrease the amount of usable artra for school
facilities. Substarntial reliarrce Lt being placed on the Boarrl's cvaluation of the
vflriour- sites considered. It woutd seern more logical to locate a school facility
in an area with sommunity water and sewer availablc.
