I REQUEST
The Applicant is proposing a PUD text amendment allowing the measurement of building
heights to be taken from the established grade after completion of all lot grading and
excavation, as represented in the applicable grading plan.
The proposed text amendment only controls measuring/enforcing building height
limitations on the following lots:
IRONBRIDGE PUD
Phase ll
Filing 1, Lol225
Filing 2, Lots 62 and 225-249
Filing 3, Lots 77-79,250-270 and 271-296
Phase lll
Lots 1 through 6
Lots within lronbridge Planned Unit Development not identified in the requested text
amendment are subject to building height requirements as defined in $2.02.09 of the
Garfeild County Zoning Resolution of 1978, amended.

S 4.12.03 identifies criteria that shall be used to determine if a modification to a PUD is
warranted. lt states, all provisions of the Plan authorized to be enforced by the County
may be modified, removed or released by the County, subject to the following:

l) No modification, removal or release of the provisions of the Plan by the
County shall aiect the rights of the residents, occupants and owners of the
pllD to maintain and enf6rce those provision at law or in equity; and

Staff finds that the proposal to establish build height provisions on the identified Lots will
not affect the rights otirre residents, occupants and owners of lronbridge PUD to maintain
and enforce those provisions at law or in equity. Staff finds this standard is met'

IV SUGGESTED FINDINGS
1.) The Application is in conformance with Gar{ield County Zoning Resolution of
1978, as amended;

the best interest of the health, safety and welfare of the citizens of Garfield
CountY;
