Colorado, held in the Commissioners'Meeting Room, Garfield County PlazaBuilding, in
Glenwood Springs on Tuesday, the 4th day of June,2007, there were present:

when the following proceedings, among others were had and done, to-wit:

A RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT
AMENDMENT FOR PROPETY OWNED BY ALBERT STARK AND J. BRUCE
SNODE

WHEREAS, the Board of County Commissioners of Garfield County, Colorado
received a request from the Albert Stark and J. Bruce Snode to rezone Parcel No.
211910100018 from Agriculture Industrial ro Commercial General;
WHEREAS, on wednesday, May 9th, 2007, the Garfield county planning
Commission, in a public meeting, forwarded a recomrnendation of approval to the Board
of County Commissioners for the proposed zone district amendment finding that the
conditions of the neighborhood have changed to such a degree to support the requested
zone change from Agriculture Industrial to Commercial General;
WHEREAS, the Board of County Commissioners held a public hearing on the 4e
day of June, 2007 upon the question of whether the zone district amendment shouid be
granted or denied, the Board of Countv Commissioners continued the public hearing until
date cenain June 18th. 2007 J
WHEREAS, the Board of County Commissioners reopened the public hearing on
the 18th day of June, 2007 upon the question of whether the zone district amendment
should be granted or denied, at which hearing the pubiic and interested persons were
given the opportunity to express their opinions regarding the issuance of said amendment;
and

WHEREAS, the Board of County Commissioners, on the basis of substantial
competent evidence produced at the aforementioned hearing, has made the following
determination of facts :
l. That proper notification was provided as required by 1a,.,.' for the meer,ings and
hearings before the Planning Commission and before the Board of County
Commissioners.
2. That the public m'eetings and hearings before the Planning Commission and the Board
of County Commissioners were extensive and complete; all pertinent facts, matters
and issues were submitted; and that all interested parties were heard at those hearings.
3. That the application has met the requirements of the Garfield County Zonrng
Resolution of 1978, as amended.
4. That the conditions of the neighborhood have changed to such a degree to support the
requested zone change from Agricuiture Inciustriai to Commercial Generai.
5. That the proposed zone district amendment has been determined to be in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
NOW, THEREFORE, BE IT RESOL\IED by the Board of County Commissioners of
Garfieid County, Colorado, that based on the determination of facts set forth above. the
request is approved to rezone Parcel No.2i7910100018 from Agriculture lndustrial to
Commercial General.
