THE REQUEST
on April Ll,2o07 the Garfield County Planning Commission initiated arezoneof three, twoacre parcels (parcel numbers 2409-27 lo-o071 , 24og-27 1o-oo7 6 and, 24Og-27 10-0075) andlocated in Section 27, Township 75, Range 96w from Agricultural Residential Rural Density(ARRD) to Resource Lands (RL) - Gentle Slopes and iower Valley Floor (GSLVF).
This rezone initiation was in response to a requested (and subsequently approved) change inzoning for Frac Tech Services, LLC lparcet number z4og-n3o-or r+), the parent andsurroundingTT acte property, in order to prevent the de facto spot zoning of these threeinterior properties. The Planning commission heard the rezone request for the surrounding77 acre Frac Tech services, LLC parcel on April Ll, 2oo7 . At this meeting, the planning
Commission voted 7-0 to recommend that the Board of County Commissioners (BoCC)approve the Frac Tech Services, LLC rezone request from ARRD to RL - GSLyF due tosubstantial changes in the surrounding area. At this same meeting, the planning commissioninitiated the rezoning of the three interior parcels from ARRD to RL - GSLVF). The Boardof County Commissioners held a public hearing concerning the Frac Tech Services, LLCrezone request on May 7,2001 and voted 3-0 to rezonethe surroun ding7l acre parcel (Seebelow)' on September 12,2oo7 the Planning Commission recommended by a vote of l-0that the Board of county Commissioners approve the rezoning of the three aforementionedproperties.

II. LAND USE BACKGROUND
Per Resolution 81-48, thethree subject parcels (parcel numbers 24og-2710-0017 ,2409-2710-0076 and 2409-2710-0075) were split fromihe parenr properry in 19g1. Each interiorproperty is approximately 2.Ol acres. At this time, the properties described as parcelnumbers 2409-2710-0077,2409-2110-0076 and2409-2710-0075 are zoned A/R/R/D.
ilI. PROPERTY DESCRIPTION
The three subject properties are completely surrounded by RL - GSLVF zoning. The parcelowned by Scott Tnigler is currently vacant while the two properties owned bly Frac Techservices, LLC each contain one single family residence. St#f understands that the two FracTech owned single family dwelling units are used for employee housing. These three parcelsare situated at the confluence of a rapidly changing portitn of carreto county. The parcelscan be described as generally flat with a slight ir.tin. from Highway 6 to Interstate 70.Below are photos and descriptions of the devilopment occurring in the surroundin g area:

The parent property is identified as parcel number
2409-273-114 while the land-locked subject
parcels are identified as 2409-273-071;075; and
076. As can be seen, parcels ending rn 077 , OJ 5,
and076 do not have direct access to Highway 6.
Rather, these parcels are allowed access to
Highway 6 via a 20' wide access easement. In the
end, however, these parcels are completely land-
locked within the parent RL zoned parcel.

IV. STAFF COMMENTS
The Colorado Revised Statutes establish the standards of review for rezoning land in the
county. The standards depend on whether the proposed rezoning is in compliance with the
Comjrehensive Plan lthe flan;. If so, the proposed rezoning need only bear a reasonable
relatironship to the general welfare of the community. If the rezoning is in conflict with the
plan, the Applicant needs to show either 1) that an elTor was made in establishing the current
zoning, o. iftnut there has been a change in the conditions ofthe neighborhood that supports
the requested zone change. At present, the subject properties ale designated "Outlying
Residential" in the ptan wtrictr generally conflicts with the Resource Land zone district
sought for the properties. As a result, the rezoning request needs to demonstrate that either
1) a-n error *u, ,rrid" in establishing the current zoning,or 2) that there has been a change in
the conditions of the neighborhood that supports the requested zone change. Staff offers the
following thoughts in addition to the previously provided information:
The subject parcels are identified in the Comprehensive Plan as "Outlying Residential"'
Althougl the proposed RL zoning is generally in conflict with this designation, the RL
zoningio the north as well as the ARRD zoning to the south are both designated as "Outlying
Residential". Hence, although there is a general conflict, staff has not concluded that there is
a direct conflict with the "Outlying Residential" designation and the RL zoning district' ln
fact, it is consistent with past application of the "Outlying Residential" designation to
coincide with the RL zone district. In addition, several uses to the south of the properties
which are industrial in natural have been previously approved by Special Use Permit in the
ARRD zone district. Further, the three subject properties are currently enclaves within the
surrounding RL zone district.
b. Error in Zoning
The current zoning of ARRD for the subject parcels was originally established in the early
1970's, when the area was originally zoned based on uses that existed at the time on the
ground. In this case, the subject properties were zoned residential due to their rural
iesidential and agricultural character. To this end, Staff believes the present zoning of the
subject parcels was not done in elTor.
c. Chanse in Conditions of the Neishborhood
The planning Commission has initiated this rezone based on the interpretation that
conditions of the area have changed enough so that the existing uses that define the area are
more "industrial" in nature and consistent with the uses identified within the Resource Land
zone district. The most significant change occurring in the area which affects the subject
parcels is that the surrounding parent parcel has been rezoned from ARRD to RL' Staff
lor"o6 that conditions in the area have changed significantly since the zoning in the area
was initially established. Note the following uses permitted in the Resource Land zone
district:

3.10 R/L -- RESOURCE/LANDS
The Resource/Lands district shall be subclassified into the following zones:

(4) Gentle slopes and lower valley floor
3.10.04 Gentle slopes and lower valley floor
Uses. bv right: Ranching, farming and general agriculture, accessory uses and structures
related to agriculture; guiding and outfitting.
Single-family dwelling units and customary accessory uses;
Kennel, riding stable and veterinary clinic;
Retail establishment for sale of goods processed from raw materials produced on the lot.
Accessory dwelling unit approved as a part of a public hearing or meeting on a subdivision or
subdivision exemption or guesthouse special use approved after 7 /95 and meeting the
standards in Section 5.03.021.
Pipeline (Subject to review and approval per procedure and requirements of Section 9.07)

Uses. conditional: Church, community building; day nursery and school; studio for conduct
of urt. and crafts; home occupation; utility airport, feedlot as principal use of the lot, group
home for the elderly. (A. 97-60)
Uses. special: allowed by permit only: lndustrial support facilities which would include:
material handling, pumping facilities, electric distribution, warehouse facilities/staging areas,
storage areas, water impoundments, utility lines, utility substations, extraction, processing,
accessory uses to the above; camper park; hunting lodge; mineral waste disposal areas;
public gatherings; commercial park; resort agriculture-related business; sanitary landfill;
recreational support facilities, communication facility, corrections facility, shooting range
facility (A. 97 -60; 98-108; 99-025)
Mass Transit Facility (added 2OO2-I2); Camper Park for the purpose of providing temporary
quarters to employees and contractors of the energy extraction industries. (added 2006-95);

Accessory dwelling unit meeting the standards in Section 5.03.021for any lot not created
after a public hearing or meeting after I195.
Minimum Lot Area: Two (2) acres; except as otherwise approved in a Cluster Option
(2003-r7)
Maximum Residential Lot Coverage: Fifteen percent (l5Vo).
Reouired Setback. other than industrial:
(1) Front yard: (a) arterial streets: one hundred (100) feet from street centerline or seventy
five (75) feet from front lot line, whichever is greater; (b) local streetst seventy-five (75) feet
from street centerline or fifty (50) feet from front lot line, whichever is greater;
(2) Rear yard: One hundred twenty-five (125) feet;
(3) Side yard: One hundred (100) feet from side lot line or one-half (ll2) the height of the
principal building, whichever is greater.
Required Setback. industrial: One hundred (100) feet from any property line unless otherwise
permitted by special use permit.
Maximum Height of Residential Building: (not related to agriculture) Twenty-five(25) feet.
Additional Requirements: All uses shall be subject to the provisions under Section 5
(Supplementary Regulations). (A. 80-180; 81-145; 8l-263; 86-09)
Performance Zone Requirements
The Commission should be aware of the performance standards required for certain
proposed uses in the RL Zone District. In order to conduct some of the following uses,
the Applicant must be sure that they comply with the following:
3.12.08 Additional Requirements: All uses shall be subject to the provisions under
Section 5.00 (Supplementary Regulations). Compliance with Section 5.03.07(Industrial
Operations) and Section 5.03.08 (Industrial Performance Standards), inclusive, shall be
required. If the proposed land use is a "(lse-By Right", compliance must be demonstrated
at the time a building permit application is made to the County.
Conditional and Special [Jses shall require permitting by the County, consistent with the
applicable Sections of this Resolution, for which compliance shall be demonstrated at the
time of Conditional/Special (Jse Permit application submittal.

Atl fabrication, service and repair operations shall be conducted within a building or
obscured by a fence, natural topography or landscaping.
Loading and unloading of vehicles shall be conducted on private property and may not
be conducted on any public right-of-way.
At the discretion of the County Commissioners, all outdoor storage facilities for fuel, raw
materials, andproducts shallbe screenedby naturaltopography, or enclosedby afence or
wall adequate to conceal suchfacilitiesfrom adjacent property. All outside storage abutting
orfacing a lot in a residential or commercial zone shall be screenedby natural topography
or enclosed by a site-obscuring fence, which shall obstruct the storage from view on the
sides of the property abutting or facing a lot. The fence shall be of such material and design
as will not detract from adjacent residences and shall be built according to plans submitted
by the Owner to and approved by the Garfield County Planning Department. If the design is
rejected by the Planning Department, the applicant can appeal the decision to the Gaffield
County Board of Adiustment.
If landscaping is proposed to screen the site consistent with these regulations, a landscape
plan shall accompany the submittal for a special [Jse, conditional use or building permit
application to Gaffield County. This plan shall ffictively buffer the proposed use from
surrounding residential uses and shall be of sfficient detail, for review by the Planning
Department to determine compliance with these regulations.
Evidence must be provided that all industrial wastes shall be disposed of in a manner
consistent with State Statutes and requirements of the Colorado Department of Health.
(Add Amendment gS-27) All residential structures allowed within the Light Industrial Zone
District, whether as a use-by-right or special use, shall meet the following standards:
One (l ) dog will be allowedfor each residential unit associated with a storage use, and the
dog shall be required to be confined within the property boundaries of said use, with
enforcement provisions allowingfor the removal of a dogfrom the area as afinal remedy in
worst cases.
No open hearth solid-fuel fireplaces will be allowed within a residential unit. One ( 1) new
solid-fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations
promulgated there under, will be allowed in any dwelling unit. All dwelling units will be
allowed an unrestricted number of natural gas burning stoves and appliances.
All exterior lighting shall be the minimum amount necessary and all exterior lighting shall
be directed inward, towards the interior of the storage use, except that provisions may be
made to allow for safety lighting that goes beyond the property boundaries.

V. STAFF SUMMARY
In light of the forgoing, Staff makes the following observations:
1) The proposed rezoning generally conflicts with the Comprehensive Plan, but is consistent
with the past application of the Comprehensive Plan;
2) The subject parcels are completely surrounded by the Resource Land - Gentle Slopes and
Lower Valley Floor (RL-GSLVF) zone district;
3) On September 12, 2OO7 the Planning Commission held a Public Meeting regarding the
rezoning of the three 2-acre parcels. At this meeting, the Planning Commission voted 7-0 to
recommend that the Board of County Commissioners rezone the three Z-acre parcels from
Agricultural/Residential/Rural Density (ARRD) to Resource Land - Gentle Slopes and
Lower Valley Floor (RL-GSLVF).

2409-2110-0016 and2409-2710-0015 from Agricultural/Residential/Rural Density (ARRD)
to Resource Land - Gentle Slopes and Lower Valley Floor (RL-GSLVF) in order to avoid de
facto spot zoning.
VI. SUGGESTED FINDINGS
1) That all applicable regulations regarding azone district amendment have been complied with
including, but not limited to, Section 10.00 of the Garfield County Zonrng Resolution of
1978, as amended.
2) That the conditions of the neighborhood have changed to such a degree to support the zone
change from ARRD and RL.
3) That the proposed rezoning from ARRD to RL is in the best interests of the public health,
safety and welfare of citizens of Garfield County.
VII. RECOMMENDED MOTION
"I move that the Board of County Commissioners approve the rezoning of parcel numbers 2409-
27lO-0077,2409-2710-0076 and2409-2710-0075 from ARRD to RL - GSLVF."

As a minimum, specifically respond lo altrtre foilo*ing items below and attach any additional information to
be submitted with this application:

9. Submit payment of the $450.00 Base Fee: Applicant shall sign the "Agreement for Payment"
form and provide the fee with the application.

the Building and Planning Department. Staff will request additional copies once the application
has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(A Zone District Map Amendment is considered a two step process because it is first reviewed by
the Planning Commission which makes a recommendation to the Board of County Commissions.
The following steps outline how the Zone District Map Amendment application review process
works in Garfield County.)
Submit this completed application form (pages 1-4), base fee, and all submittal requirements to
the Garfield County Planning Department. lt will be received and given to a Staff Planner who
will review the application for technical completeness.
Once the application is deemed technically complete, the Staff Planner will send you a letter
indicating the application is complete. ln addition, the letter will indicate the dates and times
scheduled for your request to be heard before the Planning Commission during a public
meeting (no notice required) and the Board of County Commissioners during a public hearing
(notice required). The Planning Commission will fonvard a recommendation to the Board of
County Commissioners to be considered during a properly noticed public hearing. Staff will
send you the appropriate "Public Notice Form(s)" indicating the time and date of your public
hearing and will provide you with a Staff Memorandum regarding your requested Zone District
Amendment. (lf Staff determines your application to be deficient, a letter will be sent to you
indicating that additional information is needed to deem your application complete.)
Please note, if an application includes a request to amend the current designation as defined
on the Comprehensive Plan's Proposed Land Use Districts Map, the request may be
considered at the same meeting before the Planning Commission. However, the request to
amend the Comprehensive Plan shall be considered prior to the request to amend the zoning
map. ln addition, the Applicant shall be required to provide proper notice (as described below)
for the request to amend the Comprehensive Plan for the Planning Commission to hold a
public hearing on the request. Further, the Planning Commission is the final decision maker on
the Comprehensive Plan amendment request whereas the Planning Commission will make a
recommendation on the rezoning request to the Board of County Commissioners.
It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the public
hearing before the Planning Commission and / or the Board of County Commissioners. lf
proper notice has not occurred, the public hearinq will not occur. Notice requirements are as
follows:
a. Notice by publication, including the name of the applicant, description of the subject lot,
a description of the proposed amendment and nature of the hearing, and the date, time
and place for the hearing shall be given once in a newspaper of general circulation in
that portion of the County in which the subject property is located at least thirty (30) but
not more than sixty (60) days prior to the date of such hearing, and proof of
publication shall be presented at hearing by the applicant.

' b.' Notice by mail, containing information as described under paragraph (1)above, shall be
mailed to all owners of record as shown in the County Assessor's Office of lots within
two hundred feet (2OO') of the subject lot and to all owners of mineral interest in the
subject property at least thirty (30) but not more than sixty (60) days prior to such
hearing time by certified return receipt mail, and receipts shall be presented at the
hearing by the applicant.
c. The site shall be posted such that the notice is clearly and conspicuously visible from a
public right-of-way, with notice signs provided by the Planning Department. The
posting must take place at least thirly (30) but not more than sixty (60) days prior to the
hearing date and is the sole responsibility of the applicant to post the notice, and
ensure that it remains posted until and during the date of the hearing.
5. The Applicant is required to appear before the Planning Commission and the Board of County
Commissioners at the time and date of the public meeting / hearing at which time they will
consider the request. ln addition, the Applicant shall provide proof at the hearing before the
Board of County Commissioners (and Planning Commission for an Amendment to the
Comprehensive Plan)that proper notice was provided.
6. Once the Planning Commission and/ or the Board of County Commissioners make a decision
regarding the request(s), Staff will provide the Applicant with a signed resolution memorializing
the action taken by either Board. Following the Boards' approval, this office will change the
property's zoning designation on the zoning map and the Comprehensive Plan Map (if
decided) if approved.

fee structure ('Tlase Fee') for the processing of each t51pe of subdivision and tand use applications.
The Base Fee is an estimate of the average number of hours of stafftime devoted to an appiication, multiplied by
an hourly rate for the personnel involved. The Board recogniz*d that the suMivision and land ,r" uppti"utioo
processing time will vary and that an appiicant should pay for the total cost of the review which rnay require
additional bi[ing. Hourly rates based on the hourly salary, and fringe benefits costs of the respective positions
combined with an hourly overhead cost for the office will be used to establish the actual cost of County statrtime
devoted to the review of a particulm project.
Actual staff time spent will be charged against the Base Fee. After the Base Fee has been expended, tle
applicant will be bilied based on actual staff hours accrued. Any billing shall be paid in ful1 prior 16 final
consideration of any land use permit, vsning amendment or suMivision plan. If an applicant has previously failed
to pay application fees as required, no new or additional appiications will be accepted for processing until the
outstanding fees are paid.
Checks, including the appropriate Base Fee set forth below, must be zubmiued with each land use application,
and rnade pryable to the Garfield Cbunt-v Treasurer. Applications will not be accepted without the required
appiication fee. Base Fees are non-refundable in full, unless a written request for withdraw from the applicant is
submitted prior the initial review of the application materials.
Applications must include an Agreement for Pqyment Form ("Ageement-) set forth below. The Agreement
establishes the applicant as being responsible for payment of all costs associated with processing the application.
The Agreement must be signed by the parfy responsibie for payment and suirmitted with the appiication in order
for it to be accepted.
The complete fee schedule for subdivision and land use applications is attached.

The following guidelines shall be used for the adminishation of the fee structure set forth above:
1. AII applications shall be submitted with a signed Agreement for Payment form set forth beiow.
2. County staffshall keep accrnate record of actual time required for the processing of each iand use
appiication, zoning amendment, or suMivision appiication Any additional billing will occur commensurate
with the additional costs incurred by the County as a result of having to take more time that that covered by
the base fee.
3. Any bilings shall be paid prior to final consideration of any land use permit, 26ning amendment, or
suMivision plart All additional costs shall be paid to the execution of the written resolution confirming
action on the appiication
4. Final Plats, Amended or Corrected Plats, Exemption Plats or Permits will not be recorded or issued until all
fees have been paid.
5. In the event that the Board determines that special expertise is needed to assist them in the review of a land
use permit, zoning amendment, or subdivision application, such costs will be borne by the applicant and paid
prior to the final consideration of the application All additional costs shall be paid priorto the execution of
the written resolution confirming action on the appiication.
6. If an application involves multiple reviews, the Applicant shall be charged the highest Base Fee listed above.
7. Types of '?rocedures" not listed in the above chart will be charged at an hourly rate based on the pertinent
planning staffrate listed above.
8. The Planning Director shall establish appropriate guidelines for the coliection of Additional Billings as
required.
9. This fee structure shall be revised annuatly as part of the County budget hearing process.
