Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in
Glenwood Springs on Monday, the 10th day of December, 2007, there were present:

A RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT
AMENDMENT FROM AGRICULTURAL / RESIDENTIAL / RURAL DENSITY
(ARRD) TO RESOURCE LAND _ GENTLE SLOPES AND LOWER VALLEY
FLOOR (RL-GSLVF)

WHEREAS, the Board of County Commissioners of Garfieid County, Colorado
received a request from the Garfield County Planning Commission, to rezone Parcel
Numbers 2409-2710-0075; 2409-2710-0076; 2409-2710-0017 from Agriculture I
Residential/ Rural Density to Resource Lands - Gentle Slopes and Lower Valley Floor;
and.
WHEREAS, On Wednesday September 12,2007 the Planning Commission held a
Public Meeting regarding the rezoning of the three 2-acre parcels. At this meeting, the
Planning Commission voted 7-0 to recommend that the Board of County Commissioners
rezone the three 2-acre parcels from Agricultural/Residential/Rural Density (ARRD) to
Resource Land - Gentle Slopes and Lower Valley Floor (RL-GSLVF); and,
WHEREAS, the Board of County Commissioners held a public hearing on the
10'h day of December,2007 upon the question of whether the zone district amendment
should be granted or denied, at which hearing the public and interested persons were
given the opportunity to express their opinions regarding the issuance of said amendment;
and,
WHEREAS. the proposed rezoning generally conflicts with the Comprehensive
Plan. but is consistent with the past application of the Comprehensive Plan; and,
WHEREAS, the subject parcels are completely sunounded by the Resource Land

- Gentle Slopes and Lower Valley Floor (RL-GSLVF) zone district; and,
WHEREAS, on May 7, 2OO7 the Board of County Commissioners rezoned the
surrounding 77 acre parent parcel from AgriculturallResidential,iRural Density (ARRD)
to Resource Land - Gentle Slopes and Lower Valley Floor (RL-GSLVF); and,
WHEREAS, on April 11,2007 the Plaruring Commission initiated the rezone of
parcels 2409-2710-0077, 2409-2710-0076 and 2409-2710-0075 from
Agricultural,G.esidential/Rural Density (ARRD) to Resource Land - Gentle Slopes and
Lower Valley Floor (RL-GSLVF) in order to avoid de facto spot zoning; and,
WHEREAS, the Board of County Commissioners, on the basis of substantial
competent evidence produced at the aforementioned hearing, has made the following
determination of facts :
1. That proper notification was provided as required by law for the meetings and
hearings before the Planning Commission and before the Board of County
Commissioners.
2. That the public meetings and hearings before the Planning Commission and the Board
of County Commissioners were extensive and complete; all pertinent facts, matters
and issues were submitted; and that all interested parties were heard at those hearings'
3. That the application has met the requirements of the Garfield County Zoning
Resolution of 1978, as amended.
That the conditions ofthe neighborhood have changed to such a degree to support the
requested zone change from Agriculture / Residential / Rural Density to Resource
Lands - Gentle Slopes and Lower Valley Floor.
That the proposed zone disfict amendment has been determined to be in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County, Colorado, that based on the determination of facts set forth above, the
request is approved to rezone Parcel Number 2409-273-1,14 from Agriculture I
Residential/ Rural Density to Resource Lands - Gentle Slopes and Lower Valley Floor.
