APPLICATION SUBMITTAL REQUIREMENTS As a minimum, specifically respond to all the following items below and attach any additional information to be submitted with this application: 1. Please submit, in narrative form, the nature and character of the Special Use requested. Submit plans and supporting information (i.e. letters from responsible agencies). Include specifications for the proposed use including, but not limited to, the hours of operation, the number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and the size and location of any existing andlor proposed structures that will be used in conjunction with the proposed use, and provisions for electric power service and any other proposed utility improvements. Be specific. EnCana Oil & Gas (USA) Inc. (EnCana) requests a Special Use Permit for the expansion of the Middle Fork Compressor Station. The Middle Fork Compressor Station is an existing facility located on EnCana's North Parachute Ranch (NPR) in the SWSW % of Section 30, Township 5 South, Range 95 West, of the 6th Principal Meridian. Garfield County Board of County Commissioners (BOCC) approved construction of the existing facility in August 2005, with the BOCC approval of Resolution 2005-85. Resolution 2005-85 approved installation of seven natural-gas driven engines, three electric -driven compressor engines, and related ancillary equipment as indicated on the site plan. The BOCC approved use, of three acres for the installation, operation, and maintenance of the Middle Fork Compressor Station. The original Special Use Application for the existing Middle Fork Compressor incorrectly identified the site as a four acre parcel; actually the Middle Fork Compressor Station is located on a nine acre parcel. The expansion of the Middle Fork Compressor Station involves installation, operation, and maintenance of an additional four electric -driven compressors, one slug catcher, one JT2 skid (liquids condenser and separator), and removal of one gas driven compressor. The building housing the electric compressors will also be expanded to accommodate the additional four electric compressors. The expansion at the Middle Fork Compressor will be phased construct over the next 24 months. At completioe Middle Fork Compressor Station would hav si natural gas -driven compressors and seven., lectric-driven compressors and related `ancillary equipment. Based on current projected volumes, EnCana anticipates installing two additional electric -driven compressors by the end of 2007, for a total of five electric -driven compressors at the end of the year. EnCana's preliminary 2008 plans include installing an additional two electric -driven compressors and removal of one gas -driven compressor by the end of 2008. Site plans and drawings for the expansion at the Middle Fork Compressor Station are provided in the Site Plan Tab. Copies of the air permits from Colorado Department of Public Health and Environment Air Quality Control Division are included in Permits Tab. MIDDLE FORK COMPRESSOR EXPANSION FEBRUARY 2007 Expansion of the Middle Fork Compressor Station would require a workforce of approximately 18 to 25 personnel or 12 vehicles per day during the peak construction period would utilize Garfield County Road 215. During the pre -construction and post -construction phases of the project approximately 10 to 15 personnel or six vehicles per day would be traveling to the Middle Fork Compressor Station. The pre -construction and post -construction phases would last approximately one additional month before and after the peak construction periods. Typically an electric compressor can be installed within two to three months. Peak construction during 2007 and 2008 would primarily occur for approximately four to six months each calendar year. During the actual installation of the compressors, tractor -trailers and mobile cranes would be necessary to delivery and install the compressor units. Estimates of vehicle traffic for the 2007 and 2008 construction phases are provided in the following table. No full-time employees are located on-site. The compressors are monitored remotely from EnCana's Parachute Office. Operation of the expanded Middle Fork Compressor Station would not result in any impacts to county roads. Excel Energy is currently providing electric power at the Middle Fork Compressor Station to operate the existing electric -driven compressors. Portable toilets are available on-site and potable water is transported from off-site and made available to personnel. EnCana would not construct any permanent water or sanitation utilities. 2. If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan to demonstrate that you have legal and adequate waterfor the proposed use. Potable water used at the site will be transported to the Middle Fork Compressor Station via transport trunks and no water wells will be utilized at the location. Portable toilets are available on-site and EnCana will not construct any permanent water or sanitation utilities. 3. Submit a site plan/ map drawn to scale that portrays the boundaries of the subject property, all existing and proposed structures on the property, and the County or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. 2 MIDDLE FORK COMPRESSOR STATION FEBRUARY 2007 A copy of the site plan and topographic map are provided in the Site Plan Tab. The Middle Fork Compressor Station is located on a private road on the NPR, and a Garfield County Driveway Permit will not be necessary for construction of the project 4. Sub mit a vicinity map showing slope / topography of your property, for which a U.S. G.S. 1:24,000 scale quadrangle map will suffrce. A topographic map of the Middle Fork Compressor Station is provided in the Site Plan Tab. 5. Sub mit a copy of the appropriate portion of a Garfield County Assessor's Map showing all the subject property and public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, public and private landowners and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the Assessor's Office. We will also need the names (f applicable) of all mineral right owners of the subject property. (That information can be found in your title policy under Exceptions to Title). gh.�$;,.. A copy of the Garfield County As essor's Map is included in the Landownor?s Tab. No property owners are located within 200 feet of the site. The nearest adjacent property owner is located approximately 3,400 feet south of the Middle Fork Compressor Station. EnCana Oil & Gas (USA) Inc. is the mineral owner and surface owner of the subject property. 6. Sub mit a copy of the deed and a legal description of the subject property. A copy of the deed and legal description are provided in the Landowners Tab. 7. If you are acting as an agent for the property owner, you must attach an acknowledgement from the property owner that you may act in his/her behalf. The owner of the property is EnCana and EnCana is also the applicant of the Special Use Permit application. 8. Sub mit a statement that specifically responds to each of the following criteria from Section 5.03 of the Zoning Regulations: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Portable toilets are available on-site and potable water is transported from off-site and made available to personnel. EnCana would not construct any permanent water or sanitation utilities. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. MIDDLE FORK COMPRESSOR EXPANSION FEBRUARY 2007 The Middle Compressor Station is located approximately 2,880 feet north of Garfield County Road 215. A gated entrance is located at the entry point of the NPR; which is the ending point of County Road 215. The expansion of the Middle Fork Compressor Station would have minimal direct impact to County Road 215, and street improvements would not be necessary. (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character, The Middle Fork Compressor Station is located within a steep canyon in the East Fork of Parachute Creek drainage and the steep topography surrounding the facility blocks visual impacts from the general public. The nearest public access point is located approximately 2,880 feet south of the Middle Fork Compressor Station and the visual impacts are screened by the steep topography. Lighting is provided at the Middle Fork Compressor Station. Lighting is directed downward and inward to prevent direct reflection on adjacent property. 9. Depending on the type of Special Use Permit requested, you may need to respond to additional review standards in the Garfield County Zoning Resolution Section 5.00 [Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 & 5.03.081, Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific sections of the Zoning Resolution which can be located on the Garfield County web site at httn://www.karieldeounty.comlbttil(lina and planning4ndex.hun or information can be obtained from this office. 5.03.07 Industrial Operations: Industrial Operations, including extraction, processing, fabrication, industrial supportfacilities, mineral waste disposal, storage, sanitary landfill, salvage yard, access routes and utility lines, shall be permitted, provided: (1) The applicant for a permit for industrial operations shall prepare and submit to the Planning Director ten (10) copies of an impact statement on the proposed use describing its location, scope, design and construction schedule, including an explanation of its operational characteristics. One (1) copy of the impact statement shall be filed with the County Commissioners by the Planning Director. The impact statement shall address the following: i J(A) Existing lawful use of water through depletion or pollution of surface run-off, streamflow or groundwater, EnCana has prepared and utilizes the Stormwater Management Plan (SWMP) for Gas Gathering and the Spill, Prevention, Control and Countermeasure Plan (SPCCP). Implementation of these plans ensures that activities comply with stormwater management and spill prevention controls Q MIDDLE FORK COMPRESSOR sI'XI10N FEHRIJARY 2007 and countermeasures as required by Garfield County, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollute surface runoff, stream flow, or groundwater. Copies of the SWMP and SPCCP are provided in the Stormwater and SPCCP Tab. (B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or vibration, or other emanations; No smoke or glare would be produced as a result of this project. Minor vibration would occur from operation of the compressor engines; however, vibrations would not be noticeable at the property line. Equipment operation would produce vapor, which is a standard by-product of equipment operation. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the project area. EnCana is conducting a sound survey for the existing compressor facility and the results of the sound survey will be provided to Garfield County in late February. After installation of the additional compressor engines, EnCana will perform an additionalsound level 'survey. If operations exceed COGCC regulations, EnCana would install sound mitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre -fabricated steel buildings over compressors and drivers, and/or installation of other sound mitigation equipment. The sound level survey is provided in the Supporting Documentation Tab. EnCana has acquired air quality permits from the Colorado Department of Public Health and Environment Air Pollution Control Division for the seven existing natural gas -driven compressors, and additional air permits for condensate removal, equipment leaks, condensate tanks, and two glycol dehydrators. The air permits are included in the Permit Tab. (C) Impacts on wildlife and domestic animals through the creation of hazardous attractions, alteration of existing native vegetation, blockade of migration routes, use patterns or other disruptions; EnCana has contracted WestWater Engineering Inc. (WestWater) to prepare a Wildlife Assessment and Mitigation Plan for the existing Middle Fork Compressor Station, which is included in the Supporting Documentation Tab. The assessment determined that the compressor station location and immediate vicinity was poor quality wildlife habitat. Installation of additional compressor engines inside the fenced, disturbed area would not create additional adverse impacts to wildlife or domestic animals in the project area. (D) Affirmatively show the impacts of truck and automobile traffic to and from such uses and their impacts to areas in the County; Expansion of the Middle Fork" Compressor Station would require a workforce of approximately 18 to 25 personnel or 12 vehicles per day during the peak construction period. (E)That sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed use(s). The nearest adjacent property owner is approximately 3,400 feet south of the existing Middle Fork Compressor Station. The Middle Fork Compressor Station is located within the steep canyon in West Fork of Parachute Creek drainage and no damage will occur to the abutting property as a result of expanding the Middle Fork Compressor Station. (F)Mitigation measures proposed for all of the foregoing impacts identified and for the standards identified in Section 5.03.08 of this Resolution. No mitigation measures are proposed. (2) Permits may be granted for those uses with provisions that provide adequate mitigation for the following: (A) A plan for site rehabilitation must be approved by the County Commissioners before a permit for conditional or special use will be issuer! MIDDLE FORK COMPRESSOR STATION FEBRUARY 2007 Prior to abandonment of the Middle Fork Compressor Station, EnCana would contact the Garfield County Planning Director to arrange for a meeting and joint inspection of the Middle Fork Compressor Station. This meetingand inspection would take place a minimum of 30 days prior to abandonment, and would be so that an agreement on an acceptable abandonment plan can be reached. EnCana will complete final reclamation measures in areas that are not necessary for operation of the compressor station facility. The majority of the disturbed areas at the Middle Fork Compressor Station will be hard-scaped with gravel to facilitate compressor station operations. EnCana has developed the North Parachute Reclamation Plan to reclaim disturbed areas as a result of constructing well pads, access road, compressor stations, and pipelines. The North Parachute Reclamation Plan is included in the Supporting Documents Tab. (B) The County Commissioners may require security before a permit for special or conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment of credit, bond, certified check or other security deemed acceptable' `by the County Commissioners in the amount calculated--' by the County Commissioners to secure the execution of the site' rehabilitation plan in workmanlike manner and in dccordanee with'the specifications and construction schedule established or approved by the County Commissioners. Such commitments, bonds or check shall be payable to and held by the County Commissioners Se EnCana has provided Garfield County a revegetati¢n security for the amount of $36,000 for the original Middle Fork Compressor Station Special Use Permit and an additional revegetation security will not be necessary. t, ,-, r iry (C) Impacts set forth in the impact statement and compliance with the standards contained in Section 5.03.08 of this Resolution. (A. 93- 061) EnCana will comply with the standards contained in Section 5.03.08 of this Resolution. 5.03.08 Industrial Performance Standards: All industrial operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard. Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with thefollowingstandards: (1) Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes at the time any new application is made. (A. 93- 061) MIDDLE, FORK CONPRFSSOR EXPANSION FEBRUARY 2007 EnCana would conduct a sound level study to determine compliance with COGCC regulations. If operations exceed COGCC regulations, EnCanawould install sound mitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre -fabricated steel buildings over compressors and drivers, and/or installation of other sound mitigation equipment. (2) Vibration generated: every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located; EnCana would provide vibration mitigation to meet all vibration regulation requirements. Ground vibration would not be noticeable at the fenced boundary of the Middle Fork Compressor Station. (3) Emissions of smoke and particulate matter, every use shall be operated so as to comply with all Federal, State and County air quality lm%,.regulations and standards; Smoke would not be produced as a result of this project. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the project area. EnCana has acquired air quality permits for the seven existing natural gas -driven compressors (included in Permit Tab). (4) Emission of treat, glare, radiation and fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required bylaw as safety or air pollution control measures shall be exempted from this provision; Ancillary facilities may produce heat during operation of the Middle Fork Compressor Station. Heat produced would be minimal and would not be detectable at the Middle Fork Compressor Station property boundary. No glare, radiation, or fumes would be produced. Adjacent property would not be affected and a public nuisance or hazard would not be created. (S) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas (A97-112) A) Storage of flammable or explosive solids or gases shall be in accordance with accepted standards and laws and shall comply with lite national, state and local fire codes and written recommendations and/or comments from the appropriate local protection district regarding compliance with the appropriate codes; (A97-112) MIDDLE FORK COMPRESSOR STATION FEBRUARY 2007 Storage tanks are located on-site and store approximately 1200 barrels (bbls). Storage is in accordance with EnCana's SPCCP. Flammable and combustible liquids and gases will be stored in accordance with accepted standards and laws and will comply with the national, state, and local fire codes and written recommendations and/or comments from the appropriate local protection district regarding compliance with the appropriate codes. (B) At the discretionof the County Commissioners, all outdoor storage facilities may be required to be enclosed by fence, landscaping or wall adequate to conceal such facilides from adjacent property; (A97-112) The Middle Fork Compressor Station is visually secluded from the adjacent property boundary. (C) No materials or wastes shall be deposited upon a property in such form or manner that they may be transferred off the property by any reasonably foreseeable natural causes orforces, (A97-112) No waste products or materials will be deposited at the Middle Fork Compressor' Station in a form or manner that will allow off-site transport. (D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above and thefollowing standards: (A97--112) 1. The minimum lot size is five (5) acres and is not a platted subdivision. The Middle Fork Compressor Station is located on the EnCana NPR which consists of approximately 9.0 acres and the facility is zoned resource lands not within a platted subdivision. 2. The equipment storage area is not placed any closer than 300 ft. from any existing residential dwelling. No residential buildings are located within 300 feet of the existing Middle Fork Compressor Station. The nearest residence is approximately 3.5 miles south of the facility. 3. All equipment storage will be enclosed in an area with screening at least eight (8) feet in height and obscured from view at the same elevation or lower. Screening may include berming, landscaping, sight obscuring fencing or a combination of any of these methods. Visual impact is non-existent because of the location of the existing Middle Fork Compressor Station. The facility is located in a canyon, which is visually blocked from the general public. MIDDLE FORK COM1IPRESSOR EXPANSION 9 FEBRUARY 2007 " 4. Any repair and maintenance activity requiring the use of equipment that will generate noise, odors or glare beyond the property boundaries will be conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m., Mon. Fri. No equipment repair or maintenance will occur that would affect adjacent property owners. S. Loading and unloading of vehicles shall be conducted on private property and may not be conducted on any public right-of-way. The Middle Fork Compressor Station is located on a private road on the NPR, and no public right-of-ways would be used to load or unload equipment. (E) Any storage areafor uses not associated with natural resources shall not exceed ten (10) acres in size. (A97-112) Compressor engines and ancillary equipment would be temporarily stored at the Middle Fork Compressor Station. Temporary storage would no longer be needed once the compressors and ancillary equipment are installed. After expansion is complete, rqutine maintenance and repair items would be stored on-site. Expansion of the Middle Fork Compressor Station will not require an additional temporary storage area. (F) Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property (A97-112) Lighting is provided at the Middle Fork Compressor Station. Lighting is directed downward and inward to prevent direct reflection on adjacent property. (6) Water pollution: in a case in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Health' Officers must be met before operation of the facilities may begin. EnCana has prepared and utilizes the SWMP for Gas Gathering and the SPCCP. Implementation of these plans ensures that activities comply with stormwater management and spill prevention controls and countermeasures as required by Garfield County, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollute surface runoff, stream flow, or groundwater. Copies of the SWMP and SPCCP are provided in the Stormwater and SPCCP Tab. 10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment' form and provide the fee with the application. 10 MIDDLE FORK COMPRESSOR SL\TION FEBRUARY2007 The $400.00 base fee is included with the Special Use Application submittal. 11. Submit 12 copies of this completed application form and all tite required submittal materials to the Building and Planning Department.' Staff will request additional copies once the Special Use Permit application has been deemed technically complete. EnCana has submitted 12 copies of the completed application form and all the required submittal material to the Garfield County Building and Planning Department. II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Permit Application review process works in Garfield County.) 1. Sub mit this completed application farm, base fee, and all supplemental information to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness. 2. Once the application is d eemed technically complete, the Staff Planner -*ill send you a letter indicating the application is complete. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Special Use. (If Staff determines you application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Special Use and the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed special use and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. The Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied by an hourly rate for the personnel involved. The Board recognized that the subdivision and land use application processing time will vary and that an applicant should pay for the total cost of the review which may require additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of the respective positions combinedwith an hourly overhead cost for the office will be used to establish the actual cost of County staff time 'evoted to the review of a particular project. Actual staff time spent will be charged 'against the Base Fee. After the 'Base Fee has been expended, the applicant' will be billed based on actual staff hours accrued. (EnCana) received approval in August 2005 from the Garfield County Board of Commissioners (BOCC) (Resolution 2005-85) for installation, operation, and maintenance of the Middle Fork Compressor Station. The Middle Fork Compressor Station provides dehydration and compression for natural gas produced by EnCana: Natural gas is compressed and discharged into existing pipelines for transport to sales outlets. Resolution 2005-85 approved installation of seven natural-gas driven engines, three electric - driven compressor engines, and related ancillary equipment as indicated on the site plan. The BOCC approved use of three acres for the installation operation; and maintenance of the Middle Fork Compressor Station. The original Special Use Application for the existing Middle Fork Compressor incorrectly identified the site as a four acre parcel; actually the Middle Fork Compressor Station is located on a nine acre parcel. A copy of Resolution 2005-85, is provided in the Permits Tab. c. 1.2 Description Expansion of the Middle Fork Compressor Station will involve installation and operation of an additional four electric -driven compressors, one slug catcher, one JT skid (liquids condenser and separator), and removal of one gas driven compressor. The building housing the electric compressors will also be expanded to accommodate the additional four electric compressors. The Middle Fork Compressor Expansion will be phased construction over the next 24 months. At completion, the Middle Fork Compressor Station would have six natural gas -driven compressors and seven electric -driven compressors and related ancillary equipment. The location map and site plan are provided in the Site Plan Tab: Based on current projected volumes, EnCana anticipates installing two additional electric -driven compressors by the end of 2007, for a total of five electric -driven compressors at the end of the year. EnCana's preliminary 2008 plansinclude installing an additional two electric -driven compressors and removal of one gas -driven compressor by the end of 2008. Please note that actual number of compressor engines installed for any given year is an estimate based on today's current and anticipated production volumes and is considered a forward- looking statement. Special Use Permit Application Narrative February 2007 Middle Fork Compressor Station Expansion The intent of this Special Use Permit application is to allow for the expansion in its entirety to be considered within this application. 1.3 Purpose and Need EnCana plans to increase production in the Piceance Basin by approximately 100 to 200 million standard cubic feet per day (mscf(d), each year, for the next several years. The existing Middle Fork Compressor Station is designed for approximately 90 million standard cubic feet of natural gas per day (mscf/d). The proposed expansion would expand capacity to approximately 300 mscf/d by the end of 2008. The expansion has been sized to accommodate EnCana's current and future estimated gas production from Garfield County and existing and future natural gas from other natural gas producers in Garfield County., 1.4 Location' The Middle Fork Compressor Station is located on a 9.0 acre parcel of land located in the SWSW '/4 of Section 30, Township 5 South, Range 95 West of the 6'h Principal Meridian, Garfield County. EnCana Oil & Gas (USA) Inc. is the owner of this parcel ofohoperty, which is located on EnCana's North Parachute Ranch (NPR). A Garfield County Assessors map, legal description, and deed for the property are provided in the Landowners Tab. The Middle Fork Compressor Station is located on zoned Resource Lands. 1.5 Project Design The Middle Fork Compressor Station expansion would be designed in accordance with American Petroleum Institute (API), American Society of Mechanical Engineers (ASME), Institute of Electrical and Electronic Engineers (IEEE), National Electric Code (NEC), National Fire Protection Association (NFPA), and Occupational Safety and Health Act (OSHA) standards. EnCana would not construct any permanent water or sanitation utilities. 2.2 Access The Middle Compressor Station is located approximately 2,880 feet north of Garfield County Road 215. A gated entrance is located at the entry point of the NPR; which is the ending point of County Road 215. The Middle Fork Compressor Station is located on a private road on the NPR, and a Garfield County Driveway Permit will not be necessary for construction of the project. 2.3 Neighborhood Character The Middle Fork Compressor Station is an existing facility. The nearest residence is 3.5 miles south of the Middle Fork Compressor Station. The steep topography surrounding the Middle Fork Compressor Station blocks any visual impacts from public roadways. Installation of additional compressors would not change the existing neighborhood character. Special Use Permit Application Narrative 3 February 2007 Middle Fork Compressor Station Expansion 3.0 SECTION 5.03.07 INDUSTRIAL OPERATIONS The following sections address impacts as required by Section 5.03.07 of the Garfield County Land Use and Zoning Regulations. 3.1 Existing Lawful Use of Water No water depletion would occur as part of this project. EnCana has prepared and utilizes the Stotmwater Management Plan (SWM?) for Gas Gathering and the Spill, Prevention, Control and Countermeasure Plan (SPCCP). Implementation of these plans ensures that activities comply with stormwater management and spill prevention controls and countermeasures as required by Garfield County, the State of Colorado, and the United States Environmental Protection Agency. Implementation of these plans also ensures that EnCana would not pollute surface runoff, stream flow, or groundwater. Copies of the SWMP and SPCCP are provided in the Stormwater and SPCCP Tab. 3.2 Generation of Vapor, Dust, Smoke, Noise, Glare or Vibration bi.. No smoke or glare would be produced as a result of this project. Minor vibration would occur from operation of the compressor engines; however, vibrations would not be .noticeable at the fenced property boundary at the Middle Fork Compressor Station. Equipment operation would produce vapor, which is a standard by-product of equipment operation. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the project area. EnCana is conducting a sound level survey for the existing compressor facility and the results of the sound survey will be provided to Garfield County in late February. After installation of the additional compressor engines, EnCana will perform an additional sound level survey. If operations exceed COGCC regulations, EnCana would install soundmitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre -fabricated steel buildings over compressors and drivers; and/or installation of other sound mitigation equipment. The sound level survey is provided in the Supporting Documentation Tab. EnCana has acquired air quality permits from the Colorado Department of Public Health and Environment Air Pollution Control Division for the seven existing natural gas -driven compressors, and additional air permits for condensate removal, equipment leaks, condensate tanks, and two glycol dehydrators. The air permits are included in the Permit Tab. 3.3 Wildlife and Domestic Animals EnCana prepared a Wildlife Assessment and Mitigation Plan for the existing Middle Fork Compressor Station, which is included in the Supporting Documentation Tab. The assessment determined that the compressor station location and immediate vicinity was poor quality wildlife habitat. Installation -of additional compressor engines inside the fenced, disturbed area would not create additional adverse impacts to wildlife or domestic, animals in the project area. Special Use Permit Application Narrative February 2007 Middle Fork Compressor Station Expansion 3.4 Traffic Impacts Expansion of the Middle Fork Compressor Station would require a workforce of approximately 18 to 25 personnel or 12 vehicles per day during the peak construction period. During the pre - construction and post -construction phases of the project approximately 10 to 15 personnel or six vehicles per day would be traveling to the Middle Fork Compressor Station. The pre - construction and post -construction phases would last approximately one additional month before and after the peak construction periods. Typically an electric compressor can be installed within two to three: months. Peak construction during, 2007 and 2008 would primarily occur for approximately four to six months each calendar year: During the actual installation of the compressors, tractor -trailers and mobile cranes would be necessary to delivery and install the compressor units. Estimates of vehicle traffic for the 2007 and 2008 construction phases are provided in the following table. No full-time employees are located on-site. The compressors are monitored remotely from EnCana's Parachute Office. Operation of the expanded Middle Fork Compressor Station would not result in any impacts to county roads. 3.5 Abutting Property, The nearest residence is 3.5 miles to the south. No damage from operations of the Middle Fork Compressor Station would occur to adjacent property. 3.6 Reclamation Pian Prior to abandonment of the Middle Fork Compressor Station, EnCana would contact the Garfield County Planning Director to arrange for a meeting and joint inspection of the Middle Fork Compressor Station. This meeting and inspection would take place a minimum of 30 days prior to abandonment, and would be held so that an agreement on an acceptable abandonment plan can be reached. EnCana will complete final reclamation measures in areas that are not necessary for operation of the compressor station facility. The majority of the disturbed areas at the Middle Fork Compressor Station will be hard-scaped with gravel to facilitate' compressor station operations. EnCana has 'developed the North Parachute Reclamation Plan to reclaim disturbed areas as a result of constructing well pads, access road, compressor stations, and pipelines. The North Parachute Reclamation Plan is included in the Supporting Documents Tab. Special Use Permit Application Narrative 5 February 2007 Middle Fork Compressor Station Expansion EnCana has provided Garfield County a revegetation security for the amount of $36,000 for the original Middle Fork Compressor Station Special Use Permit and an additional revegetation security will not be necessary. 3.7 Emergency Response Plan EnCana would comply with its Emergency Response Plan (ERP); whichdescribes the functional roles and accountabilities for life safety, property damage, and environmental response. The ERP also describes the communication and notification protocols to engage support, based on the nature and complexity of the emergency. The ERP is included in the Emergency Response Tab. EnCana would reimburse the appropriate emergency service provider for costs incurred in connection with emergency response for activities associated with this project. 4.0 SECTION 5.03.08 INDUSTRIAL PERFORMANCE STANDARDS All operations at the Middle Fork Compressor Station would comply with applicable county, state, and federal regulations regulating water, air, and noise ,pollution and would not be conducted in a manner constituting a public nuisance or hazard. Operations would be conducted in a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property. The following section address compliance with the standards set forth in Garfield County Zoning Regulations 5.03.0$. 4.1 Sound Volume EnCana would conduct a sound level study to determine compliance with COGCC regulations. If operations exceed COGCC regulations, EnCana would install sound mitigation equipment as necessary to meet COGCC regulations. Sound mitigation measures could include a combination of residential grade silencers over fans, pre -fabricated steel buildings over compressors and drivers,, and/or installation of other sound mitigation equipment. 4.2 Vibration EnCana would provide vibration mitigation to meet all vibration regulation requirements. Vibrations would not be noticeable at the fenced property boundary at the Middle Fork Compressor Station. 4.3 Smoke and Particulate Matter Smoke would not be produced as a result of this project. EnCana would apply water, gravel, tackifier, or other equivocal measures as necessary to prevent fugitive dust emissions from equipment and/or vehicles traveling in the project area. EnCana has acquired air quality permits for the three existing natural gas -driven compressors (included in Permit Tab). EnCana would acquire additional permits for natural gas -driven compressors prior to installation and operation. 6 Special Use Permit Application Narrative February2007 iWiddle Fork Compressor Station Expansion 4.4 Heat, Glare, Radiation, and Fumes Ancillary facilities may produce heat during operation of the Middle Fork Compressor Station. Heat produced would be minimal and would not be detectable at the Middle Fork Compressor Station property boundary. No glare, radiation, or fumes would be produced. Adjacent property would not be affected and a public nuisance or hazard would not be created. 4.6 Storage Compressor engines and ancillary equipment would be temporarily stored at the Middle Fork Compressor Station. Temporary storage would no longer be needed once the compressors and ancillary equipment are installed. After expansion is complete, routine maintenance and repair items would be stored on-site. Storage of heavy equipment would not be allowed at Middle Fork Compressor Station, except during installation on compressors. Storage tanks are located on-site and store approximately 1200 barrels (bbls). Storage is in accordance with EnCana's SPCC Plan. No wastes are produced by operation of the Middle Fork Compressor natation. Any waste materials are disposed of at a licensed disposal facility. No materials or wastes would be deposited on-site. � ' Lighting is provided at the Middle Fork Compressor Station.
