Smith , Commissioner Chairman Arnold L. Macklev , Commissioner , Commissioner Don DeFord , County Attorney , Clerk of the Board , County Administrator Elmer Arbaney Mildred Alsdorf Chuck Deschenes when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 89-02Q A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY COLORADO GATHERING CORPORATION WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Colorado Gathering Corporation for a Special Use permit for a natural gas pipeline and compressor station on the following described tract of land: Legal Description: See Exhibit A. (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 19th day of December, 1988, upon the question of whether the above-described Special Use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That- proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Special use permit be and hereby is authorized permitting the use of the above described tract of land for a natural gas pipeline and compressor station upon the following specific conditions: 1. All representations of the applicant, either within the application or stated at the public hearing before the Board of County Commissioners shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant, contractor, and subcontractors shall notify the County Clerk's office and Assessor's office to ensure proper licensing and assessment of equipment and vehicles based in the operation, prior to final approval. 3. The applicant shall comply with all regulations of Garfield County relating to industrial operations in the zone districts in which the pipeline will be located, and shall construct and operate the pipeline and compressor in accordance with all applicable State and Federal regulations. 4. The applicant shall submit an approved Air Pollution Emission Permit for the compressor station from the Colorado State Department of Health. 5. The applicant shall submit permits or agreements with the DRG & W Railroad, the Colorado State Highway Department, and Questor Pipeline Company, allowing for the pipeline. Restoration shall be addressed by these agreements or separate resotration agreements shall be submitted. 6. The applicant shall apply for and receive any driveway access permits, overweight vehicle permits, and building permits as required by the County Road and Bridge Supervisor and the Chief Building Official. In addition, the applicant shall submit verification that the $20,000 road restoration bond, required by the County Road and Bridge Department, is in place. 7. The applicant shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use has commenced. Dated this 23rd day of January , A.D.1989 . Thence northwesterly through Section 23 across the Denver and Rio Grande railroad and Interstate 70 into the Southeast Quarter of Section 14. Thence Northeasterly through the Southeast Quarter of Section 14 crossing into the Southwest Quarter of Section 13 continuing Northeasterly through Section 13 and ending in the Northwest Quarter of Section 18, Township 6 South, Range 93 West. Approximate width of right of way is 40 feet.
