RE: Lake Fox Water Quality Data.
Dear Sir or Madam:
Please find the attached data summary table and laboratory analysis report for water samples
collected from the Lake Fox Water Storage Pond on May 04, 2010. The on sitc Monitoring Well
was dry on the date the lake was sampled. The data summary table also lists several reference
standards for comparison with the analytical results. These standards are provided for relative
comparison only, as the water is not intended to comply with any of the referenced regulatory
standards. The water will be contained on site or used solely for natural gas exploration and
production activities. As such, the water will not come in contact with the gcneral public or with
environmental receptors such as soil, ground water, or surfacc water.

Dear Mr. Jarman:
The Board of County Commissioners (BOCC) approved EnCana's Lake Fox Water Storage Facility
(Resolution 2005-87) subject to compliance with certain conditions. The purpose of this letter is to
confirm compliance with, and agreement to, the county's conditions so that the Special Use Permit for the
facility can be issued to EnCana. For your reference, the BOCC conditions appear in italicized type and
the EnCana response appears in normal font.
1. All representations of the Applicant, either within the application or stated at the meeting before
the Board of County Commissioners, shall be considered conditions of approval, unless
specifically altered by the Board.
EnCana agrees to this condition.
2. The Applicant shall comply with all applicable requirements of the Gartield County Zoning
Resolution of 1978, as amended.

7. Any changes fo the Special Use Permit will require a new Special Use Permit.
EnCana understands that this condition may be modified by changes to Garfield County's Land Use
Codes, effective January 1,2009, but agrees to this condition as it may apply.
8. Rehabilitation of the propefty, when the use terminafes, sha// consrsf of the following:
a) Removalof all surface equipment (pump and pump building) and pond liner material;
Upon rehabilitation of the property, EnCana will remove the surface and pond liner materials, as
described in the Landscaping and Reclamation Plans section of the SUP Application.
b) Restoration and re-contouring of grade to approximate originalconditions;
Upon rehabilitation of the property, EnCana will restore and re-contour the grade of the disturbed
area to approximate original conditions, as described in the Landscaping and Reclamation Plans
section of the SUP Application.
c) Replacement of stockpiled topsoil; and
Upon rehabilitation of the property, EnCana will replace all stockpiled topsoil, as described in the
Landscaping and Reclamation Plans section of the SUP Application.
d) Comptiance with all prevailing Colorado Oil and Gas Conservation Commission and Garfield
County regulations governing final reclamation.

9. Groundwater resources shall be protected at all times. ln the event of potential violations with
respect to water pollution, the Applicant shall be required to provide proof of compliance with
applicable Federal, State, and County laws, regulations and standards. Specifically, the
Applicant shall install a groundwater monitoring well down gradient of the pond in order to
annually test groundwater to ensure groundwater resources have not been impacted by any
potential leakage from the pond. The Applicant shall furnish fhe resu/fs of such testing to the
Building and Planning Depaftment and fhe Grass Mesa Homeowners Association and which said
resa/fs shall contain a professional opinion as to any impact to ground water. This annual test
shall be conducted for the life of this facility.
ln the event of a potential violation with respect to water pollution, EnCana will provide documentation
of compliance with applicable Federal, State, and County laws, regulations, and standards, at the
county's request. EnCana installed a monitoring well down gradient of the pond in order to annually
test groundwater to ensure groundwater sources have not been impacted by any potential leakage
from the pond. Annual water tests for Lake Fox and a professional opinion as to impact to
groundwater are contained in Attachment 2 and the annual test of groundwater quality will continue to
be conducted for the life of the facility. EnCana has, and will continue to furnish the results of such
testing to the Building and Planning department and the Grass Mesa Homeowners Association.
10. The Applicant shall install natural screening vegetative landscaping along the outside of the fence
on top of the berm along the nofth, east and west sides of the pond to minimize the visual impact
of the pond from the views from the north. This type of landscaping shall be approved by the
County Vegetation Manager and shall be installed prior to the issuance of any Specra/ Use
Permit.
EnCana has mitigated the growth of any noxious weeds and has allowed natural vegetation tocontinue growth along the north, east, and west sides of the pond as a vegetative screen. As shownin the photographs in Attachment 3, EnCana has utilized the slope of the terrain and the natural
vegetation to minimize the visual impact of the pond from the views from the north
11. Any lighting proposed to be instatted at the facitity shatl be of a shielded design, directed
downward and inward towards the propefty and motion censored.
EnCana has not and does not anticipate installing lighting at this facility. However, if any lighting is
installed it will be a shielded design, directed downward and inward towards the property and motion
sensored.
12. The Applicant shall install a wateiowl deterrence sysfem prior to the issuance of the Specla/ Use
Permit that is acceptable to and has been approved by the Division of Wildlife.
A letter from the US Department of Natural Resources, Division of Wildlife exempting EnCana fromwaterfowl disturbance on this location due to exclusive storage of fresh water is contained in
Attachment 4.
13" The Applicant shall lower the height of the dam fo /ess than 10 feet and remove the spiilway tosatisfy the requirements of the State Engineer's Office and the Colorado Oil and Gas
Conservation Commission regarding the allowabte height and spiltway regulations retated to
Centralized E&P Waste Facilities.
EnCana received notice from the Colorado Division of Water Resources, Water Division 5 that nochanges are to be made to the dam or the spillway. EnCana, therefore, by recommendation of saidstate entity has not made any changes to the dam or spillway. The letter fiom the Colorado Division
of Water Resources, Water Division 5 is contained in Attachment 5.
14. No operation of the facility shall be attowed until atl of these conditions have been met.
EnCana met the conditions required by the County prior to operation of this facility.
15. No more than 10 trucks shatl be altowed to go to and from this facility per day.
EnCana agrees to this condition. EnCana currently has an average of two trucks on a daily basis that
