ACCESS: Buford Road -~-- EXISTING ZONING: AIR/RD ADJACENT ZONING: AIR/RD I, RELATIONSHIP TO THE COMPREHENSIVE PLAN This proposal is located in Stndy Area II of the Comprehensive Plan. II, INTRODUCTION I DESCRIPTION OF THE PROPOSAL The applicant is requesting permission to develop a Resort Cabin on pro e zoned ··AIRIRD. The applicant wis es to use this odge as a stagmg area where people, mostly in small or family groups explore the snrrounding forest area and then retnm to the lodge to sleep, prepare meals and clean up. This resort, if approved, conld house as many as twelve people at a time. ill. GARFIELD COUNTY ZONING RESOLUTION Approval or denial of this application depends on how well the applicant's proposal conforms to the criteria outlined in the Garfield County Zoning Resolution, Chapter 5.03 Conditional and Special Uses. As listed under the Zone District Regulations, conditional and special uses shall conform to all regulations hereunder and elsewhere in this Resolution plus the following requirements: (1) Utilities adequate to provide water and sanitation services based on acceptable engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. This request, if approved, would be serviced by well water (well permit number 231228 -copy attached), septic system and electricity through "off the grid" devises. Off the grid meaning the cabin has electricity via a generator, solar cells and batteries. Well permit number 231228 can be used for the following purposes; commercial business, lodge (over night hut) for multiple use by cross country hikers, bikers, snow-mobilers and skiers. Water from this well shall not be used for lawn or landscape irrigation or for any other purpose outside the business building structure. The applicant has signed and notarized a letter stating that the septic system would be designed by a registered, professional engineer (copy attached). Though isolated, the applicant states that cell phone service is available in this area which is a benefit should an emergency arise. In the narrative, the applicant states that not more than twelve people will be lodged in this facility at any one time. Based on the Uniform Building Codes, if more than ten people are lodged here the R-1 ratings apply and must be handicap accessible. (2) Street improvements adequate to accommodate traffic volumes generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. This proposal is small in scale; therefore CR 245 and Buford Road should be adequate to handle the traffic volumes created by this proposal. (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences, or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect the established neighborhood character. The design of the cabin, as presented in the application, shows a rather non-descript two-story building. Since there are no neighbors within two miles of this proposal impacts to the surrounding area should be minimal. IV. REFERRAL AGENCY COMMENTS The following agencies were given the opportunity to comment on this proposal; no comments were received: Burning Mountain Fire District, Bureau of Land Management and Garfield County Road and Bridge. V. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the that meeting. 3. That for the above-stated reasons, the proposed special use permit would be in the best interest of the health, safety, morals, convenience, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in confonnance with the Garfield County Zoning Resolution of 1978, as amended. VI. RECOMMENDATIONS Staff recommends approval of this proposal based on the above Suggested Findings and the following conditions: 1. That all representations of the applicant, either written, implied or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended. 3. The applicant will have the septic system designed by a registered, professional engineer. 4. This proposal is isolated and elevated and the activities associated for this proposal are strenuous in their nature, therefore the applicant should be prepared to deal with emergency situations as they arise and with the understanding that emergency response might be delayed. 5. Due to the remote location of this resort the applicant is responsible for all emergencies that may arise by the use of this facility. 6. The applicant should work with the Burning Mountain Fire District to develop a fire- safe envelope around the cabin. 7. It is recommended that the applicant notify all user of this facility that cellular phone service might be the only way to contact the 911 system and they should have a cell phone on hand. This may save lives.
