WHEREAS, the Board of County Commissioners of Garfield County, Colorado has received an application frorn Colorado Ute Electric Association, Inc. for a Special Use Permit for construction and operation of a 345-KV electric transmission Iine in bhe f o1-lorriirg described corridor: In Garfield County, Colorado: BEGINNING at Ehe Rifle Sub-station southeast of Rifle located iir the SW L/4 SW l/4 of Sect,ion I4t THENCE in a westerly direction to a point in the SE l/4 SE l/4, Section L4;:'HENCE in a southwesterly direction to the existing 230-kv transmission line; THENCE in a southwesterll, directioir following said existing 230-liv transmission line to a point in the IIE 1/4 Nw L/4 of Section 29r aII in Tovrnship 5 South, Range 93 !'lest,6th P.i,i.; THEUCE in a southerly direction to a point in the SW L/4 of Section 5 , T7S, R9lW, 6th P. That application has been filed iir accordance witir Section 5.03 of the Garfield County Zoning Resolution of 1978r ds amended; 2. Prope:: public ilotice was provided as required DJ Sect.ion 9.03.04 of the Garfield County Zoning Resolution of l97Br ES amended; / 4. That neither the impact on traffic volume and safety or on rtilities, or any other inpact of the special use will- be ir:jurious to the :stablished neighborhood or zone district in which the special use is to be Located. NOI{, THEREFORE, BE IT RESOLVED by the Board of county commissioners of larfield County, Col-orado, Lhat a special use pertnit be and hereby is authorized permitting the use of the above-described corridor for the construction and operation of a 345-KV elect;:ic transmission line, upon the following specific conditions being met or agreed upoll prior to construction: L. AlL proposals of tire applicant shal1 be considered conditious of rpproval, unless expressly stated below; 2. That prior to issuance of the subject special use pcrnits, the ipplicant shall obtaih an<1 submit to the Garfield County Department of )evelopment,/Planning Divis ion copies clf : a. AII permits from other governmental erttities affecting Garfield County; b. The public Utilities Commission approved Certificate of Convenience and NecessitY; and 3. The propose<I use is compatible with listrict in which it is to be located, :ontained conditions be complied with; 10. That upon allegation by an affected land owner or governmental entit)2, the Board si-ra1I investigate cornpliance with the conditions of approval r 6rs provided f or in section 9.01 .06 of Garf iel-d County Zoning Resolutionsr of 1978r ds amended; 7. That the permits shall be reviewed annually for compliance with the permit's conditions of approval until such tir,re that all consLruction and site rehabilitation has been accepted by the County; B. T5at all access roads on private lands be clescribed as I{AR-IC (temporary road to be revegetated upon completion of construction) or NAR-1D ( ternporary road wliich will be recontoure'l and revegetated upoll completion of conslruction ) , as identif ied in the Site Specif ic Landscape I'lanagement Plan submitted as a part of tiris application unless a different type of access road is agreecl upon by the landowner involved; 9. That prior to issuance of said Special Use Permit a definite construction time schedule sha11 be submitted to the County; ior to issuance of saicl Special Use Permits, the applicant fication of the fact that all employees have or will have 11. ThaL said Special Use PermiL witl be taken out within one of bhe date of approult of the resolution and be valid only for the time identified in the construction schedule; and 12.
