WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Cade L. Benson for a special use permit to allow for approval of one (t) accessorY dwelling unit; and WHEREAS, the Board of County Comrnissioners of Garfield County, Colorado, held a public hearing on tire lgh day of luty, 2OOO upon the question of whether the above described I""*rrry Olielling unit should be granted or denied, at which hearing the public and interested o"rron, ,rere given the opport,6[ to express their opinions conceming the approval of said special use Perrnit; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the basig of suUstantial'competent evidence produced at the aforementioned hearing has made the following determination of fbct as listed below: A That proper public notice was provided as required for the hearing before the Board of County Commissioners; B. That ihe hearing bets-re the Board of County Comrnissioners was extensive and Oomplete, that i'lt pertine,lrt facts, matters and issues were subrnitted and that all intercsted parties were heard at that meeting; c. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; Now THEREFORE, BE IT RESOLVED by rhe Board of county commissioners of Garfield f*"ay, Colorado that the Flattops Gatewey Rench Accessory Dwelling Unit is hereby ;p;;fu subject to cornpliance withall of the following specific conditions: l. Comply with Section 5.03.21 of the Garfield County Zoning Resolution, 1978, as amended' Z. This modular unit will comply with the regulations detailed in the Mininrum Application Requirements 7or Mobtte Homes and those regulations found to be p"rtinrnt in UBb, UMC, UpC (rggl-5) for one and rwo Family Dwelling. Copies are available at the Building and planning Oftice. ln general, all living facilities will have operable toiletq battr/Jhower and meal preparation apptiances. 3. A rnaximum of ten people can be housed in this unit and still fall under the R-3 guidelines for a residential unit. If more than ten people are housed in this unit the R-l guidelines of apartment building takes precedence' 4. This modutar unit is for the sole purpose of housing seasonal .tq Any violation of the terms, interpretation or agreements made or represented to Garfield County by the applicant pertaining to or included in this special use permit shall be considered a breach ofthe ierms of condition by the applicant and property-ownefs. 5. The well permit that the applicani has expired on l6-Aug-'96. Before the applicant receives " tuitaing perrnit iliey will need to show evidence of a positive water source that meet the followhg criteria: a. That a four hour pumP test be performed on tlre well to be used; b. well completion ieport demonJtrating the depth of the well, the characteristics of the aquifer and the static water level; c. The results ofthe four hour pump test indicating the pumping rate in gallons per minuteandinformationshowingdowndrawandrecharge; d. A written opinion ofthe person conducting the well test that this well should be adequate to supply to the number of proposed lots; e. an aszumption ofan average or no tiss than 3.5 people per dwelling unit" using 100 gallons of water per person' per day; f. The ivater qualrty te iestiA by anapproved laboratory and meet State guidelines ooncerning bacteria' nitrates and suspended solids' 6. This modutar unit is for the sole purpose of housirtg seasonal staff. If guests are housed in the modular unit it is no longer an Accessory Dwelting Unit but a Resort and the owners will have to obtain a permit to engage in resort activity.
