PRACTICAL LOCATION: Approximately 1.4 miles east of the intersection of County Road 3(E and
County Road 304. Proiect site is adiacent to County Road 304
WPE OF APPLICATION: SUP Amendment (Re: Waterfowl COA)
I. GENERAL PROJECT DESCRIPTION
EnCana received a Special Use Permit approval from the BOCC for the High Mesa Water Storage &
Evaporation Pond which is memorlalized in Resolution 2005-57. This approval included the
following condition:

b. The Applicant shall install o woterfowl deterrence system that conslsts of the
placement of high-tensile wire at regulor intervols ocross the pond. These wires oct os
a visuol deterrent to blrds ottempting to land on the woter, and os a noise deterrent,
os the stretched wire creotes an ultrasonic (inaudible to humons) sound.
At present, the actual SUP has not issued because this condition has not been met. Encana would
like this conditlon to be eliminated based on a meeting with Garfield County Planning, EnCana and
the Colorado Division of Wildlife (CDOW). Encana provided a letter that describes an intensive
water treatment system that would eliminate harmful constituents in the pond water therebyo
rendering the need for netting unnecessary. (Letter from Encana dated 7O123/O9). This approach
was supported by the CDOW.
II. REGUTATORY PROVISIONS APPLICANT IS REqUIRED TO ADDRESS (DEVETOPMENT CODE /
CoMPREHENSIVE PLAN, STATE STATUTES, ETC.)
Section 2-LO7 Amendments to Approvals of Land Use Permits granted under
Regulations adopted prior to October 13, 2008
Amendments may be made to Conditional Use Permits and Special Use Permits approved by the
Board of County Commissioners under the Zoning Resotution of L978, as amended (the old code)'
An amendment request shall be required to demonstrate that the amendment does not result in a
Substantial Change as defined in Article XVl, Should the Director determine that the requested
change resuJts in a Substantial Change, the Applicant shall submit a new Land Use Change permit
application under the Unified Land Use Resolution of 2008, as amended.
Artacle xvl Definition of Substantial Change
A change to and existing approved land use resulting in one or more of the following.
1. A change in land use category. (No)
2. A change in site design which increases
a. the number of dwelling units.
b. the maximum square footage of structures less than 10,000 sq. ft. over 100% and
structures over 10,000 sq. ft. by LO%,if a maximum has been specified in a permit
or approval.
c. projected traffic such that a highway access permit or an amendment to a highway
access permit is required as a result of the change
d. the size of the land which is the subject of the permit or approval
3. A change in land use which creates or increases the incompatibility of the use.
III, REVIEW PROCESS
Section 4-t0.l Amendment of a Major lmpact or Limited lmpact Permit Approval. Any proposalto
change conditions of approval or a site plan approved under these Regulations as a Major lmpact or
Limited tmpact Review permit shall require application to the Director for Amendment of a Major
lmpact or Limited lmpact Permit Approval. The Director shall review the application to determine
whether the proposed change constitptes a substantial change to the Major lmpact or Limited
lmpact Permit approval.
A.Review Process
t.Pre-Application Conference. A Pre-Application Conference shall be held in
accordance with the provisions of Section 4-103(A), Pre-Application Conference.
Application. The appllcation materials required for amendment of a MaJor lmpact or
Limited lmpact Permit approval are set forth in Sectlon 4-501(H).
Determination of Completeness. The Director shall review the application for
determination of completeness in accordance with the provisions of Section 4-
103(C), Determlnation of Completeness.
Evaluation by Director/Staff Review. Upon determination of completeness, the
Director shall evaluate the application to determine if the proposed amendment(s)
constitutes a substantial change to the approved Major/Limited lmpact Review. A
staff report shall be prepared pursuant to Section 4-103(E).
Director Declslon. Withln thirty (30) worklng days of the date of determination of
completeness the Director shall make a determination as to whether the proposed
change(s) constitutes a substantial modification to the approved plan or conditions of
approval contained in the Resolution of Approval.
a. No Substantial Change. lf the Director determines that the change does not
constitute a substantial change to the approved Major lmpact Review permit,
the Director shall approve the proposed amendment to the site plan or set a
public hearing before the Board of Countv Commissioners for an amendment
to a condition of approyel in a resolutign--gf approval. The Director shall
schedule the request for consideration by the Board of County
Commissioners:
Public hearing by the Board of County Commissioners shall be held
within forty-five (+5) calendar days of the date of determination by
the Director of the request for amendment,
Public notice of the hearing shall be made pursuant to Section 4-
103(F), Notice of Public Hearing.
Substantial Change. lf the Director determines that the change constitutes a
substantial change, the Major lmpact Review shall be considered a new
application subject to full review under the applicable review process for the
land use change application.

Written Notice of Decision. The Director shall inform the applicant of the
determination in writing within five (5) working days of the date of decision. Notice
of the Director's decision shall also be provided to the Board of County
Commissioners.
Request by Applicant for Reconsideration of Decision. An applicant may request
review of the Director's decision by the Board of County Commissioners by filing a
written request within ten (10) calendar days of the date of receipt of written notice
of the decision by the Director.
a. Schedule Public Hearing. The Director shall schedule the request for review
by the Board of County Commissioners'
(1) Pubtic hearing by the Board of County Commissioners shall be held
within forty-five (45) calendar days of the date of receipt of the
request for review.

WHEREAS, the Board of County Commissioners held a public hearing on the
20'h day of June, 2005 upon the question of whether the above-described SUP should be
granted or denied, during which hearing the public and interested persons were given the
opportunity to express their opinions regarding the issuance of said SUP; and
WHEREAS, the Board of County Commissioners on the basis of substantial
competent evidence produced at the aforementioned hearing, has made the following
determination of facts:
1. That proper publication, public notice, and posting was provided as required by law
for the hearings before the Board of County Commissioners.
2. That the public hearing before Board of County Commissioners was extensive and
complete; all pertinent facts, matters and issues were submitted; and that all interested
parties were heard at those hearings.
3. The proposed Special Use Permit conforms to Sections 3.10.04, 5.03, 5.03.07 and
5.03.08 of the Garfield County Zoning Resolution of 1978, as amended.
4. The proposed use is in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE m RESOLVED by the Board of County
Commissioners of Garfield County, Colorado, that based on determination of facts set
forth above, the SUP request for "Storage, Processing, and Material Handling of Natural
Resources" is approved with the following conditions:
1. That all representations of the Applicant, either within the application or stated at
the hearing before the Board of County Commissioners, shall be considered
conditions of approval unless explicitly altered by the Board.
2. That the operation of the facility be done in accordance with all applicable
federal, state, and local regulations governing the operation of this type of
facility.
3. That the Applicant shall comply with the fire protection provisions included in the
rules and regulations of the Colorado Oil and Gas Conservation Commission
(COGCC) and the National Fire Code as the Code pertains to the operation of
this facility.
4. The issuance of the SUP shall be subject to an annual review of the water
chemistry contained in the evaporation pit at such time when free standing water
is within the pit and water samples collected from the ground water monitoring
well. These analyses shall be submitted to the Building and Planning Department
on the first day of July for every year the pit is in operation. The cost of this
analysis shall be born entirely by the Applicant. If this water is determined,

Special Use Permit Amendment Application to change a wildlife deterrence system
condition of approval of Resolution 2005-57
The purpose of this application is to seek approva! to modify the original condition 9.b
with the proposed language noted below:

Please provide more technical information about the Dissolved Air Filter (DAF) process that is
noted in your second application submittal:
The Double-DAFTM Solds Thickener is designed to recover solids from plant wastewater prior to
discharge to a holding pond. This recovery process ls defined in the following paragraphs.
lnfluent water is pumped into the coagulation chamber of the DAF tank. Here coagulants are mixed using
high speed mixers to create pin floc. Flow is then directed up and through a poft into the floccuation
chamber. Here polymer is thoroughly mixed using low speed mixers to enhance flock formation. Flow
out of the stilling chamber is directed upward over the downstream baffle wall allowing the more dense
sofds fo settle to the bottom and the floatable so/rds fo rlse. Micro-AirerM aerated recycle enters via
VanAire supplied breakout valves immediately downstream from the baffle. The flow path created by the
baffle leaves the floc/solids in a bubble-rich zone near the surface so the floatable so/ids need only travel
about a foot to the suiace. This minimizes the amount of buoyancy lost due to the re-absorption of
bubbles into the wastewater.
As the wastewater stream continues on the flow path through the DAF Thickener it flows through the paft
of the DAF Thickener unique to the Double-DAFL sysfem. A cross-flow plate-pack, which is located mid-
DAF Thickener provides a damping effect on the water in the DAF Thickener, and provides a surface for
the coalescing of bubbles and microscopic particles. As the bubbles and particles build up on the
underside of the plates, the pafticles agglomerate into larger particles, eventually floating to the surtace.
Our cross-flow design does not affect the normal flow patterns in the DAF Thk:kener; so hydraulic loading
rates are not affected" A second hit of Micro-AirerM aeration is administered just below the plate pack for
enhanced recovery/removal of water contaminates and late forming floc. The second recycle air hit
imitates and has the effectiveness of the second DAF Thickener in a series system.
Floated so/rds are skimmed from the sufface of the DAF Thickener using a variable speed concurrent
skimming sysfem for maximum float density. A limit switch sfops fhe flights on the beach plate for an
adjustable period of time to allow free water to drain from the float. A pitched false floor concentrates
settled so/rds near four blow down valves where they can be removed via manually or automatically
controlled "blow down" valve(s). There are also blow down valves located in each chamber and near the
effluent end for removal of settled solids from this area. Floated so/rds are held in the float hopper, which
is located near the effluent end of the DAF Thickener. A bridle pipe is provided to mount a levelsensor fo
staft and sfop a customer supplied float pump, and to stop the skimming flight system on float hopper
high level.
An adjustable rectangular weir located between the float hopper and the clear well controls the level of
the DAF Thickener. The weir is adjusted to maintain DAF water at the front edge of the beach during low
flow. Water passrng over the weir exits the clarifier through the DAF effluent pi,pe.
Does the DAF process involve emissions of hydrocarbons or other compounds into the air? lf
so. has Encana filed APENs or received appropriate permits for these emissions?
Emr'sslons from the DAF unit are de minimus. An emission fesf was attempted on the unit, but air flow and
thus the emlssion rate were below detection levels; therefore APEN repofting was not required.
Encana indicates that "ultimatelv" thev want to treat the water to discharoe standards.
Assuminq this means they are not there vet. are there evaporative emissions from the ponds
that require APENs or appropriate emission permits from CDPHE APCD?
Encana has the appropriate CDPHE Construction Permit for the residual emissions from the ponds. No
APENs required, as deep well disposal is permitted via state and federal regulations.
Does Encana intend to discharqe the treated water at some point in tinre?
Yes, into holding pond for the foreseeable future, eventually we will discharge to surface but likely many
years from now.
The information provided indicates that there is a sludoe tank associated with the treatment
process. No information is provided as to the nature of this waste and how it is managed in
accordance with local, state and federal reoulations. ls this addressed elsewhere in the SUP?
lf not, Encana should provide this information.
Yes, rT is addressed in the original SUP... natural separation process allows lhe sofds to be skimmed off
the produced water (soliditied) then be hauled away for dlsposa/ at a permitted site, while the produced
water is pumped directly into the storage pond for reuse in drilling operations.
June 2010 Responses to Planner
A description of the proposed water treatment process and how it will be incorporated on the
existino site:
Addressed in EnCana's letter dated 10-23-09; specifically paragraph four. As well as a detailed
explanation given at the October 6, 2009 meeting. Update on the progress srnce fhls letter was written
includes the installation and operation of 25 micron filters after the DAF units along with oil absorption
filters following these. lncorporation of these water treatmenf sysfems has alrcady been accomplished at
the site and the equipment is located in the D.A.F. Building as shown in the attached "HM Water
Treatment Facility Features Contours (02-23-10). All water offloaded at the facility flows through the
upfront tanks for free oil recovery and then ls processed through the above described treatment system
prior to discharge to the ponds.

Amendmenf does not have any impacts on traffic, noise or odor (statement provided in 02-25-10 letter to
Planner). The current system generates no negative impacts to the site. lmpacts eliminated at the site
include ponds with no so/rds, minimal odor, and no oil sheen.
How often will it be inspected. etc.
tnspection schedute was addressed in EnCana's letter dated (10-23-09) paragraph 3. ln an effott to find a
new method of protecting waterfowl, EnCana has been actively researching and studying the feasibility of
various methods of prevention and has concluded that water treatmenf ls the most reliable method
available to us. Although water treatment of these waters is very complex, allowing only treated waters to
be discharged to the ponds should prevent harm to any waterfowl that do happen to land in these waters.
Hourly inspections will continue to be employed by plant operators to ensure waterfowl do not stay in the
area while daily inspections of the wildlife exclusion methods will also be conclucted. Hazing devices will
also be implemented if we find repeated attempts by wateffowlfo rest or feed in this area.
What assurances will be provided that it will operate as proposed.
Assurances that the treatment sysfem will operate as proposed can only be guaranteed through hourly
lnspecfions and a robust treatment sysfem design. Sysfem design includes a three step treatment
sysfem in which each step is a backup to the prior step to ensure no failure in the treatment system
occurs. Repeated backwashing of the filters will be an indicator that the system is not operating properly
and will signal the operator to fine tune the sysfem without allowing any untreated water to the ponds.
How will the site be monitored for effectiveness:
Site monitoring for effectiveness will be conducted through hourly inspections referenced above and
specifically monitoring of ponds for oil sheen.
Discuss the plans for operational break-downs. malfunctions. and maintenance:
Operational breakdowns are minimal due to the lack of mechanical moving parts on the system. Hourly
checks of the system will identify any breakdowns or malfunctions that may occur and spare pafts for all
the equipment is on the shelt at each location. Maintenance for pumps and compressors r.s done as per
manufacturer's recommendations and is peiormed by a third pafty pump company. Chemical pumps are
serviced monthly with through drsassemb/y and a thorough cleaning of all parts.

The Colorado Division of Wildlife greatly appreciates the partnership and willingness of Garfield County to allow
us the opportunity to review and recommend strategies on this and other projects that may pose significant threats
to wildlife.
lt has been brought to my attention that after the meeting with EnCana and you regarding the strategies for water
treatment at these two facilities that you need to have some assurance from the CDOW that this will ameliorate
the wildlife concerns. The CDOW has been hesitant to state that one method or another will be the best solution
for wildlife protection with regard to produced water ponds in Garheld County. It is the operator's responsibility
to ensure that the taking of wildlife does not occur. With that being said, EnCana has moved forward with
concepts that set them apart from most other industry operators. The ability to treat water completely and to
remove any possibility that illegal take of wildlife may occur is a great concept that the CDOW supports. We
believe that EnCana has come up with a possible solution that will alleviate our concerns.
We support the proposal that EnCana has come up with and look forward to future communication and assurance
that this technique is working. Monitoring of effectiveness and plans for break-downs, malfunctions or non-
effectiveness should be a part of the changing language. Again, while this may not be end all solution, we believe
this will accomplish our goal if implementation occurs to the degree that has been proposed.

SUP Amendment Application to change a wildlife deterrence system condition of
approval as approved under Resolution 2005-57
Molly and Fred -
EnCana is very concerned regarding your latest letter regarding our SUP amendment and feel that we
have provided all the necessary documentation and justification to gain approval from the County. We do
not feel there is significant justification regarding this letter in determining the application to be Technically
lncomplete and Withdrawn. We firmly believe that this process/application should be allowed to continue
and not be withdrawn due to the time and effort already put forth.
Past documentation indicates exactly how we want the condition to be modified. Concluding that the wire
grid deterrent cited in the original COA presents structural integrity and safety concerns, as well as the
ultrasonic noise being proven ineffective at deterring birds. We also stated that the utilization of water
treatment and filtering is the most reliable method available to us and that the CDOW supports this
concept. We also indicated that the DAF (Dissolved Air Flotation) systems or water treatment systems are
currently in place.
We feel that EnCana has adequately explained, and that you understood and agreed with our reasoning
to change the condition and that the support of CDOW was the hurdle we overcame to get your approval.
As stated in the CDOW letter: 'EnCana has moved forward with concepts that set them apart from most
other industry operators. The ability to treat water completely and to remove any possibility that illegal
take of wildlife may occur is a great concept that the CDOW supports.
To date, these have been the requests, discussions, and submittals we have provided to the County to
meet your concerns:
- 11117109: Letter and Pre-Application Conference Summary received from Fred Jarman. "... To
amend that permit, Secflon 4-107(A)(5)(a) provides the process to change / alter conditions of
approval required by the Board of County Commissioners. Lastly, in support of your request to
provide an alternative method to waterfowl deterrent sysfems we request a letter from the
Division of Wildlife that supports your proposed treatment system."
- 12128109:. Letter and SUP Amendment submitted to have COA re-worded; Supporting
documents included EnCana letter dated 10123109 (detailed methods and justification) and a
letter from CDOW (CDOW Support Letter, dated 12109/09) addressed to Fred Jarman.
01115110: Phone conference with Molly and Fred; recap: Fred indicated that he would
administratively approve Hunter Mesa and High Mesa would be turned over to Molly. I informed
her that that SUP Amendment and supporting documentation was submitted on 12128109.
02110110: Received Technically lncomplete Letter (dated 02108110) from Molly requesting:o A more detailed Written Statement of the Proposed Amendment (how we wish the
change to the condition to read), along with a suggestion to have the condition address
the Division of Wildlife's comment in a letter dated 12109/09 to Fred Jarman which states,
"Monitoring of effectiveness and plans for break-downs, malfunction or non-effecfiyeness
should be a paft of the changing language."
o Supporting Documentation: Proof of Ownership, Vicinity map, Site plan, Letter of
Authorization
- 03102110= Delivered (hand-carried) to Molly at the County (3 packets) - Revised Statement
(detailed as instructed and provided all which was requested in 02108110 letter), including
Supporting Documentation as requested above.
- 04/09/10: Call from Molly wanting to discuss; scheduled a meeting lor 04113110 at my office.
- 041131102 Molly could not recall receiving the 3 packets I personally handed to heron 03/02110; I
made 3 more hard copies for her and emailed her the packet in pdf format. I tried to convey the
fact that our method of treating the water to eliminate mortality of migratory birds is a much better
method than that of the original COA. I questioned why a process/method, approved/supported
by the DOW (more effective & sensible than high tensile wire) cannot be administratively
approved.
- 05/07/10: Received Technically lncomplete and Withdrawn Letter from Molly. Failure to
understand how we did not correct deficiencies. As your letters states, if we were to resubmit, we
would be required to include items which were addressed and had been previously submitted
after the first technically incomplete letter, dated 02108/10.
We clearly do not see the need in withdrawing the application and starting over due to the time and effort
already expended on this matter by both EnCana and the County. We hope that through further
discussion and the answering of any concerns you may have we can clarify any issues still remaining.
Please consider and review the information we have previously provided and consider moving forward
with issuing this permit as it currently stands.

we discussed the condition and I tried to convey the fact that our method of
treating the water to eliminate mortality of migratory birds is a much better
method than that of the original COA. I questioned why a process/method,
approved/supported by the DOW and Planning Director (more effective &
sensible than high tensile wire) has to go through such a rigorous process
and what more is needed in order to complete this project and' obtain
approval
