April 28, 1995 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 Case No. 94CW344 was filed with the Water Clerk in Division No. 5 Water Court on December 28, 1994, on behalf of the West Divide Water Conservancy District and William Zilm. The West Divide Water Conservancy District is represented by Russell George, Esq. According to the application, William Zilm is represented by Scott Balcomb, Esq. FIRST CLAIM ZILM TRANSFER DITCH Applicants' first claim is for an absolute water right for the Zilm Transfer Ditch. Applicants claim an appropriation date of 1913. Applicants claim an absolute amount of 2.0 c.f.s. for augmentation purposes. Applicants state in Item 5.c that the date water was applied to beneficial use was N/A. Applicants claim no irrigation use and claim a diversion of water to augment other water rights. The Applicants do not describe what uses or structures were augmented, nor the times that the augmentation supposedly occurred. The Division of Water Resources in Glenwood Springs was unable to locate any diversion records for the Zilm Transfer Ditch. To date, the Applicants have provided none. SECOND CLAIM ALTERNATE POINT OF DIVERSION WEST DIVIDE PROJECT FOURMILE CANAL Applicants are requesting that numerous points of diversion be established as alternate points of diversion for the West Divide Four Mile Canal which was established as an alternate point of diversion for 200 c.f.s. of the 1000 c.f.s. awarded the West Divide Avalanche Canal and Siphon on June 20, 1958, in Civil Action No. 4613 in the Garfield County District Court. The West Divide Project Fourmile Canal was not decreed a legal point of diversion. A request for a finding of reasonable diligence is presently pending in Water Court Case No. 95CW052 for this structure. Since it's appropriation in 1957, no part of the Fourmile Canal has been constructed. With a 1958 water right, the Fourmile Canal would rarely, if ever, be in priority on Four Mile Creek. Page 2 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 THIRD CLAIM PLAN FOR AUGMENTATION EXCHANGE Applicants have requested that the West Divide Fourmile Canal be augmented with water rights from the Atkinson Ditch, Hughes Reservoir, Green Mountain Reservoir, Ruedi Reservoir and the Zilm Transfer Ditch. The Application does not state what depletions are to be augmented from each of the 36 structures which are to be utilized as alternate points of diversion to the West Divide Fourmile Canal. No dry -up of lands under the Atkinson Ditch is specified and no consumptive use credits are quantified. No method of delivery of water from Hughes Reservoir is described. The amounts of water contracted for from Green Mountain Reservoir and Ruedi Reservoir are not stated. The Application states that the Zilm Transfer Ditch will be operated to provide water to the Fourmile Ditch to mitigate any injury caused by operation of the augmentation plan. No description is given of how the Applicants' proposed 1994 water right in the Zilm Transfer Ditch will augment any senior water rights. PROPOSED DECREE OPERATION OF THE PLAN On March 15, 1995, pursuant to the Applicants' request of March 13, 1995, this matter was rereferred to the Water Judge. On April 25, 1995, the Applicants provided the parties with a revised proposed decree "Findings and Ruling of Referee" when in fact the matter is no longer before the Referee. The proposed decree suggests that 1.14 cfs of the senior priority of the Atkinson Ditch has historically been utilized to irrigate 57 acres and yields a credit of 113.43 acre feet of consumptive use according to the following schedule: Page 3 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 Month Credit A.F. April 3.42 May 21.66 June 27.36 July 25.65 August 16.53 September 14.25 October 4.56 Evidently, Applicant's engineer has refused to take into account that during the poor and dry water years, the Atkinson Ditch has not received enough water to irrigate Applicants' 57 acres with their share of the senior priority. Their 1.14 c.f.s.share amounts to 28.5% of the amount of water in the senior 4.0 c.f.s. in the Atkinson Ditch. The official water commissioner records for irrigation year 1977 show that after May 31st of that year the Atkinson Ditch received zero ( - 0- ) c.f.s. The official water commissioner records for irrigation year 1989 show that from June 27 until October 31 of that year that the Atkinson Ditch received only an average of 0.57 c.f.s. Applicants 28.5% would equate to an average of 0.163 c.f.s. per day. That is enough water to normally irrigate only five (5) acres. The official water commissioner records for irrigation year 1990 show that from July 12 until October 31 of that year that the Atkinson Ditch received only an average of 0.189 c.f.s. Applicants 28.5% would equate to an average of 0.054 c.f.s. (24 gpm) per day. That is enough water to normally irrigate only two (2) acres. The scenarios of 1989 and 1990 will be even worse for the Atkinson Ditch in the future. In 1989 and 1990, one-half of the water rights in the Four Mile Ditch had been transferred to four wells in Case No. 79CW207 and the Division Engineer would not allow the Four Mile Ditch during 1989 and 1990 to "call" for the entire 1.6 c.f.s. of its senior water right. The Four Mile Ditch has a 1.6 c.f.s. water right in Priority 19. On March 6, 1991, in Water Court Case No. 90CW187, the Court eliminated the change to the four wells. Now the Four Mile Ditch can "call out" Priority No. 33 in the Atkinson Ditch until such time as it receives its 1.6 c.f.s. If this had happened in 1989 and 1990, the Atkinson Ditch would have been entitled to even less water. The 1994 official water commissioner records are not yet available, but they are expected to average the 1990 situation. Page 4 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 It is a generally recognized principle that an applicant can not claim consumptive use credits for those months that their water right does not receive a full supply of water. In order to avoid damage to prior vested water rights, it is common professional practice to base engineering evaluations on the worst year of reliable record. Based on the 1977 official water commissioner record for the Atkinson Ditch, no consumptive use credits should be available for domestic use in augmentation plans from June through October. There are two water rights claimed by Edmund Prehm and his family which are on Four Mile Creek and downstream of the Four Mile Creek Ditch. The Smart and Green Ditch was awarded 0.9 c.f.s, absolute, on July 21, 1911, for irrigation purposes with an appropriation date of April 24, 1909. The Gristy Ditch was awarded 0.5 c.f.s. on April 28, 1903, for irrigation purposes with an appropriation date of April 4, 1886. Up until 1984, the Gristy Ditch was administered as the 6th most senior water right on Four Mile Creek. In 1984, the Division Engineer changed the water rights tabulation and arranged the Gristy Ditch as the 14th most senior water right on Four Mile Creek. The official water commissioner records for irrigation year 1989 show that the Gristy Ditch received less than its decreed 0.5 c.f.s. from May 14th through October 12th, except for the period July 25th through August 13th. The official water commissioner records for irrigation year 1990 show that the Gristy Ditch received less than its decreed 0.5 c.f.s. from August 3rd through September 4th. The official water commissioner records for irrigation year 1989 show that the Smart and Green Ditch received less than its decreed 0.9 c.f.s.from May 14th through July 9th and from August 14th through October 12th. The official water commissioner records for irrigation year 1990 show that the Smart and Green Ditch received less than its decreed 0.9 c.f.s. from April 2nd through October 26th. Applicants have proposed in their decree to ensure that no injury occurs to Objector Edmund A. Prehm's water rights in the Gristy and Smart and Green Ditches by observing the following conditions during the operation of its augmentation plan: a) Applicant shall bypass its augmentation water available at the headgate of the Atkinson Ditch to the unnamed draw East of Fourmile Creek in such quantities as necessary to provide for the availability of no less than 0.50 c.f.s at the headgate of the Smart and Green Ditch. Page 5 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 1 b) Applicant shall bypass such quantities of water at the headgate of the Zilm Transfer Ditch as necessary to provide for the availability of no less than 0.50 c.f.s. at the headgate of the Smart and Green Ditch. The dry year record of 1977 and the poor water year records of 1989 and 1990 clearly indicate that Applicants share of the senior priority in the Atkinson Ditch could not have provided more than the average 0.163 c.f.s. and 0.054 c.f.s., respectively, available to them during those years. According to the records, at times during both 1989 and 1990 the Atkinson Ditch received zero water. Therefore in poor water years similar to 1989 and 1990, let alone the dry years similar to 1977, the Applicants proposal to bypass its augmentation water available at the headgate of the Atkinson Ditch to provide for the availability of water to the Smart and Green or Gristy Ditch will amount to zero or at least considerably less than the amount of credits the applicant is claiming. In the dry years, the amount of water available to the headgates of the Smart and Green Ditch and the Gristy Ditch does not all make its way to the irrigated fields. Based on the decrees, the decreed amounts of 0.9 c.f.s. and 0.5 c.f.s. are necessary to provide a full irrigation supply to the lands irrigated. Based on conversations with Mr. Prehm, when the flows of these two ditches are decreased dramatically as they were in the years of 1989 and 1990, there is a considerable loss of water from the headgate to the place of use. Mr. Prehm has stated that when he is not receiving enough water to irrigate with from the Smart and Green Ditch and/or the Gristy Ditch that he has historically contacted the water commissioner to shut-off the out -of priority diversions in the "Middle Ditch" which is operated by the owners of the Four Mile Creek Ditch. POTENTIALLY DAMAGED PARTIES If the augmentation plan in Water Court Case No. 94CW344 is approved as presently written, it is my professional opinion that several water rights will be damaged. They are as follows: 1) All water rights junior to the Atkinson Ditch Priority No. 33 (the senior priority). If the excess consumptive use credits requested are transferred to otherwise out -of -priority structures, then those structures will be allowed to divert and will cause depletions to Four Mile Creek. Those depletions will cause the available measurable water in Four Mile Creek to diminish. The diminished flows will cause each junior water right in turn to be curtailed earlier due to a lack of water available to their individual priorities Page 6 2) In my opinion, other users in the Atkinson Ditch will be damaged, because even though they ordinarily have the "calling" Priority No. 33, the water available at the headgate of the Atkinson Ditch for them to divide has already been diminished by allowing otherwise out-of-priority structures above to divert. This will be especially evident in the dry and poor water years when the Applicants have transferred a large block of consumptive use credits to others that they themselves would not have been entitled to in those years. According to the Application, the amount in C.F.S. which will be diverted by the initial contract users is 2.544 c.f.s., not counting an additional 3.5 c.f.s. for the filling of ponds. The Application, if approved in its present form, will allow for numerous additional contract users to divert from otherwise out-of- priority structures and this will only exacerbate the problem which is one of an extended-expanded use of Applicants' water right. The actual affect in acre feet of consumptive use is probably far less than the diversions of 2.544 c.f.s., but the Applicants have not provided their estimates of the expected consumptive use. 3) In Division 5 Water Court Case No. 92CW302, the Court awarded an Appropriative Right of Exchange of up to 2.0 c.f.s. for irrigation and livestock watering purposes which entitles the owners of Flannery Ditch, Four Mile Creek Extension and Flannery Reservoir to deliver water into the Atkinson Ditch or the Four Mile Ditch in exchange for deliveries from Four Mile Creek into the McKown Ditch. When there is less than 2.0 c.f.s. available to either the Atkinson Ditch and/or the Four Mile Ditch, and this exchange is operating, Applicants will not have physical water available to effectuate their exchanges. 4) I am not a geologist, but I would expect the physical supply of the Zilm Well No. 1 to be adversely affected, if the subject plan for augmentation is approved in its present form. The Zilm Well No. 1 serves a subdivision of some forty (40) homes and diverts from an aquifer that could be expected to be recharged from irrigation of lands from waters in the Atkinson Ditch. As described above, if Applicants are allowed to expand the use of their Atkinson Ditch rights to structures above the Atkinson Ditch, less availability of water in the Atkinson Ditch will result in less recharge to the Zilm Well No. 1. Page 7 ZILM WELL NO. 1 The Zilm Well No. 1 is one of the structures to be augmented by the subject plan for augmentation. The Zilm Well No. 1 was awarded 0.1694 c.f.s. (76.23 gpm) in 1972 in Case No. W-1680. On December 13, 1973, in Case No. W-1804, the Zilm Well No. 1 was allowed to divert 1/13th of the water available to the Atkinson Ditch. Based on the 1989 and 1990 official water commissioner records for the Atkinson Ditch and on the fact that,at least, at such times as the Smart and Green Ditch and the Gristy Ditch were not receiving their full decreed amounts of water, on the average the Zilm Well was only entitled to 0.04 c.f.s. (20 gpm) and 0.0145 (6.5 gpm). Based on an estimated forty (40) homes with an estimated average lawn area of 1/10 acre each, the consumptive use from the Zilm Well No. 1 in the poor water years exceeds the entire amount of consumptive use credit attributable to the Applicants in their present plan for augmentation in this matter. In written interrogatories, the Division Engineer has previously sworn that the Zilm Well No. 1 has not historically been properly administered. HUGHES RESERVOIR The proposed decree makes available 20 acre feet of water and dedicates it to the plan for augmentation. Southeastern Colorado Water Conservancy District, et al v. Fort Lyon Canal Company 720 P.2d 133 (1986) states that provisions of the Water Rights Act listing various factors to be considered by the water court in evaluating applications for changes in water rights require that diminished return flows, whether due to change in direct flow or storage rights, must be considered when calculating the amount of injury to other appropriators and also require that decrees of the water court must prevent or compensate such injuries by ordering appropriate modifications and conditions. The proposed decree does not address the change in place of use aspect nor the credit for the historic consumptive use credits. In addition, Applicants have not indicated whether they intend to deliver water directly into Four Mile Creek or whether they are attempting to augment only depletions to the Colorado River.
