This letter wiIl confirm that Garfield County has accepted theinstaLlation of the curb and gutter along the west side of yourdevelopment on County Road 180.
rncluded in the agreement was that the county would chip andseal the 5 feet of roadway for 150 feet more or less, which infact has been completed.
Please advise if we can be of any further assistance in thismatter.

Dear l'[r. Bean:
We hereby respecfully request the County Conmissioners consider waiver
to condition No. 4 on Resolution 81-96 wherein we were required to erect
a 6t chain link fence aLong the northerly portion of the West Glenwood
Plaza because:
After two years of postponement due to drainage problems and water
line breaks on the adjacent property we believe installation of
the fence would not be in the best interest for the area because:
1. It is will serve no real purpose as it will not enclose anything.
2. It will be ahazard for children who will undoubtedly cLimb it.
3. It will be an eyesore as it wil1 collect windblown trash and weeds
will grow in it.
4. I{hen the subdivision was approved building plans were incomplete
so it was not know if there were to be windows on north side of
building. The building was conplete with al1 steel doors and
one smaLl" window which could be barred if necessary.
5. We have had no complaints fron tenants, who in fact prefer no
fence. Attached letter signed by each tenant supports this.
6. A fence will be a hinderence to snow removal.
7. The School District does not beLieve a fence is needed at this
time. Mr. Dwight Helms will write you a letter of confirmation.
8. The Soccer Association does not believe a fence is needed.

9. Water line immediately adjacent to property line is a I'thin waIlrr
line and with 5 or 6 breaks this year, more breaks are inmenent
and a fence will hinder repair work.
10.To install fence within one foot of property line would put
fence nearly on top of electric and phone line, and to set back
restrict traffic flow as many tenants park at rear of building.
11. I{e more or less volunteered to instalL fence as one nenber of

not accomplish this.
We sincerely hope our noncompliance to date has not caused any inconcience
to your department. Please let us know when we can meet to set up the

wanted before installing as we did not want to redo. we were originally prepared
to put in ful1 curb an gutter.
FENCE
Fortunate we did not install because of:
1. soccer field drainage problems in 1982
2. watet line breaks and di-tch overflows in 1983
If installed it will:

we have had no complaints by tenants, who in fact prefer no fence at all'
when fence requirement was made final building plans not completed and it was
thought there would be windows along entire waIl of store. There is only one
smal1 window which could be barred if necessary.
Last check with soccer. association the fence was not wanted because socceT
ball retrieving would be more difficult.
When fence recluirement was made, it seemed like only lvlrs Laura wanted it and
even then the need seemed uncertain.
To install the fence now we will be over top of telephone line and electric
line and VERY close to water line. The watLr line is a thin wal1 pipe and
more leaks are imrninent. To set fence back far enough to assure not being
over utilitie lines would mean narcowing drive so as to impede parking and
traffic.

Dear Mr. Moffatt:
Your letter of February 25,1981 to Mr. R. A. Prosence has
been referred to this office for clarification of our
requirements concerning the referenced deveiopment.
After discussions with Mr. Prosence and Mrl Campbell, I wish
to reiterate our requirements as follows:
1. Access to U.S. 6 will be limited to the one, 30-
foot driveway shown. The 16-foot entrance to
the fast food unit should be eliminated from the
location shown and should be accommodated off
the main access. Traffic circulation for aI1
businesses should be internal and contained on
the development
2. It will be necessary to widen U.S. 6 at this
location to provide for a westbound deceleration,/
right-turn lane artd an eastbound left-turn slot.
Increased runoff from the development will reguire
that the existing. I8-inch cross culvert in U-S. 6
be replaced with a 24-inch CMP with headwall-
Grading of the property should be accomplished
to direct drainage to this culvert. The entrance
side-drain should also be a 24-inch CMP. (Main-
tenance considerations require that these culverts
be at least 24 inches in diameter. )
We request that you coordinate the design of these improvements
with the County so that they are compatible with our
requirements for the ne, "or.rty road/U.S. 6 intersection

The following are our requireuents for the inEersection of the refereneed
county road with U.S. 6 aL a point approximately 450 feet east of County
Road 133:
1. This intersection will require widening of U.S. 6 to
accomodate the following:
A through lane and a right-turn lane, westbound.
b. A through lane and a left-turn s1ot, eastbound.
2. The new county road approach to U.S. 6 should be widened
to accommodate three lanes as follows:
a. A northbound l-ane.
b. A right-turn and a left-turn lane, southbound.

property on the northeast quadrant of this intersection. He will be

Mr. Fleming said construction on the Taco John building
will start in three or four weeks. He said it will be a typical
strip shop with a mansard roof and masonry walls.
He said the parking requirement is high and snow storage
wil l bc on unuscd frar:hi.ng spaccs. lle said Leonard Bowlby
indicated the road will be started in the spring. He does
not know whether a sidewalk is planned.
Mr. Fernandez said the County is considering revising its
existing requirement for 25% open space so that less opqn
space would -be required but landscaping and buffering _ofparking areas would be required. This would help traffic
circulation.
Commissioner Kaufman said snow storage in normal winEers
can occupy so much parking area that business is hurt.
Commissioner Durrett said pedestrian traffic should be
considered, as this property abuts school district land
which may house a school in the future. Mr. Hancock said
the adjacent landowners are not notified at this sLage, but
when the site plan is submitted.
Commissioner Kaufman said a sidewalk could be required and
would help pedestrain traffic. Mr. Fleming questioned the
use of a sidewalk where the adjacent properties do not havethem. Commissioner Law indicated that in the future sidewalks
should be on adjacent property as well.
Mr. Hancock and Mr. Fleming discussed the location of the
building on the property with the Commission members.
Mr. Fernandez said that under County procedures if the proposal
is declared an exemption, there will be no public hearing.
Commissioner Kaufman moved, seconded by
Commissioner Durrett, that item //8-81 be
recommended to the County Planning and Zoning
Commission for approval with the following
recommendations :
f) that it go through the subdivision process
as opposed to being an exemption, for the
purposes of public hearing;
2) that the issues of snow storaBe and trash
receptacles be addressed ;
3) that pedestrian acces be evaluated and included
along 6 & 24 and the proposed CounEy Road;
and
4) that completion of the County Road in
conjunction with the completion of this project
be encouraged.
Mr. !'leming said he does not see the point of the public
hearing. Commissioner Kaufman said the school District
should receive notice of the proposal. Mr. Fleming
said he'd like to avoid the public hearing process because
of the time it takes saying the delay would cost him money.
Motion on /18-81 is voted on by the Commission.
