HomeMy WebLinkAbout4.0 PermitSPECIAL USE PMMIT ISSIIED TO WAYNE FLEMMING In accordance with and pursuant to the provisions of the Garfield CountyZoning Resolution of L979, as amended, and Resolution No. 81 - 96 of theBoard of County Couunissioners of Garfield County, Colorado, hereby authorizes,by Special Use Permlt, the following activity: a conmercial park whose use shall be limited to commercial/retailin two buildings under one ownership. on the following described tract of land in Garfield County, Colorado: a parcel of land located in the NEkSEk of Section 6, Township 6 South, Range 89 West of the 6th Principal Meridian, lying Northerly of theNortherly right-of-way line of old U.S. Highway 6 and 24 (presently I-70Access Road), Southerly of a parcel of land described as Document No.265593 in Book 467 on Page 54 filed in the Clerk and Recorder's officeof Garfield county, colorado, and Easterly of a county road, moreparticularly described as follows: Beginning at an iron post with a brass cap properly uarked for thesoutheast corner of Section 34, Township 5 south, Range g9 Inlest of the6th Principal Meridian; thence s.32"45'00'\{. 1756.13 feet ro a pointon the Northerly right-of-way line of said U.S. Highway: thence N.87"23r00"W. 139.57 feet along said Northerly right-of-way line ro the TRUE pOINT OF BEGINNING: thence N.87'23'00"W. The above described parcel of land contains 1.484 acres, nore or less. The within Special Use Permit is issued subject to the conditions setforth in the above-mentioned resolution, and shall be valid only during cornpliancer,rith such conditions and other applicable provisions of the Garfield CountyZoning Resolution, Subdivision Regulations, Building Code, and other regulationsof the Board of county connnissioners of Garfield county. The conditions are as follows: 1. The use on 1ot 2 sha11 be limited to Cornmercial/Retail purposesin tow buildings. 2- A 5 foot sidewalk will be provided along the Westerly portion of theproperty in the New Cor:nty Road ROI,I at the expense of the applicant unless otherwiseagreed to by the County. 3. A 6 foot chain-link fence will be constructed along the Northerlyportion of the property before a certificate of occupancy will be issued..4. A11 parking areas shall be paved. 5. Access to the site shaIl be linited to two points along highway 6 and24 and four points along the New Cor:nty Road. Access points sha1l be definedwith concrete bumpers and landscaping along both the Westerly and Southerlyportions of the property. 6. A11 water taps necessary to serve the project must be obtained prior to the issuance of a certificate of occupancy for the project. 7. A11 inprovements necessary to serve the project must be in place andfunctioning prior to the issuance of a certificate of occupancy.
