I. DESCRIPTION OF THE PROPOSAL
Harlan McElroy owns Lots 5 - 8 and 17 - 20 of Block 11 in Travelers Highlands
Subdivision and K & H Leasing owns Lots 10 and 15 of Block 1 1 . (These areas are
J"fi"t"O in the front page of tlie memo.) Pr'to_r_amended plats approved by the BOCC.
combined varying comb-inations of these 5,oOO sq. ft. lots over the last several years. ln
doing so, an error occurred in the final naming of the combined lots which resulted in
duplication of parcel titles as ParcelA.
The purpose of this corrected and amended plat application is to correct those errors
and correct tile. The proposed plat contains the following note to explain the purpose
of the correction:
II. AUTHORIry
section 6:40 of the subdivision regulations states that a correction may be made to an
approved plat, if the sole purpose'is to correct technical errors such as minor surveying
"r.r, and'drafting errors, and the correction is consistent with the approved Preliminary
plan. The corrected plat shall be submitted to the Planning Department with a narrative
explaining the reason for the plat correction, for review and comparison with the
irLtiriniry plan. Within thirty (30) days of submittal, the corrected plat shall be brought
before the Board of County iommissioners for review and decision' lf approved, !!e 9t1t

III. STAFF RECOMMENDATION
Staff recommends that the Board of County Commissioners approve this corrected and
amended plat request with the following conditions:
1. That all representations of the Applicant, either within the Application or stated at the
meeting before the Board, shall be considered conditions of approval'
2. Within g0 days of approval, the Amended Final Plat shall be reviewed (papel copy),
then signed and OatbO (mylar copy) by the County Surveyor, than signed and dated by

the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield
County. The Amended Final Plat shall meet the minimum CRS standards for land
survey plats, as required by Colorado state law, and approved by the County Surveyor
and shall include, at a minimum, the information outlined in Section 5'.22 of lhe Garfield
County Subdivision Regulations.

Applicant submits this application for Corrected Plat pursuant to Procedure 3 of the Amended or
Corrected Plat procedure promulgated by the Building & Planning Department of Garfield
County.
Applicant requests approval of the proposed Corrected Plat to correct technical errors that
occurred during the preparation of three prior plats by a surveying company. The technical
drafting errors occurred in 2005 and 2007 and resulted in different tots withln Block 1'1 being
titled ParcelA.

The technical errors were discovered by the Applicant while researching the real property
assessment and payment of 2007 real property taxes in 2008. Applicant's representative
worked with the Garfield County Assessor and GIS office to determine the proper titles for the
lots and sought their review and ultimate consent to the form of the proposed Corrected Plat
prior to filing this application for Corrected Plat.
Applicant desires that the Corrected Plat be placed on the consent agenda of the Board of
County Commissioners at the earliest possible (following appropriate review by planning and
surveying departments) Board meeting. The Corrected Plat will allow all County records
(planning, assessor and GIS) to match and remove any duplicative and confusing references
that arose due to technical errors within past plats.
!ll. Discussion.
The purpose of the proposed corected plat is to correct the scrivener's errors that mistakenly
applied the same 'ParcelA'description to two separate /distinct lots and then canied on this
mistake in successive plats.
The proposed corrected plat does not increase the number of lots, nor does it relocate property
lines.
The purpose of the proposed corected plat is to establish:1. Lots 5, 6, 19, 20 as Parcel A;2. Lots 8 and 17 as Parcel B;
3. Lots 7 & 18 as Parcel C; and4. Lots 10 & '15 as Parcel D.
The above corrections will fix the enors on earlier recorded plats:
a. "Amended Final Plat, Lots 5, 6, 19 and 20", recorded at#677833, July 8, 2005 (which
combined Lots 5, 6, 19 and 20 into ParcelA and did not affect any other lot);b. "Amended Final Plat, Lots 8 & 17", recorded at #686305, November 10, 2005 (which
combined lots I &17 into "parcel a" and referred to the just combined Lots 5, 6, 19, 20 as
'parcel b' (rather than ParcelA as was designated in the plat recorded 4 months earlier);c. "Amended Final Plat, Lots 10 and 15", recorded at#717900, February 26,2007 (which
combined lots 10&15 into.Parcel D" and referred to lots I &17 as "parcel a"; lots 7 &18
as "parcel c" and lots 5,6,19, 20 as "parcel b"); andd. "Amended Final Plat, Lots 7 &18", recorded at#717901, February 28,2007 (which
officially combined lots 7 & 18 into "Parcel C" but continued the errors of 'parcel a' and
parcel 'b' as the prior 2 plats).
To summarize, the problem arose with the filing of the November 2005 Plat where Lots 8 & 17
should have been labeled "Parcel B" from the outset.
Reduced size copies of the proposed Corrected Plat and the four prior Amended Final Plats are
attached hereto for ease of reference.

lV. Gonclusion,
Applicant requests that the Planning Department determine that the application for Corrected
Plat is complete and allow the application to proceed to review and report, and schedule the
corrected plat for consideration of the Board of County Commissioners within 30 days, pursuant
to the published Garfield County procedures for Amended or Corrected Plat.
