GENERAL PROJECT LOCATION
II. PROJECT DESCRIPTION AND PURPOSE
The vicinity map above points out the general location of CR 306 which is approximately 4 miles
southwest of Parachute, CO. The landowners and the BOCC intend to vacate an old portion of
County Road 306 known as Wallace / Spring Creek Road which exists as an old right-of-way
(not improved as a road today) that loops through several properties listed on the cover of this
memo which was deeded to the County years ago. lt is currently difficult to make out if you walk
the right-of-way. The currently travelled public road will remain the same corridor travelled by
the public today but will officially be deeded (50 ft. ROW) to eh County. The map below shows
(as well as Exhibits A and B to the resolution in your packet) the areas to be vacated denoted by

III. REFERRAL AGENCIES
Pursuant to specific direction to Staff by the Board of County Commissioner BOCC) on Monday,
October 4, 2010, the BOCC decided to waive all of the referral requirements codified in the
Unified Land Use Resolution of 2008, as amended (ULUR).
lV. REVIEW CRITERIA & STANDARDS in Section 4-110(C) of the ULUR RELATED TO
ROAD VACATIONS
Section 4-110(CX7) Planning Commission Review. lf appropriate, the Garfield County
Planning Commission shall review all applications or petitions to vacate public roads or right-of-
way pursuant to the provisions of 530-28-110(1) (d), C.R.S., as amended. The Planning
Commission procedures are as follows:

The Planning Commission shall conduct its review of the petition or application to vacate
a county or public road right-of-way as a public hearing without required notification
other than inclusion in a posted agenda.
The date establish for initial review by the Planning Commission shall be considered the
date of submission pursuant to $30-28-1 10, C. R.S., as amended.
The Planning Commission may continue consideration of the petition or request to
vacate county or public road rights-of-way to the next regularly scheduled Planning
Commission meeting. Under all circumstances, it shall conclude its review and render
its decision and recommendation to the BOCC within sixty (60) days of submission.
The decision of the Planning Commission, rendered pursuant to its review set forth
herein, shall be considered a recommendation. Under no circumstances shall the
Planning Commission action be considered a vacation of a road or right-of-way or final
action on such request.
The Board of County Commissioners has the discretion to vacate a road, however certain
vacations are prohibited per the following code section in 4-110.
E. Prohibited Vacations. The Board of County Commissioners shall not approve any petition
or request to vacate a county or pubic road right-of-way when the following information has
been submitted to the BOCC.
1. The subject county road or public road right-of-way provides any access to public lands
(for the purpose of this subsection public land shall mean any property owned by the
federal government or the State of Colorado).
Z. The subject county road or public road righ[of-way abuts or is connected to any
property, including any easement owned by the federal government. State of Colorado,
municipality, county, or special district, where such property or easement constitutes a
public park, recreational area or trail.
3. The subject county road or public road right-of-way is currently used or will be used in
the foreseeable future for any county or public road purpose. The term "county or public
road purpose" includes, but is not limited to, motor vehicle use, pedestrian use,
equestrian use, bicycle traffic, stock drive, or placement of utilities. The term
"foreseeable use" shall include a use projected or planned to occur within the next
twenty years as such has been include in any adopted state, county, federal, municipal
or special district facilities plan, comprehensive plan, zoning plan, recreation plan, street
plan, or similar document for development objectives for that entity. This provision shall
apply only if documentation of the current or foreseeable use is presented at the time of
public consideration of the proposal vacating resolution.

4. The Provisions of thls section shall not be deemed to preclude the BOCC's denial of a
petition or application to vacated a county or public road right-of-way for other reasons.
Staff Response: Staff finds the subject vacation is not in conflict with these criteria.
V. REVIEW CRITERIA & STANDARDS FOR LOCATION AND EXTENT
As you are aware, the BOCC recently adopted the "Location & Extent" regulations form the
state statutes in to the ULUR. ln that regulation, the Planning Commission is required to
determine whether the project (the road vacation in this case) conforms to the Comprehensive
Plan.
Staff Response: The existing Comprehensive Plan of 2000, as amended (the Comp Plan) does
not specifically address Road Vacations. However, there are a few areas that support this
action:
A) Public Participation: The act to vacate a public righGof-way will be done in a publically
noticed hearing before the BOCC ensuring that the public has a right to due process.
B) Transportation: One goal is to specifically "ensure that the County transportation system
(its roads) are safe, functional, and designed to handle existing and future levels of
traffic..." This vacation cleans up an 18-year old discrepancy ensuring that the proper
County road (the existing one) is the County road of preference and is located in a
properly described / deeded ROW to Garfield County. Further, this vacation does not
conflict with providing access to public lands as it does not currently do so.
C) Agriculture: By formally establishing the current existing CR 306 as the public ROW and
vacating the old ROW, it reduces that potential impact of an additional road way through
open grazing lands by allowing that old right-of-way to return to a more natural state.
Ultimately, Staff finds this vacation to be in the spirit of the applicable goals, objectives, and
policies of the Comprehensive Plan.
VI. PLANNING GOMMISSION REGOMMENDATION
ON October 13, 2010, the Planning Commission forwarded a recommendation of approval to
the Board of County Commissioners regarding the request to vacate a portion of the deeded
right-of-way for County Road 306 with the following findings.
1. That the public hearing before the Board of County Commissioners was extensive or
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.

That the above stated and other reasons, the proposed vacation and acceptance of CR
306 right-of-way has been determined to be in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the citizens of Garfield County.
That all representations made by the Applicant in the application, and at the public
hearing before the BOCC shall be conditions of approval, unless specifically altered by
the BOCC.
The subject county road or public road right-of-way does not provide any access to

RESOLUTION NO. 10-
A RESOLUTION CONCERNED WITH VACATING A PORTION OF
PUBLIC ROAD RIGHT-OF.WAY OTHERWISE KNOWN AS A
PORTION OF COLiNTY ROAD 306, ACCEPTING NEW PUBLIC ROAD
RIGHT-OF-WAY AND RESERVING A PRIVATE ACCESS EASEMENT.
WHEREAS, the Board of County Commissioners of Garfield County, State of Colorado
("BOCC") through resolution 2OO3-07, adopted a procedure for vacating public roads and rights-
of-way; and
WHEREAS, Resolution 2003-07 is mandatory for requests to vacate or abandon the
entire width of a public road or County road; and
WHEREAS, the BOCC have determined that for the requested vacation of portions of
County Road 306, as set forth herein, certain provisions of Resolution 2003-07 shall not apply;
and
WHEREAS, the BOCC desires to vacate a portion of a dedicated public road right-of-
way, as such lies within the property of the affected party as set forth below; and
WHEREAS, the public road right-of-way as set forth below is no longer needed as a
public road dght-of-way; and
WHEREAS, the BOCC is entitled to vacate a public road right-of-way by resolution
pursuant to the provisions of Section 43-2-303(1Xb), C.R.S. (2010); and
WHEREAS, to the extent necessary a duly noticed public meeting was conducted by the
BOCC concerning the need and appropriateness of vacating said public road right-of-way under
the provisions of Section 43-2-303(2Xb), C.R'S. (2010); and
WHEREAS, the purpose of this proceeding is to vacate that portion of the road right-of-
way for County Road 306 which is no longer required; and
WHEREAS, the Garfield County Planning Commission has conducted an appropriate
location and extent review pursuant to the provisions of Section 30-28-110, C.R.S. (2010) and
Article IV of the Garfield County Unified Land Use Resolution.
WHEREAS, the BOCC is entitled to accept right-of-ways, properly dedicated to the
public, for use by the public, and on behalf of the public, pursuant to the provisions of Section
43-2-20r(1)(a), C.R.S. (201 0).
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County, State of Colorado, as follows:
1. That the public meeting leading to vacation of this roadway was the subject of
necessary notice to landowners adjacent to the roadway, to the extent such notice was required
by the provisions of Section 43-2-303(2Xb), C.R.S. (2010) and Article IV of the Garfield County
Unified Land Use Resolution.
2. That a public meeting was conducted at which testimony and evidence was
presented concerning the vacation of portions of the subject road. No testimony or evidence was
presented objecting to said vacation. Exhibits were presented supporting the finding of proper
notice, if needed, and all interested parties were given an opportunity to attend, testify and
present evidence.
3. That the vacation of the roadway was conducted in accordance with Garfield
County Resolution 2OO3-07, or the BOCC waived compliance with those provisions, and Section
43 -2-303, C.R.S. (20 1 0).
4. That portion of the public road right-of-way of County Road 306, described in
Exhibit A and B, ittached hereto, and all other right-of-ways in SW%SE% Section 1 and
NWTTNE% Section 12 all in T8S, R96W, 6th P.M., should be and hereby are vacated except the
new public road right-of-way set forth in Exhibits D, 1 and 2 attached hereto.
5. That pursuant to the foregoing vacation, title to such property including all oil,
gas, and other minerals shall vest in the property owners of the abutting lands to the right-of-
ways.
6. That pursuant to Section 43-2-302(1X0, C.R.S. (2010), the vesting of title to the
vacated right-of-ways is subject to the private-access easement as set forth in Exhibit C attached
hereto.
7. The foregoing vacation does not leave any property adjoining said public road
right-o1--way without an established public road connecting said land with another established
public road.
8. The vacated right-of-ways do not provide access to public lands, and therefore,
this vacation does not leave any public land without access to a public road'
9. That this vacation is in the best interest and for the health, safety and welfare of
the general public.
10. The BOCC hereby accepts as the new public road right-of-way the property
deeded as forth in Exhibits D, 1 and 2 attached hereto. The acceptance by this Resolution is
limited to the descriptions contained therein.

EASEMENT DEED
Nathan N. Dutton of 4000 C,R. 306, Parachute, CO 81635, for the consideration
of ten dollars and other valuable consideration, receipt and adequacy of which are
acknowledged, grants and conveys to David S. Dutton and Muriel S. Dutton, whose
address is 4852 County Road 306, Paraohute, CO 81635, and their heirs and successors,
a non-exclusive perpetual easement ('oEasement') for ingress and egxess for agricultural
and residential purposes to and from real property in Garfield County, Colorado, legally
described as the NE'/NE% Section 12, T8S, R96W, 6th P.M., County of Garfield, State
of Colorado such Easement to be appurtenant to such property. The Easement shall be
across real property in Garfield County, Colorado, legally described as the NW%NE%
Section 12, T8S, R96W, 6th P,M., County of GarIield, State of Colorado such Easement
being further described on the attached Exhibit A and depicted on the attached Exhibit B.

SPECIAL WARRANTY DEED
Muriel Dution and Linda M. biion of and P.O. Box 58, New
Castle, CO 81647, and as owners of a life estate and remainder interest respectively to certain
lands in Garfield County described as the SW/+SE% Section 1, TBS, R96W, 6th P,M.
("Grantors"), County of Garfield, State of Colorado, for the consideration of ten dollars and
other good and vaiuable consideration, the receipt and adequacy of which are hereby
acknowledged, hereby sell and convey to the GARFIELD COUNTY BOARD OF COUNTY
COMMISSIONERS, with an address of 108 SrH Street, Suite 213, Glenwood Springs, CO
81601, a public road easement for travel by the public including associated subsurface road
support located in Garfield County, Colorado, and described on Exhibit 1, attached hereto and
incorporated by this reference, (the "Property"), reserving unto Grantors all oil, gas, and other
minerals and all other subsurface uses including but not limited to public utilities, private utilities
and similar uses.
Garfield County may protect this public road easemenr from all other users, including the
g1'antors, through issuance of permits that will control, condition, or prohibit the use of the
easement. The provisions of the foregoing reservations, interests, dghts and easements shall be
binding upon and run with the land.
Grantor warrants title against all persons claiming under Grantor, excepting taxes and
assessments for the years 2009 and thereafter, and easements, reservations, restrictions,
covenants encumbrances, and other matters shown on Exhibit 2 hereto.

Yesterday the BOCC off,rcially approved "waiver" of its road vacating process in regard to the cr306
Dutton/Dixon project. Pursuant to that action, and unless your clients object, the County will proceed to vacate
and accept relevant portions of the 306 right-of-way following only state law. Under that direction, the vacation
and acceptance issues have been set for 6:30pm on Oct. l3'h for a location and extent review by the Planning
Commission. Subsequently the BOCC will conduct a public hearing on Oct. 18th at 1 :15 to consider the
Resolution you have reviewed. Please advise this Office as soon as possible conceming your clients position on
the "waiver" and the schedule as their objection may substantially alter the course of events. It is also my
understanding that your clients will schedule a "walk through" with County staff this week to confirm

Don: At this time, my clients are planning on the vacation and acceptance issues for 6:30pm on Oct. 13ft by the
Planning Commission and the public hearing on Oct. 18th at 1 :15 to consider the Resolution. The compliance
with state process and waiver of the county process is acceptable. The form of the attached resolution (also sent
to you on Friday) is acceptable. I plan to attend the Oct. 18ft hearing. Should our office be in attendance for
the Oct. 13th meeting?
I instructed Linda to contact Jeff Nelson to schedule a "walk through" with County staff this week to confirm
construction compliance with the MOU. I also indicated to my clients that all issues of construction should be
resolved by Oct. 15, 2010 in order to proceed with the vacation. I asked that they take this issue up directly
with Jeff Nelson. If I hear anything.to the contrary or if there are any problems, I will let you know.
