I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located within the Silt Urban Area of Influence and the
subdivision designation of the Comprehensive Plan.
II. DESCRIPTION OF THE PROPOSAL
A. History: The applicants received approval of a Special Use permit
for —a—Tint auction facility/farm equipment sales operation on the
original 11.87 acre parcel in February, 1985 (Resolution #85-32). On
September 30, 1985, a Subdivision Exemption was conditionally approved
splitting their original parcel into two lots. This approval was
contingent on application for separate special use permits for the two
lots.
B. Project Description: The applicants propose to separate the two
existing business operations in conjunction witn the subdivision of
the property. The auction facility will be located on a proposed 7.5
acre lot, owned and operated independent of the adjacent farm
equipment sales operation. The livestock auction operation includes:
an existing auction barn, witn auction area and kitchen, livestock
pens and corrals designed to hold as many as 2000 head of livestock,
and large parking areas. The applicants propose to mitigate impacts
on neighboring land uses by screening the east boundary of the site
with Russian Olive trees, orienting lighting away from neighboring
properties, and maintaining reasonable hours of operation with sales
limited to 1-2 days a week and not on Sundays.

III.MAJOR ISSUES AND CONCERNS
1. The applicants propose no changes in their existing and
previously permitted operation and therefore should be subject to
the same conditions of approval as with their original permit.
2. Due to the subdivision of the property and business, the
applicant should establish the legality of using their existing
well for both parcels and businesses or obtain an additional
legal source of domestic water.
3. The Silt Town Council and Town Planning Commission recommended
approval of the original permit application in February, 1985,
subject to the following conditions:
a) That the petitioner screen the east boundary of the property
with a row of Russian Olive trees.
b) That signing will be confined to a painted or flush mounted
sign on the building (mounted signs should not extend into or
above the roof line).
c) That the petitioner work closely with the Town of Silt if
problems arise (odors, flies, etc.) to mitigate them.
d) That the Town of Silt be informed of any change in use of the
property which would promote cooperation and input for the
County's decision making process.
The Town of Silt has been advised of the present applications and has
indicated that any additional comments will be submitted prior to the
hearing.
IV. SUGGESTED FINDINGS
1. That proper publication and public notice was provided as
required for the hearing before the Board of County
Commissioners.
2. That the hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that meeting.
3. That for the above stated and other reasons, the proposed special
use permit is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the use of the tract of land comply with all regulations of
Garfield County relating to agricultural related business in the
zone district in which the property is located.
2. All proposals of the applicant shall be considered conditions of
approval unless stated otherwise by the Board of County
Commissioners.
3. That all conditions must be met within 120 days and that the said
Special Use permit shall be taken out within 120 days of the date
of issuance of the resolution approving the Special Use permit
unless an extension is granted by the Board of County
Commissioners.

4. The Special Use permit shall only be valid for a period of 120
days from the date of issuance unless construction or use has
commenced thereunder; and if construction or use has not
commenced within this specified period, the permit shall expire.
5. That the petitioner screen the east boundary of the property with
a row of Russian Olive trees or other appropriate vegetation.
6. Use of the site shall be limited to the proposed use of Livestock
Auction facility.
7. That the applicants shall, to the best of their ability, mitigate
impacts on surrounding property, including, but not limited to,
noise, odor, glare, traffic and visual impacts.
8. That the applicants establish the legality of using the existing
well for both proposed parcels and businesses or submit evidence
of an additional legal source of domestic water.
9. That the applicants obtain final approval of their subdivision
exemption creating the proposed 7.5 acre parcel on which the
auction facility is to be located prior to final approval of the
Special Use permit.
