Gentlemen:
The public hearing for your Special Use permit for an agricultural
related business has been scheduled for February 19, 1985 at 1:30 P.M.
at the Garfield County Courthouse in the Commissioners meeting room,
Suite 301.
Enclosed is a list of your adjacent land owners and copies of the
Public Notice for your public hearing. Each adjacent land owner must
recieve a copy of this notice by Certified Return Reciept mail. The
return reciepts you recieve from the Post Office, indicating that each
adjacent land owner has recieved the public notice must be brought to
the public hearing as proof that they have been notified. In addition
a copy of the public notice will have to be published in both the
Glenwood Post and the Rifle Telegram.
Notice to adjacent land owners must be made no less than five days
prior to the hearing, however it is suggested that the mailings go out
as soon as possible. Publication in the newspapers must be no less
than 15 days prior to the hearing. Due to the Rifle Telegrams weekly
schedule it should be submitted to them no later than January 28th by
noon. Publishing in the Glenwood Post should also be completed no
later than February 1st. As indicated above the mailings should be
done as soon as possible and no later than the week of February 4th.
Both your return reciepts from the mailings and the proof of Publications
from the two newspapers will have to be presented at the public h-aring.
You may bring these items to the planning office prior to the hearing
if that is more convenient. If you have any questions regarding these
public notice requirements or your application in general please

Dear Mr. Bernklau:
After further discussion with the Board of County Commissioners, it has
been determined that the Bullshipper's Cafe is an accessory use to the
auction facility. As such, the cafe may continue to operate as it has in
the past, as long as the auction facility is the primary use. In other
words, should the auction facility cease operating permanently, the cafe
would also have to close too, unless the property were rezoned.
Based on the above interpretation, I am enclosing your rezoning
application and application fee. Your cooperation and time involved with
trying to resolve this issue is appreciated. I apologize for any
inconvenience my previous letter may have caused you.

Gentlemen:
It has come to the attention of this 9ffice that restaurant is operating
on property owned by you in Section , T6S, R' ^W of the 6th Principal
Meridian. The property in question is at 32597 U. S. Highway 6 & 24. As
a result of further review by this office, it was determined that a
restaurant was not approved as a part of the Special Use permit authorized
by Resolution No. 85-32 and represents a violation of the Garfield County
Zoning Resolution of 1978, as amended.
Specifically, Section 3.02 of the Garfield County Zoning Resolution, as
amended, does allow for the approval of an agriculturally related business
in the A/R/RD zone district. Resolution No. 85-32 approved the
agriculturally related business for farm equipment sales and livestock
auction. The livestock auction facility was approved with the
understanding that a snack bar would be included in the facility as an
accessory to the sale barn operation. Operation of an independent
restaurant on days and hours other than when auctions are in operation was
not approved, nor could a commercial restaurant be approved in the A/R/RD
zone district. As such, it must be considered a violation of the County's
Zoning Resolution.
Please be advised that the provisions of the Garfield County Zoning
Resolution of 1978, as amended, and Section 30-28-124 (a) -(c) C.R.S., as
amended, provide that it is unlawful to use any building, structure, or
land in violation of any County Zoning Resolution, or amendment, duly
adopted by the Board of County Commissioners. Any person, firm, or
corporation found to have violated such zoning regulations is guilty of a
misdemeanor and, upon conviction, shall be punished by a fine of not more
than $100 or by imprisonment in the County Jail for 10 days, or by both
fine and imprisonment. Each day is considered a separate violation. The
County also has civil legal remedies available to it, including the
initiation of legal proceedings to obtain the injunction or abatement of
any unlawful use of land in violation of the County Zoning Resolution.

If some corrective action on the above noted violation is not taken within
30 days of the receipt of this letter, the Building, Sanitation and
Planning Department will turn all information over to the Garfield County
Attorney's office for legal action, if necessary. Please contact this
office should you have questions or additional information regarding this
zoning violation. Your cooperation in this matter is appreciated.

Gentlemen,
Enclosed is your Special Use Permit and a copy of the Resolution
of Approval for your Agriculture related Business. These documents
were signed on February 25, 1985 and your permitting procedure is
therefore complete.
Please note the conditions of approval as indicated on your
Resolution of Approval. These conditions including the screening of
your property on the eastern boundary with Russian Olive trees or
other appropriate vegetation need to be complied with.

RE: Fazzi-Julius-Bernklau Auction Barn
Dear Mr. Bean:
The Town of Silt Planning and Zoning Commission and the Silt Town
Board heard the referenced proposal for the auction barn facility
(including the cafe use), and recommends approval of the use,
subject to the following:
1. That the petitioner screen the east boundary of the
property with a row of Russian Olives.
That signing will be confined to a painted or flush
mounted sign on the building (mounted signs should not
extend into or above the roof line).
That the petitioner work closely with the Town of Silt
if problems arise (odors, flies, etc.) to mitigate
them.
4. That the Town of Silt be informed of any change in use
of the property, which would promote cooperation and
input for the County's decision making process.
If you have further- questions please contact me at Silt (876-

2..5:1) or Rifle (625-2121). We feel that well done agricultural
uses are appropriate for economic diversification and would offer
encouragement for these uses, provided they can be good
neighbors.

required application fee to $100.00 from $500.00.
