HomeMy WebLinkAbout5.0 Resolution 2008-101110 • 1111 h'� i KW 11111 Recep1/15/2 08 741172P 01!15/2008 04:29:16 PM Jean Alberico 1 of 3 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO o2 g l.— 36 f— 03 --COS STATE OF COLORADO )ss County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on, Monday, the 3`d day of December, A.D. 2007, there were present: John Martin Larry McCown Tresi Houpt Don DeFord Jean Alberico Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION No. 2008-10 A RESOLUTION CONCERNED WITH GRANTING A SPECIAL USE PEMIT FOR A TWO-FAMILY DWELLING FOR A PROPERY OWNED BY PAUL AND JENNIFER FLEETWOOD LOCATED AT 735 HEATHER LANE, GLENWOOD SPRINGS, COUNTY OF GARFIELD WHEREAS; Paul and Jennifer Fleetwood petitioned the Board of County Commissioners of Garfield County, Colorado, for a Special Use Permit for a Two -Family Dwelling consisting of an addition on the single-family dwelling to include a living area, garage, kitchen, bedroom, closet and bathroom to take care of a relative at the property; WHEREAS, the property is located within the Agricultural/ Residential / Rural Density (A/R/RD) zone district and is also located in Study Area 1 of the Comprehensive Plan of 2000 in an area designated as "low density residential"; WHEREAS, the Zoning Resolution of 1978, as amended, defines a Two -Family Dwelling as, "A building containing two dwelling units" [Commonly referred to as a Duplex] and is permitted as a Special Use in the ARRD zone district; WHEREAS, the Board held a public hearing on the 3rd day of December, 2007, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the 1 Eli sv L a+ icria i4 mil 1111 Reception#: 741172 01/15/2008 04:29:16 PM Jean Alberico 2 of 3 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO approval of said special use permit; and • WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1) That the approval of such Two -Family Dwelling is in the best interests of the general health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 2) That proper public notice was provided as required for the hearing before the Board of County Commissioners. 3) That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 4) That the Two -Family Dwelling complies with applicable Sections of the Zoning Resolution of 1978, as amended, if all conditions have been met. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Special Use Permit is hereby approved subject to compliance with all of the following specific conditions: 1. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. Any physical changes to the Two -Family Dwelling may require a building permit from the Garfield County Building Department. 3. All lighting associated with the property shall be directed inward and downward towards the interior of the property. 4. Prior to issuance of a Special Use Permit, the Applicant shall upgrade the septic system and obtain approval from the Building and Planning Department. 5.
