Mann for Marilyn Mann LOCATION: A parcel of land in the NE1/4, SE1/4, Section 31, T7S R87W; more accurately described as 2727 CR 100, two (2) miles east of Carbondale. SiTE DATA: 2.56 Acres WATER: Well SEWER: ISDS ACCESS: Direct access from CR 100 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD; R/L/SD I. RELATIONSHIP TO THE COMPREFIENSIVE PLAN The property is located in District F - River/Floodplain; Severe Environmental Constraints, as designated by the Garfield County Comprehensive Plan's Management Districts Map. I1. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is generally level with native vegetation along the Roaring Fork River, which forms the northern boundary of the property. See site map, page B. Background: The parcel was created through a subdivision exemption (Ries) granted by the Board of Comity Commissioners in November, 1987. Recently, the applicants completed constriction of a single-family dwelling on the property. An inspection by the County Building Department discovered evidence that seemed to indicate the concurrent construction of an additional, separate living space located on the second floor of the approved, single-family dwelling, above the garage. The building plans submitted to the County Building Department, clearly show the additional living space, complete with stairs, kitchen, and bathroom. See plans attached on pages 5 . The applicants were notified this type of construction was in violation of applicable zoning standards and notified that a Special Use Permit would need to be applied for and granted by the Board of County Commissioners. III. MAJOR ISSUES AND CONCERNS 1. Section 2.02.21 of the Zoning Resolution defines a Two -Family Dwelling as "A building containing two (2) dwelling units." 2. Section 3.02.03 (Uses, Special) of the Zoning Resolution allows for a two-family dwelling within the A/R/RD zone district. 3. Section 3.02.08 (Additional Requirements) states "All uses shall be subject to the provisions under Section 5 (Supplementary Regulations)." • • 4. Section 5.03 (Conditional and Special Uses) shall conform to all requirements listed thereunder and elsewhere in this Resolution plus the following requirements: a) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the environmental Health Officer shall either be in place or shall be constructed in conjunction with the proposed use; b) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; c) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. 5. Water: The applicants have been granted a permit from the State Division of Water Resources for the construction of a well to serve one (1) single-family dwelling and inigaf n of not more than 0.1 acre of home lawn. See well permit attached on page The second dwelling is not covered by this permit and additional water will need to be secured from Basalt Water Conservancy District. A letter from Resource Engineering, attached on page , indicates that the applicant will probably be granted an amended contract m the District for the additional water. Staff recommends that approval be contingent on receiving the additional water. 6. Sewer: The applicants have installed an engineered ISDS to process the waste water from the original single-family dwelling. The ISDS application indicates the home will be built with three (3) bedrooms and a loft, a garbage grinder, automatic washer and a dishwasher and have one (1) occupant. It is assumed that the additional ilyelling will nearly double these specifications. See application attached on pages /e . It will be necessary for the applicants to have an engineer satisfactorily demonstrate that the current ISD system and leach field are capable of treating the effluent generated by the additional dwelling unit. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staff recommends APPROVAL based on the following conditions: 1. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant shall have 360 days from the date of the Resolution of • • Conditional Approval to meet all conditions set forth in the Resolution. The Special Use Permit shall be issued when all conditions are met and shall expire 360 days after issuance, unless construction or use have commenced. 3. Applicant must demonstrate that additional water has been secured, providing a legal and adequate source of water for the two (2) dwellings. 4. An engineer's certification that the ISDS is capable of processing the expected amount of effluent generated by the two-family dwelling. 5. All additional permits and inspections are applied for and received from the County Building Department. 6. Resource Engineering, Inc. (RESOURCE) is the engineer for the Basalt Water Conservancy District (District). Ms. Mann currently has a water service contract with the District for 0.70 acre feet per year and 0.033 cfs (contract no. 3.3.5.78a). The contract covers one single family home on Lot 4 located in the NE'//,, SW3/4 , Section 31, Township 7 South, Range 87 West, 6th P.M. Ms. Mann has contacted RESOURCE to request an amendment to her contract which would increase the contract amount to include the addition of an attached apartment to her existing home. An amendment of this type is typically approved by the District's Board of Directors and it is our opinion that Ms. Mann's request would also *be approved.
