Koss( Deputy when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 81-64 , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board A RESOLUTION OONCJMNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY MATfliu' AND ASSOCIATES WHEREAS, the Board of County Commissioners of Garfield County has received an application from Matthew and Associates for a special use permit for a Commercial Park on the following described tract of lane?.: A part of the SW/4 SW/4 of Section 1 and of the NW/4 NW/4 of Section 12, Township 7 South,Ranrc 96 West. of the 6th P.M., described as follows: Beginning at a point on the East line of the SW/4 Sid/4 of said Section 1 which is 110 feet South of the Northeast corner of said SW/4 St'7/4; thence South, along the East lines of said SW/4 SN/4 and of the NW/4 NW/4 of said Section 12, a distance of 1449 feet to a point on the Northwesterly extension of the Southwesterly richt of way line of Parachute Avenue from the Town of Parachute, formerly Grand Valley; Thence North 50° West, along said right of way line, 914 feet; thence Northeasterly to the point of beginning, EXCEPT that portion thereof lying within said extension of Parachute Avenue. W PPETS , pursuant to required public notice, the Board conducted a public hearing on the 2nd. day of fear. -h, 1981, upon the question of whether the above described special use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said.special use permit; and WHEREAS, the Board on the basis of the evidence produced at the aforemen- tioned hearing, has made the following determinations of fact: 1. The proposed use is compatible with the uses existing and permitted in the district in.which it is to be located, provided that certain hereinafter contained conditions be complied with. 2. That neither the impact on traffic volume and safety or on utilities, or any other impact of the special use will be injurious to the established neighborhood or zone district in which the special use is to be located. 1`U7, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colc5rado, that a special use permit be and hereby is authorizes' remitting the use of the above described tract of land for a commercial park, upon the following conditions:. 1. That the use of the tract of land comply with all present and future regulations of Garfield relating to Cc anercial Parks in the zone district in which the property is now or may later be located; 2. That, prior to the issuance of the authorized special use permit, the above described tract of land shall be severed from any other tract of land upon which there may exist a principal use, unless such other such principal use has been terminated at the time of the issuance of the special use rermit. • 3. a. The uses on the property shall be limited to warehouse, storage, material handling, and. accessory uses of the above designated in the R/L zone district as special uses. b. Fire protection for the site shall be provided with a 20,000 gallon sistern havi nc? a standpipe with a standard fire thread coupling. The location of the sistern shall be within close proximity of the buildings and subject to review by the Parachute Fire Department. The sistern shall be filled from the two inch waterline that presently serves the property. c. There shall not be more than two additional buildings on the site. The maximum size of each of the buildings shall be 6,000 sq. ft. d. Improvements to the site shall be installed as required to service each phase of the develo trent before a certificate of occupancy will be issued. for that phase. The improvements will be subject to review by the Planning Department, and Building Department prior to issuance of a Certificate of Occupancy. The improvements to the site shall include: roads, utilities, sewer treatment, water lines, fire protection, parking, and landscaping.
