The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. Christie and Katherine S. Christie and Katherine S. Christie desire to make this Declaration for the purpose of clarifying the respective rights and duties and establishing easements and procedures for jointly operating said water well and delivering water to the properties of the present owners and the owners of the new proposed lot Nos. 3 and 4, and for providing a method for equitably dividing the water derived from operation of the system, and for equitably allocating the shared payment of costs of operation and maintenance of the water well and its pump and other structures by all of the parties. NOW THEREFORE, in consideration of the mutual obligations, promises and covenants set forth herein, and the due performance hereof, and for other good and valuable consideration, the receipt and sufficiency of which is expressly acknowledged, including but not limited to the acceptance of the benefits and detriments deriving here from, the above-named parties dedicate and agree as follows: SECTION 1. Each owner of the new developed lot Nos. 3 and 4 of approximately 10.19 acres and 10.73 acres, respectively, created as a result of the Christie Subdivision Exemption for the above-described property shall be an owner of one third (1/3rd) of the subject well permit, well, pump, power source for the pump, fittings at the well head, meter (whether one exists at this time or will be installed at a future time), pump house, valves, and any other pipe or pipelines and other structures that are jointly used. SECTION 2. The continuing costs of electricity, maintenance, upgrading, cleaning, repairing and all other work required on shared components of this water system to cause the water at the well to become and remain available to deliver water to the present owners and the owner of the new developed lot Nos. 3 and 4 shall be shared by said lot owner in the ratio of 33.3* by the present owners and 33.35% by each owner of the new developed lot Nos. 3 and 4., except that if the new developed lot Nos. 3 and 4 require additional pressure tanks, valves and associated fittings (pressure system), the cost of the additional pressure system shall be borne solely and equally by the owner of each of the new developed lot Nos. 3 and 4. The easement described above shall allow for a twenty foot square well access, repair and maintenance easement around the well and a ten foot wide water line repair and maintenance .easement. In the event that either of the owners of the new developed lot Nos. 3 or 4 require a specific, surveyed location of the structures which have been constructed, in order to limit the generality of this section, the cost of obtaining the survey and preparing.the modified -easement language shall be borne solely by the owner(s) of lot or lots requiring said survey. The Declarants shall sign the necessary conveyancing documents. SECTION 4. This Dedication shall be binding upon and inure to the benefit of Theodore W. Christie and Katherine S. Christie, and their assignees or successors, and the easements and covenants granted or agreed to herein shall be deemed to run with the land and shall encumber the land of each party for the benefit of the properties of the parties as described herein. SECTION 5. The laws of the State of Colorado shall govern the validity, effect and construction of this Dedication. SECTION 6.
