Smith John Martin Larry McCown Don DeFord Mildred Alsdorf Chuck Deschenes , Commissioner Chairman , Commissioner , Commissioner ,County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 97-29 A RESOLUTION CONCERNED WITH THE APPROVAL OF AN AMENDMENT TO A SPECIAL USE PERMIT FOR GRANT BROTHERS CONSTRUCTION, L.L.C. (84-48, MOBILE PRE -MIX COMPANY FOR THE LOESCH PIT) WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Grant Brothers Construction, L.L.C. for construction of a concrete batch plant on the following described tract of land: See Attached: Exhibit A (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 1 lth day of March 1996, upon the question of whether the above-described Amendment to Special Use Permit No. 84-48 should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said amendment to the Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1 11111 111111 11111 111111 11111 1111111 11111 ilii 1111 506743 04/08/1997 03:40P B1014 P820 447 1 of 4 R 0.00 D 0.00 N 0.00 GARFIELD COUNTY CLER C/- • 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Amendment to Special Use Permit No. 84-48 be and hereby is authorized permitting the use of the above described tract of land for the construction of a concrete batch plant, upon the following specific conditions: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. That the operation of the facility be done in accordance with all federal, state and local regulations governing the operation of this type of facility and that all permits remain updated and in effect at all times. If any permits are modified, then a copy of the modified permit(s) shall be sent to the Planning Department for inclusion in the file. 3. That the applicants receive any necessary driveway/intersection permits from the Colorado Department of Highways, prior to the commencement of batch plant operations. 4. That if the applicants will continue to allow grazing of domestic animals on the property, reasonable care shall be taken to safeguard the animals. 5. That all current and future operations of the permitted uses of the property be done in a manner that is consistent with all earlier approvals and conditions of approval regarding the operation of the facilities. Any future modifications or amendments to the permitted uses shall require issuance of an additional Special Use Permit. The issuance of this Spacial Use Permit only allows the concrete batch plant to be placed as shown on the sketch map, it does not supersede any other requirements or conditions. 6.
