At a regular meeting of the Board of County
Commissioners for Garfield County, Colorado, held at the Commissioners'
Meeting Room at the Garfield County Courthouse in Glenwood Springs on
the Third day of August A.D. 1987 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 87-79
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION BY BEN KRUEGER AND THREE MILE MOBILE HOME PARK.
WHEREAS, the Board of County Commissioners of Garfield County,
Colorado, has received application from Ben Krueger and Three Mile Mobile
Home Park for a Special Use permit for the expansion of an existing mobile
home park on the following described tract of land:
Attached Exhibit A
(in the State of Colorado and the County of Garfield); and
WHEREAS, pursuant to required public notice, the Board held a public
hearing on the 13th day of July, 1987, upon the question of whether the
above-described Special Use permit should be granted or denied, at which
hearing the public and interested persons were given the opportunity to
express their opinions regarding the issuance of said Special Use permit;
and
WHEREAS, the Board on the basis of substantial competent evidence
produced at the aforementioned hearing, has made the following
determination of fact:
1. That proper publication and public notice was provided as
required by law for the hearing before the Board of County
Commissioners.
2. Thatthe hearing before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that hearing.
3. For the above stated and other reasons, the proposed use is in
the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Garfield County, Colorado that the Special Use permit be and hereby is
authorized permitting the use of the above described tract of land for the
expansion of a mobile home park by the addition of Space No. 20 upon the
following specific conditions:
1. That all proposals of the applicant shall be considered
conditions of approval unless stated otherwise by the Board of
County Commissioners and that all conditions of approval
contained in previous Resolutions of Approval shall remain in
force and effect.

2. That any mobile home placed on Space No. 19 and No. 20 shall be
limited to mobile homes that do not exceed the 25% lot coverage
requirement.

LEGAL DESCRIPTION
A tract of land situate in the northeast quarter of the northeast
quarter of Section 28, also in the northwest quarter of the northwest
quarter of Section 27, all in Township 6 South, Range 89 West 'of the
6th Principal Meridian, being more particularly described as follows:
Co:nurencing at an iron post with a brass cap, found in place and properly
marked for the northwest corn;r of said Section 27; thence along the
west line of said northwest (garter of the northwest quarter of Section
27, South 00 degrees 04 minutes West a distance of 1332.17 feet, to the
true point of beginning, with all bearings contained herein being relative
to a bearing of South 88 degrees 37 minutes East between the northwest
corner of said Section 27 and the north quarter corner of said Section
27; thence North 89 degrees 52 minutes 30 seconds West a distance of
237.15 feet, to a 2 1/2" diameter steel pipe found in place; thence
North 29 degrees 57 minutes 00 seconds West a distance of 117.59 feet,
to the southeasterly right-of-way line of County Road #127 as constructed
and in place; thence the following four courses along said right-of-way
line, North 38 degrees 03 minutes 00 seconds East a distance of 260.34
feet; thence North 33 degrees 41 minutes 00 seconds East a distance of
245.94 feet; thence North 35 degrees 03 minutes 00 seconds East a dis-
tance of 153.20 feet; thence North 44 degrees 19 minutes 00 seconds
East a distance of 8.88 feet to a rebar and cap. found in place and
marked L.S. 7972; thence leaving said right-of-way line and along the
boundary of a tract of land as described in Book 529 Page 571 Reception .
No. 294777 as recorded in the Garfield County Clerk and Recorder's Office,
the following eight courses, South 26 degrees 01 minutes 06 seconds East
a distance of 461.73 feet to a rebar found in place; thence North 45
decrees 23 minutes 00 seconds East a distance of 73.57 feet; thence
North 57 degrees 49 minutes 00 seconds East a distance of 36.00 feet;
thence North 44 degrees 28 minutes 00 seconds East a.distance of 153.46
feet; thence North 50 degrees 22 minutes 00 seconds East a distance of
94.67 feet; thence North 57 degrees 29 minutes 00 seconds East 3 distance
of 34.00 feet; thence North 65 degrees 33 minutes 00 seconds East a
distance of 41.61 feet; thence North 84 degrees 36 minutes 00 seconds
East a distance of 35.22 feet; thence leaving said boundary as described
in Reception No. 294777, continuing on bearing North 84 degrees 36 minutes
00 seconds East a distance of 3.68 feet; thence South 59 degrees 49 minutes
26 seconds East a distance of 64.54 feet; thence South 19 degrees 46
minutes 00 seconds East a distance of 87.29 feet; thence South 18 degrees
