The water supply will be provided by wells diverting tributary ground water. These well permits have been recently issued and have certain conditions of approval which are as follow: 1. The applicant must have the wells adjudicated by the Division 5 Water Court. 2. The yield of the wells must not exceed 100 gpm. 3. The annual appropriation of the two wells must not exceed 150 acre-feet. 4. Totalizing flow meters must be installed on both wells. The developer has indicated that he is going to utilize a portion of the Basalt Water Conservancy District's conditional water rights as an alternate point of diversion to improve the priority date of the wells. We have no objection to this procedure provided a decree for the alternate point of diversion is obtained from the Water Court. The Basalt Water Conservancy District will transfer a portion of their decrews to the wells for the legal water supply. Will this proposal provide a viable water supply for this development. On June 20, 1958, in Civil Action No. 4613, the Garfield County District Court awarded to the Basalt Conduit, as part of the Basalt Project, Priority No. 718, Project No. 511, a conditional water right for 450.0 cubic feet of water per second of time, to be used for the generation of electricity, irrigation, domestic, municipal, stock watering, piscatorial, and industrial uses, with appropriation date of July 29, 1957. 7. On June 26, 1980, the claimant filed, in Water Court for Water Division No. 5, an application for change in water right in which it is requested that Heuschkel Well No. 1 at the location as described in paragraph 5(b) above, and Heuschkel Well No. 2 at the location as described in paragraph 5(c) above, be used as alternate points of diversion for 0.22 cubic foot of water per second of time of the water previously awarded to the Basalt Conduit. 8. On December 31, 1979, the Office of the State Engineer issued Permit No. 24568-F for Heuschkel Well No. 1 and Permit No.24567-F for Heuschkel Well No. 2. 9. The change of water right requested will not injuriously affect the owner of or persons entitled to use water under a vested water right or a decreed conditional water right, and the change in water right should be granted in accordance with C.R.S. 1973, 37-92-305(3). The Referee does therefore conclude that the above entitled application should be granted, and that Hueschkel Well No. 1 at the location as described in paragraph 5(b) above, and Heuschkel Well No. 2 at the location as described in paragraph 5(c) above may be used as alternate points of diversion for 0.22 cubic foot of water per second of time of the water previously awarded to the Basalt Conduit under Priority No. 718; provided, however, that the total amount of water diverted at Heuschkel Well No. 1 and Heuschkel Well No. 2 shall not exceed 0.22 cubic foot of water per second of time. It is accordingly ORDERED that this ruling shall be filed with the Water Clerk and shall become effective upon such filing, subject to Judicial review pursuant to Section 37-92-304 C.R.S. 1973. It is further ORDERED that a copy of this ruling shall be filed with the appropriate Division Engineer and the State Engineer.
