Boss, Deputy when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 81- 122 RESOLUTION CONCERNED WITH THE AMENDMENT OF RESOLUTION #80-101, CONCERNED WITH THE CONDITIONAL APPROVAL OF AN APPLICATION FOR SPECIAL USE PERMIT BY AUSTIN HEUSCHKEL. WHEREAS, an application has been submitted by Austin Heuschkel for an amendment of this Board's Resolution #80-101, relating to the authorization of a special use permit for the purpose of establishing and operating a mobile home park, in accordance with Section 9.03 of the Garfield County Zoning Resolution; and WHEREAS, in such application Austin Heuschkel requested a modification of the aforesaid resolution, extending the authorized activity to a tract of land containing approximately 0.21 acres, more or less, located in Lots 20 and 21, Section 1, Township 7 South, Range 89 West of the 6th Principal Meridian, Garfield County, State of Colorado; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has reviewed the application, has conducted a public hearing duly advertised and held in accordance with the requirements of Section 9.03.04 of the Garfield County Zoning Resolution regarding the question of whether the requested extension of the special use permit should be granted, and, if granted, whether any conditions should be imposed upon the extension of such special use permit, and during such hearings received testimony and other evidence from the applicant and interested parties; and WHEREAS, the Board of County Commissioners has considered said application and supporting materials, and other evidence presented at the public hearing, and based thereon, the Board of County Commissioners finds that the findings included in Resolution #80-101 also accurately relate to the application presently before the Board, and further finds as follows: That the proposed extension of the requested special use permit is for the limited purpose of constructing upon such tract a sewage disposal facility in the nature of a package plant, whose location on this 0.21 acre tract will permit the location of the sewage treatment plant to serve facilities other than the mobile home park to which the plant will imme- diately be an accessory use. That the location of the sewage treatment plant on the property may be accomplished in a manner which minimizes its effect on adjoining property owners provided that the location be consistent with those representations previously :rade to the Board. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado: Section 1. That Section 1 of the operations provisions of Resolution #80-101 be amended to read as follows: Section 1. That the issuance of special use permit for a mobile home park be and hereby is authorized upon the following described lands, to be issued �-a • • and effective upon and during compliance with the conditions more fully set forth herein: A parcel of land situated in Government Lots 20 and 21, Section 1, Township 7 South,,Range 89 West of the Sixth Principal Meridian, County of Garfield, State of Colorado, being more particularly described as follows: Conunencing at the Northeast Corner of said Lot 20, an iron post and brass cap found in place and properly marked; thence S.59°50'26"W. 979.01 feet to the Southeast Corner of Document No.#266220 as recorded in the Garfield County Clerk and Recorder's Office, the True Point of Beginning; thence N.88°26'01"E. 11.78 feet to a point on the Westerly right-of-way line of the Glenwood Ditch; thence along said westerly right-of-way line S.12°08'46"W. 51.33 feet; thence along said westerly right-of- way line S.57°51'52"W. 117.45 feet; thence leaving said westerly right-of-way line N.07°49'59"W. 14.82 feet to a point on the easterly line of a 20.00 foot roadway; thence along said east- erly line N.07°49'59"W. 56.17 feet; thence along said easterly line N.11°08'36"W. 39.59 feet to the Southwest Corner of said Document No.#266220; thence along the south line of said Document'No.#266220 N.88°26'01"E. 115.85 feet to the True Point of Beginning, containing 0.21 acres, more or less. .A parcel of land situated in Government Lets 20 and 21, Section 1, Township 7 South, Range 89 West of the Sixth Principal Meridian, lying Easterly of the Easterly right-of-way of the Glenwood Ditch, Northerly of the Northerly Boundary of Government Lot 31, located in said Section, and Westerly and Southerly of Document No. 261923 as recorded in the)Clerk and Recorder's Office of Garfield County, Colorado, is more particularly described as follows: �. The above described parcel of land contains 9.52 acres, more of less. That Section 3 of the operational provisions of Resolution #80-101 shall be amended by the addition of a new subsection, which shall be identified as d: d. The mobile home park shall be served by a sewage treatment plant in the nature of a package plant, which shall be installed on the above described 0.21 acre tract lying north of the Glenwood Ditch, which plant shall be located parellel to but complying with setback requirements from the long southeast boundary of said 0.21 acre tract. Section 3. That other than as herein amended, the provisions of this Board's Resolution #80-101 shall remain in full force and effect.
