when the following proceedings, among others were had and done, to-wit:

A RESOLUTION CONCEPJ{ED WITH TIIE APPROVAL OF A SPECIAL USE PER},[T APPLICATION BY ALLEN
JOHNSON, RONAID RADIKE, & CLYDE YORK.
I'IIIEREAS, the Board of County Conrrissioners of Garf ield County has received an app-lication fron A1len Johnson, Ronald Radtke, and Clyde York for a special use pernit fora conmercial park on the following described tract of land:
A parcel of land situated in Lot 9, Section 1, Toumship 7 South, Range 89 West ofthe 6th Prineipal Meridian, lying Southcrly of the Southerly right-oi-way line ofthe Denver and Rio Grande Western Railroad (Aspen Branch) and Northerly of theNortherly right-of-way line of a County Road as constructed and in plate (old
Colorado State Highway No. 82); said pareel of land is described as follows:
Beginning at a point on the Southerly right-of-way line of said railroad whencean iron post with a brass cap found in place and properly marked for the North-west corner of said Lot 9, bears: N. 57"36100" W. 896.77 feet and N. 00o3g'00" I.I.97.29 feet; thence 188.39 feet along the arc of a curve to the right, having a radiusof 1809.86 feet, the chord of which bears: S. 54o37t05" E. 188.30-feet; thence S.00o34'00" 8.54.14 feet to a point on the Northerly right-of-way line of said high-tay; thence North 53"28'51" w. 218.07 feet along the Northerly right-of-way lineof said highway; thence N. 32"24100r' E. 39.55 feet to a point on ihe Southerl-yright-of-way line of said railroad, the point of beginning. Containing 0.20 acres,

TPREAS, pursuant to required public notice, the. B.'rard conducted a public hearinp;on the 6th d"y of Jtme, 1981, upon the question of whether the above described special usepe--ult should be granted or denied, at which hearing the public and interested persons weregiven the opportunity to e:(press their opinions regarding the issuance of said special usepe:mlt; and
WHEREAS, the Board. on the basis of the evidence'produced at the aforementionedhearing, has made the following determinations of fact:
1. The proposed use is compatible rrith the uses existing and permitted in the dis-trict in which it is to be located, provided that certain hereinafter contained conditionsbe conplied with.
2. That neither the impact of traffic volume and safety or on utilities, or anyother iropacE of the special use will be injurious to the established neighborhood or zonedistrlct in which the special use is to be located.
Nffi, TIIEREF0RE, BE IT RESOLVED by the Comlissioners of Garfield County, Colorado,that a special use perruit be and hereby is authorized perr.itting the use of the above d.es-cribed tract of land for a comunercial park, upon the following speeific cond.iti-ons:
1. That the use of the tract of land comply rrith all present and future regulationsof Garfield relating to multiple uses on one lot under one ownership in the zone districtin which the property is now or may later be located;
2. That, prior to the issuance of the authorized special use permit, the abovedescribed tract of land shall- be se.iered fron any other tract of land upon which there
may exist a principal use, unless such other such principal use has been teruinated atthe time of the issuance of the special use pernit.

3. The uses shall be in one building and linited to five offices and one shop-
warehouse.
The uses shall be further limited to:
A) Office for conduct of business or professi-on.
. B) Studio for conduct of arts and crafts.
C) Commercial establishments.
D) Wholesale and retail establishments limited to: sale
of appllances, hardware, building, and materials.
E) General service establishments limited to service and
repair of appliances , cabinetry, gLazLng, machining,
plumbing, and sheet metal.
4. The ditch along the westerly portion of the property along County Road
154 sha1l be piped and covered.
5. Concrete bumpers or some other similar barri.cade shal1 be used along 154
Road to prevent '.rnlimited access to the road.
6. Landscaping shall be used to define the aecess points along 154 Road.
7. Both the landscaping and barricades shal1 be subjeet to review by the
County Planning Department.
8. This special use permit shall be subject to review for compllance at the
request of the Garfiel-d County Couunissioners.
