PROJECT NAME: Request for a Special Use Permit for
a 25 KV electric distribution line
APPLICANT: Grand Valley Rural Power Lines, Inc.
LOCATION:
From the Fruita substation in Mesa County
to the Salt Creek Mining Company coal mine
in Garfield County.
EXISTING ZONING: R/L and 0/S
RELATIONSHIP TO THE COMPREHENSIVE PLAN:
This request falls within "unclassified" areas of the County Comprehensive Plan
Management District Map.
DESCRIPTION OF THE PROPOSAL:
The applicant proposes to construct a 25 KV electric distribution line to serve
the Salt Creek Mining Company coal mine and various ranchers in western Garfield
County. The line, which will be constructed on wood poles, will require a 20
foot wide "permanent" right-of-way and a 50 foot temporary right-of-way in
order to construct the line. Three to four temporary staging areas will be required
for construction of the project (see map, page 6 ).- These areas) which will be approx.
one acre each, will be used for temporary storage of materials and equipment.
The proposed distribution line is designed with adequate conductor separation to
protect raptors and other perching birds. The applicant indicates that the
project should have no detrimental effect on wildlife in the area. There will
be minimal noise and surface disturbance associated with the line, especially
after construction iE complete.
Construction will require approximately 30 - 120 days to complete, depending upon
the start-up time and weather conditions, and is now scheduled to begin October 1, 1982.
Approximately 15 - 20 workers are anticipated for the peak construction period.
If a local contractor receives the job, local help will be employed. Otherwise,
the temporary work force will be housed in motels in the Grand Junction area.
Revegetation will take place upon cessation of construction. On public lands,
Grand Valley will reseed to Bureau of Land Management specifications. On fee lands,
the applicant will reseed in accordance with the individual landowner's requirements.
STAFF COMMENTS:

4. Mesa County - does not require a county land use permit for this size line.
FINDINGS:
1. That proper publication and public notice was provided as required by law for
the hearing before the Board of County Commissioners.
2. That all hearings before the Board of County Commissioners were extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing.
3. That the proposed special use conforms to Section 5.03, concerning the Approval
or Disapproval of a Petition for a Special Use, of the Garfield County Zoning Resolution.
4. That the proposed land use will be compatible with existing and permitted land
uses in all directions.

On September 8, 1982, the Garfield County Planning Commission recommended
approval of this request with the following conditions:
1. All proposals of the applicant shall be considered conditions of ap-
proval unless stated otherwise by the Board of County Commissioners.
2. The applicant shall submit an as -built legal description of the
distribution line to the Planning Department within 60 days of the
project completion.
3. The applicant shall submit a copy of their BLM right-of-way agreement
to the Planning Department prior to issuancecf the Special Use Permit.
4. The applicant shall submit evidence of their legal right of entry
to private lands crossed by the electrical .' trib iorline to the Planning

5. The applicant's compliance with the conditions of this resolution and
any special use permit issued pursuant heretdo shal�be mons or thro h

6. The permit issued hereunder shall extend only to the location and operation
of a 25 KV electrical distribution line and the temporary staging areas.
7. The applicant must receive the Special Use Permit within one year of the
authorization to approve and issue the permit.
ADDENDUM
As a result of the September 8 Planning Commission meeting, the applicant
has indicated several changes in the proposal. The proposed staging areas
will now be located on private lands, rather than BLM lands. Construction
is now scheduled to commence on November 1, 1982 rather than October 1, 1982.

power line in an area between Mack and Douglas Pass, part
of which would go across my property. As we have discussed,
subject to working out the easement situation, I certainly
welcome the power source and hope you will be able to
provide electricity to my ranch properties near the line.

EASEMENT •
KNOW ALL MEN BY THESE PRESENTS, that the undersigned, (Grantor) for and in
consideration of Ten Dollars ($10.00) and other good and valuable
consideration, the receipt of which is hereby acknowledged, does hereby
grant, sell, bargain, and convey unto GRAND VALLEY RURAL POWER LINES, INC.,
a Colorado Corporation, it successors and assigns (Grantee), a perpetual
easement, not exceeding twenty (20) feet in width, to construct, operate,
and maintain a powerline for the transmission and distribution of electric
energy across the following described property:
Lots 6 and 23 in Section 35, T8S, R102W, 6th P.M., Mesa County, Colorado
(Book 1364, Page 379) according to the resurvey thereof as shown on
attached Exhibit A.
And in Section 6, T8S, R102W, 6th P.M.,
19, 20, 21, 27, 29, 30, and 33.
And in Section 29, T7S,
and 27.

This easement shall carry with it the right of ingress and egress to and
from, and access on and along said easement, with the right to use existing
roads, to survey, construct, repair, remove, replace, reconstruct, patrol,
inspect, and maintain electric transmission and distribution lines
including poles together with braces, guys, anchors, crossarms, cables,
conduits, wires, conductors, transformers and other fixtures, devices and
appurtenances used or useful in connection therewith, and full right and
authority to cut, remove, trim or otherwise control all trees, brush and
other growth on or overhanging said easement.
Grantor reserves the right to the use and enjoyment of said property except
for the purposes herein granted, but such use shall not hinder, conflict,
or interfere with Grantee's rights hereunder or disturb Grantee's
facilities, and no buildings, structures, signs, or wells shall be erected
or placed on, or over said easement without Grantee's prior written
consent.

Dear Mr. Luhrs:
Grand Valley Rural Power Lines, Inc. is proposing to construct
a 25 KV line from their Fruita Substation at Lk and 19 Road
to the Salt Creek Coal Company Mine at Munger Gulch approxi-
mately 16 miles north of Loma in Garfield County. See attached
map.
Our firm has been employed by Grand Valley to obtain rights of
way and permits for this project.
On checking the Mesa County Zoning regulations, we believe
that the proposed line will be a permitted use under the AFT
zone. If this is correct, would you please indicate your
concurrence by signing where indicated below and returning
one copy of this letter for our files.
