RESOLUTION NO. S2-239
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY GRAND
VALLEY RURAL POWER LINES, INC.
WHEREAS, the Board of County Commissioners of Garfield County has received an
:application from Grand Valley Rural Power Lines, Inc. for a special use permit for
a utility line; specifically, a 25 KV electric distribution line on the following
described tract of land:
Beginning at the Fruita Substation located in Section 3, Township 1 North,
Range 2 West, Ute Principal Meridian, North to Section 16, Township 2
North, Range 2 West, Ute Principal Meridian; thence Northwesterly to
Section 6, Township 9 South, Range 101 West, 6th Principal Meridian;
thence Northwesterly along the existing pipeline to Section 6, Township 9
South, Range 102 West of the 6th Principal Meridian; thence Northerly
along State Highway 139 to Section 21, Township 7 South, Range 102 West
of the 6th Principal Meridian to the Salt Creek Mine.
The BLM lands to be crossed are as follows:
Sections 4, 9, 16 - T2N - R2W, Ute P.M.
Sections 6, 7, 18 - T9S - R101 W, 6th P.M.
Section 1 - T9S - R102W, 6th P.M.
Sections 5, 6, 8, 9, 15, 16, 17, 21, 22, 23, 26, 36 - T8S - R1O2W, 6th P.M.
Sections 31, 32, 30, 29, 20, 21 - T7S - R102W, 6th P.M.
WHEREAS, pursuant to required public notice, the Board conducted a public hearing
on the 13th day of September, 1982, upon the question of whether the above described
special use permit should be granted or denied, at which hearing the public and
interested persons were given the opportunity to express their opinions regarding the
issuance of said special use pf rl•,hit ; and
WHEREAS, the Board on the basis of the evidence producted at the aforementioned
hearing, has made the following determinations of fact:
1. That proper publication and public notice was provided as required by law
for the hearing before the Board of County Commissioners.
2. That all hearings before the Board of County Commissioners were extensive and
complete, that all pertinent facts, matters, and issues were submitted and that all
interested parties were heard at that hearing.
3. That the proposed special use conforms to Section 5.03, concerning the
Approval of Disapproval of a Petition for a Special Use, of the Garfield County
Zoning Regulations.
4. That the proposed land use will be compatible with existing and permitted
1<>nd uses in all directions.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado,
that a special use permit be and hereby is authorized permitting the use of the above
described tract of land for a utility line; specifically, a 25 KV electric distribution
]ine, upon the following specific conditions:
1. That the use of the tract of land comply with all present and future regulations
o1 Garfield relating to a tit.11ity line in the zone district in which he property is now
of luay later be located;
2. All proposals of the applicant shah be considered conditions of approval unless
:;toted otherwise by the Board of County Commissioners.
3. The applicant shall submit an as -built legal description of the distribution
line to the Planning Department within 60 days of the project completion.
4. The applicant shall submit a copy of their BLM right-of-way agreement
to thu Planning Department prior to issuance of the Special Use Permit;
5. The applicant shall submit evidence of their legal right of entry to
private lands crossed by the electrical distribution line to the Planning De-
partment prior to issuance •of the Special Use Permit;
6. The applicant's compliance with the conditions of this resolution and
any special use permit issued pursuant hereto shall be monitored through the
Board's review thereof every six months during the period of construction in
accordance with the provisions of Section 9.03.05 of the Garfield County Zoning
Resolution.
7. The permit issued hereunder shall extend only to the location and operation
of a 25 KV electrical distribution line and the temporary staging areas.
8. The applicant must receive the Special Use Permit within one year of
the authorization to approve and issue the permit.
