Thls is in reference to an inspection by Corps of ftrgineers personnel of
our Grand Junction Regulatory Office, concernin$ the placement of d'redged-
material below the ord.inary high water elevation .and in wetlands adjaeent
to the Roaring Fork River near Carbondale, Garflefd County, Coloratlo-
You are hereby directecl to cease and d.esist from any further placement of
dred.ged. or fiII material into the wetl-and.s or belov the ordinary high
vater el-evation of the Roaring Fork River.
T1e Corps of Ergineers exereises regulatory jurisdiction on rivers, streams
a,6 wetlands under Section l+Ol+ of the Ct-ea3 Water Aet (33 USC 1344). The
Iaw requires that any individual or entity that proposes to discharge
clredged or fill material into wetland areas or'rwaters of the Unitecl States"
obtain a Department of the Army permit prior to the commencement of said
d.is charge.
The Cl-ean Water Act provides that every person who violates any provision
of 33 USC ]3l+l+ may b- punished by a fine of not l-ess than $Zr5OO.OO or more
than $25rOOO.OO per clay of violation, or by imprisonment for not more than
one year or both. The removal of any lI1egaI fill-s placed in violation of
the provision of said. section may be enforced by an injunction issued' by
the District Court exercising jurisdiction in the District in which sueh
fill exists and proper proceeding to this end may be instituted r:nder the
direction of the Attorney General- of the Uniteci States.
This office is conducting an lnvestigation of the unauthorized activity and,
as necessary, will solicit the views of appropriate Federal, State ancl focal
agencies. You may also be asked to provide additionaf information which this
office will- use in evafuating this unauthorized activity. Such information
will be used to d,etermine the appropriate administrative or legal- action to
be taken. Any information providect wil-l become part of the public recorcl
and may be presented. in any court action which may result from this
investigation.

Sadie Potter had owned Lot 10 (which is outlined inred) . She also owned a. small portion of Lot lIwhich is included in parcef OO-S lnow owned by CarIHenke) . she deeded Lot 10 to family memberg in L954.They in turn have deeded portions to one another.Through these documents we feer that Arthur s. potter
ended up with parcels 014 and 015 which he in turndeeded to you. Since the deed to you, which was rec-orded in Book 497 page 631 is so vigue we can't becertain of what the property is. To the best of ourknowledge and information you own 014 and 015 and theacreages are what we calculated.
A new survey would be needed to determine the correctboundary and acreages.

This is to update you on the progress of work on the 30,000 Galkin LDG
storage tank located at 7860 Hwy. BZ. This is as per your request at the
special meeting held in your office on March 24th.
All items of recommendation that I had org'ina1]y noted to you, in July of
1981, have been addressed and been completed to a degree of satisfaction in
my op'inion, w'ith the excePtion of:
#l the app'lied insulat'ion coating.
#Z a post-installatjon inspect'ion by the State Fuel Inspectors Office
As you know from our meet'ing on the 24th, Mr.Rich Paris assured me that
theie two items were agreeable to him and would be addressed immediately.
It was also agreed that the jnsulation need only be applied to one quarter
of the underside of the tank.
I would recommend to you that if the above two'items are not completed
within a time period acceptable to you, the operation not be allowed to
operate w'ithin the Carbondale and Rural Fire Protectjon District.
