Dear Mr. Bean,
I understand from Tom Smith, our County Attorney, that you and he
have discussed the question of the location of the Garfie'ld County -Pitkin County boundary as it relates to the processing and permittingof the Mountain Meadow subdivision. I would like to make you aware of
some efforts I have been making to resolve that issue and to invite
Garfield County to participate in finding a long-term solution.
Please find attached my letter of January 1B to John Rold, Directorof the Colorado Geological survey. Mr. Rold has reponded to my request
with a proposal to personal'ly research the original state statutes de-fining County boundaries and other relevant archival documents with the
objective of producing an authoritative 1ega1 descript'ion of the boun-
daries in question. Mr. Rold estimates that this work would take fromsix to ten hours of his time and would cost between $330.00 and $600.00($55.00/hour x 6/10 hours) as per the Geologica'l Survey's cash-fundedstatus. I bel'ieve that this project would be extreme'ly worthwhile, andthat its cost should be shared equally between the Counties benefiting,ie: Eag1e, Garfield, and Pitkin. At best, Mr. Rold's work could translateinto an authoritative and mutually acceptable map which could act as aneffective reference in resolving most future boundary disputes. At 1east,this basic research would define the extent of the problem and would point
the way to a permanent solution by lega'l or legislative means.
The money and manpower wasted by uncertainty such as that surrounding
the Mountain Meadows subdivision could become significant in the years
ahead, and I believe it is in the interests of all the parties to work
cooperatively towards a long-term solution. I believe that Mr. Rold's
proposal offers an excellent opportunity in this regard. Please let
me know as soon as possible if Garfield County concurs in this vieul and
how we should best proceed.

I am vrriting to ask for the assistance of the CGS in making an
authoritative d6termination of Pitkin County's northern boundary
line with Eagle and Garfield Counties. Although th'is boundary has
been surveyei in the Town of Basalt, it is'as far aS we can establish,
indef inite for the balance of its l ength. l'le have found those
sections of the Colorado Revised Statutes dealjng with County-
boundaries to be nonspecif"ic in reference to this boundary. i
encjose relevant excerpts from those Statutes for your information.
This issue has come up because of two pending developments_rrthose
Iocation in relation to the County Line (s) may be criticaj. These
are a subdivision which apparently straddles the Garfield-Pitkin
boundary, and the Ruedi Hydropowei proiect at Ruedi Dam, which may be
in either fagl e or Pitkin County depend'ing on the map be-ing used as
reference. ifre resolution of th'is issue has serious imp'l ications for
the land use and buiiding code requirements to be imposed on-these and
irtr.. developments. Uniertainty about the location of the iine also
may lead to future proPerty-tax inequities-
Previous inquiries to the now-defunct State Cartographer's Office o
this matter have not revea'leci an authoritative iarge-sca1e siate map
on which vre might base a finding on this matter. l'le are not sure
where the offiiial authority lies for making determinations of this
kind, but we hope that you will pass aiong this request to the appro-
priate agency if such responsibility does not lie with your agency.

I arn in receipt of your letter of January 30, 1984. With regard to the
two points ra,ised in that letter, I would first advise you that I have been in
contact with Robert Scarrow, the Garfield County Surveyor. I1r. Ken Wilson of
Schuueser & Associates is also in contact with Mr. Scarrow regarding the
location of the County 1ine. It is my understantiing that Mr. Scarrow has, in
fact, contacted the Pitkin County Surveyor regarding this location and that
the matter of the location of the county line will be resolved in accordance
with accepted surveying standards.
I wlsh to confirrn to you that Mrs. A11en understands that any sale,
conveyance or land use upon the property located ln Pitkin County will be
subject to the applicable requirements of the ?itkin County Land Use Code.
Under the developuent plan suggested, llrs. Allen has no present intention of
selling or otherririse conveying any of the property located in Pitkin County.
I do not understand your request that the limitations or further requirements
of Pitkin County Land Use Code should appear in any approvals granted by
Garfield County for the lands lying in Garfield County. I urould appreciate
your explanation on that point. Thank you for your attention to these
details.
