The following additional information 1s provided in conformance with
Section 4:60 A, B, C and G.
4:60 A: Common facilities to be shared by the subdlvision w111 be the
domesEd-Gter we11, piping system, certain lrrlgation water rlghts and the
access road to the various lots. The terms of the jolnt use of these facllities
will be sirnilar in form to the Well Water and Road Agreement prevlously entered
lnto by Mrs. Allen and the owners of the propertles constituting the two exempt
lots lylng north of the subdivislon. The form of the Well Water and Road
Agreement ls attached as an exhibit. Each purchaser of a lot w111 obtain an
undivlded one-sixteenth (Ll16) interest of all i.rrlgation, water and water
rights used ln connection with the property and subJect to the terms of the
agreement recorded ln Book 474 at Page 116 of the Garfield County records, a
copy of which is also attached. There will be no dedlcation of sites to the
publlc.

recoroed in Book 174 at page 116 of the Garfield County

VIHEREAS, first party has agreed that in connection with
the sale of said 2.027 acre parcel the secorri party shall
have and be entitled to one water tap frorn said well for a
single family residence to be constructed on said 2.027 acre
parcel; and
WHEREAS, the parties have further agreed on the use and
maintainance of the roaCway and irrigation S),stem serving
said 2.027 acre parcel;
I.lOw, THEREPORE, for and in consideration of the cove-
nants and agreements herein contained, the sufficiency of
which is hereby acknowLedged, the parties hereto oo hereby
aEree as follows:
1. First party hereby grants second parry the right to
connect one single family dwelling to the AlLen well and phe
right to a one-third share of the water produced from said
wel-1 upon the paylent of $1,000.00, the r:eceipt of which is
hereby acknowledged. Second party acknowledges that the
Al-1en well presently serves a single family owelling within
the above described 32.2I4 acre parcel ano that first party
reserves and retains the right to connect an additional
single f amily dwelling to the Allen we11. l'later produced by
Lhe Ailen well wiIl be useo for in house domr:.st ic use only
and not for irrigation, dgricultural or other purposes.
2. Second party further agrees to pay one-third (l/3)
of the cost of installing a storage tank, Pr€ssure PUmP,
metering system and associated equipment for the development

3. Second party shal-l not be reguired to shar-e in the

any repairs or maintenance relatinE to the ALlen well

4. A]1 costs and expenses incurreo in the connection to
the A11en well shalI be borne sole11, by second party. First
party shaLl be entitled to grant such other party the right
to connect to any existing Lines. rn the event a third party
is granted the right to connect to the Allen wefl, such third
party shall be charged, in aooition to aII other charges
made, a portion of the costs of such prerriousJ.y constructed
line as first party may determine is equitable based on the
relative use that will be made of such line. Such sums
collected shall be paid to the party of the second part.
5. A shut off valve for each water line connected to
the Allen weLl shal1 be installed at the point of connection
of each line serving an individual single family dwelling
with the main line. fn order to insure reasonably comparable
pressure to each user of the Al1en we11, it is agreed that
water lines of nonuniforrn dianreter may be required. A11
plans and specifj.cations for materials, installation, and
location of the water Iines shaLl be subjecL to the prior
approval of first party.
6. Second party shal-1 have an easernent for maintenance
and repair purposes five feet on eit.her side of the center
line of such installed water line from the boundary of second
partyrs property to the A1len well.

7. Second party sha1l pay one-third (1/3) of all costs
and expenses incurred in the repai.r and maintenance of the
roadwav constructed and now in use along the norlherly
bouncarv of the above referenced 32.214 acre tract.
8. AI 1 costs and expenses incurred in t,he 'ievelopr,ent
of an irri.gation system on the 2.027 acre par:ceI shall be
borne so1e1y by second party. A11 pJ.ans and specificaiions
for materials, installation and location of such irriqation
system shall be subject to the prior approval of the ritta
party. A shut off valve shal1 be installed at the point
where the irrigation system enters the 2.027 acre tract.
9. Second party further agrees to pay one-sixteenth
(1/16) of the operational expenses, electrical charges and
costs of repairs, maintenance, and imorovements of the
irrigation system serving the 32.214 acre parcel. Second
party' f urther agrees to al ternate h is usa-oe of irrigation
water with the owner of an adjacent 2.027 acre parcel, so as
to insure that adequate water pressure is available for each
user. In the event that a dispute arises between the parties
hereto as to the amount of water which is being used by
second party, first party shall have the right to require
second party to install a metering system approved by first
party at a location selected by first partlr which system
shaIl be purchased and installed at second party's sole cost
and expense.
.I0. In the event water produced from tire Al1en well is
f ound to be inadeguate f or in house clomr:st ic Purposes, then
the parties utilizing such water sha11 proportionally reduce
their consumption of same. In the event of such shortag€,
either party shal1 have the right to reguire that a metering
Si/Stem be installed for each user, the cost. of which shall be
Proportionately shared by the parties.

Frcm our review of the site and our Imowledge of the geology in the
area, it is our opinion Urat a 10 gtrm well can be develo@ within the
project. The existing rae]1 1ocated on r.ot g has been providing water
of acceptable quantity and quality for the 3 existing hornes on rot B
and the two djacent lots- rt is anticipated that the only treatrnent
required to bring the water frcrn the proposed werl into crcmpliance with
the colorado Departrnent of Health drinking water standards will be dis-
infection with chlorine.
The proposed well is to be located approximately 375' frcrn the existing
well serving the adjacent three housing r.:nits. Based on sorne prelimi-
nary calculations, the maximun area of influence of the new welr will
be in the 50t'7s' range, therefore it will not have any effect on the
existing r,v'e11. As a further on influence, it is proposed to use the
existing r'1e11 as a ncnitoring r^re1l during new rrel1 oonstruction to ver-
ify any influenee. A certification by a registered engineer will be
provided to the current users docunenting the nonitoring.
water supplied frorn the wel-l will be augrmenterl by water fron the Basart
water conservancy District, vfiich has a nrrnber of water rights, incrud-
ing a contractural right to receive storage water from Ruedi reservoir.
An application has been sutrnitted to the l^iater conservancy District for
a water arlotrnent crcntract for this suMivision. A capy of this appli_
cation is attached.
As previously stated, water for irrigation will be p,rovided by the

existing irrigation system on the site. rtris irrigation systen is sup_
plied by ttre East Mesa Ditch, vitrich uses the Crysta1 River as its
source' Ttre water righls associated with ttris ditch are for 3l.g cfs
with an appropriation date of oL/10/1gg4, naking it one of the nost
senior water rights on the crysta1 River. other water rights on the
crystal that are senior to the East Mesa Ditch only total 41.08 cfs, so
there strourd always be a reliable physical supply of water for irriga
tion p:rposes. since the Arrens have ovrned the pnoperty in 1975, there
has never been a call on their water.
Distribution System
since there is not a high enough erevation on the site to provide grav-
ity senrice at adequate pressures, a hldrotrxreunatic system is proposed.
This qlstem will onsist of a welr with a .r0 gtrn submersibre trmpr
chlorination, and a 250 gallon pressure tank. Tkre pressure tank wilr
be equip@ with automatic controls to operate on a pressure <rifferen-
tiar sufficient to insure a pressure of 40 psi aL the highest building
site' Ttre distribution system leading away frcrn the pressure tank wil-I
be a 3-inch main with service lines crrnstructed to the front prroperty
line of each lot. Fire storage will be provided by a ro,oo0 gallon
cistern located near the cul-de-sac. This cistern will incrude aute
matic mntrors to assure that it rernains full. A standpipe wilr be
connected into the cistern to a110w a BnnIEr truck access to the fire

Prince creek, a relatively sna1l stream tributary to the crystal River,
is southwest of the I'lcuntain rYeadows subdivision. prince creek has a
watershed area of approximately 10.5 sguare mi1es, vtrich vrculd ocntri-
bute to a 100-year peak flow of 240 cubic feet of water per second
(cfs') (Based on regression formulas provided by the colorado water
Conservation Board in their technical Manual No. 1 ). At its location
nearest the I'{cuntain }{eadows subdivision, prince creek is in a gultey
approximately 30 feet deep, so it is apparant that the subdivision is
entirely above the 100-year flood plain of the creek. TLre site is arso
well.above the flood plain of the Crystal River.

constructed along the southern boundary of the lr4cuntain Meadows site.
There is a snall existing berm in this general location that currently
serves the same Plrpose, but it is not adequate Lo crontain large f1ows.
The trroposed ditch has been designed to handle the 25-year tr,"ak f10w,
which is 21 cfs. This ditch wirr discharge into prince creek.
On-site Drairiage
calcurations for on-site drainage are based on the Rational Method,
assuning a 25-year, 10-minute duration storm intensity of 3.38 inchesper hour' The Rational Method is rnore applicable to snaller drainage
areas, ard it is nr:re readily r:sed to determine the increased runoff
caused by developnent. A copy of the engineering calculations for de-
termining on-site runoff are arso attached at the end of this report.
on-site drainage frqn r-ots 'l throrqh 4 will flow toward the northwest
and witl be intercepted by the access road borrow ditch and by Drainage
Ditch "B". Drainage Ditch '8" will .')nvey the runoff frqn the roadside
ditch to prince creek. This ditch will be relatively s,naIl, since itwill only have to oontain runoff frcrn a drainage area of approximately
8.5 acres. Ttre 25-year peak flow in this ditch will bre 7.4 cfs. ttrehistoric (b'efore develotrment) 25-year peak flow frqn this same drainage
area is 5-7 cfs. Detention of the on-site runoff is not proposed sincethe increase in runoff is minimal due to the lovr density of the
proposed develotrment.

The remainder of the subdivision (Lots 5 through B) wilr c.ontinue to
drain toward the rrorth, which has been the historic drainage pattern.
The increase in runoff due to develolment will be offset by the fact
that a trnrtion of the historic drainage area wirl be intercepted by the
access road, thereby reducing the Lotal area that will cr:ntribute run-
off north of the site. Therefore, the total anount of runoff that will
drain to the prroperty north of the site will not be increased due to
the proposed develolxnent.
