PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) as
amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975,
Section 1.02.17(d) and 3.02.01 and as amended on April 28, 1980,
WALTER A. STOWE and DELORES A. STOWE, by and through their attorneys,
Schenk & Kerst respectfully petition the Board of County Commissioners
of Garfield County, Colorado, to exempt by resolution the division
of a 2.04 acre tract of land into two (2) tracts, Parcel A to
contain .19 acres more or less, and Parcel B to contain 1.85
acres more or less, Parcel A is more particularly described as
follows:
A parcel of land situated in Government Lot 18 of
Section 1, Township 7 South, Range 89 West of the
Sixth Principal Meridian, Garfield County, Colorado,
more particularly described as follows:
Beginning at a point whence an iron post with a brass
cap set in place and properly marked for the Southeast
Corner of Government Lot 36 in said Section 1 hears

112.03 feet; thence S.02°13'00" W. 35.74 feet; thence

and to further exempt said division from the definitions of
"subdivision" and "subdivided land" as the terms are used and
defined in C.R.S. (1973) Section 30 -28 -101(a) -(d) and the Garfield
County Subdivision Regulations, for the reasons stated below:
The subdivided parcel will be conveyed to the property
owners' son, Walter Stowe.
In support of this petition, the petitioner also submits the

It is the ruling of the Referee that the statements in the

*CONDITIONS:
1. All installation must comply with all requirements of the County Individual Sewage Disposal Regulations, adopted pursuant to au-
thority granted in 66-44-4, CRS 1963, amended 66-3-14, CRS 1963.
2. This permit is valid only for connection to structures which have fully complied with County Zoning and building requirements.
Connection to or use with any dwelling or structures not approved by the building and Zoning office shall automatically be a viola-
tion of a requirement of the permit and cause for both legal action and revocation of the permit.
3. Section III, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal system in a manner which in-
volves a knowing and material variation from the terms or specifications contained in the application of permit commits a Class I,
Petty Offense (S500.00 fine — 6 months in jail or both.
