(1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned H. W. Storey respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division of 24.8 acre tract of land into 4 tracts of approximately (see Attachment D) acres each, more or less, and which tract to be subdivided is more particularly described as follows: (legal description - attach separate sheet if additional space is required) See Attachment A from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. The parcels contain the following approximate acreages: Parcel 1: 5.6 acres Parcel 2: 9.3 acres Parcel 3: 5.2 acres Parcel 4: 3.7 acres There are no site conditions contrary to the intent of the subdivision regulations. A. Adequate building sites exist on each parcel. B. Individual wells will be located on each parcel. C. Septic tank/leach field disposal systems will be used unless percolation tests indicate that evaporation - transpiration systems are required. D. Floodplain information is not currently available regarding the property. The property is located on a terrace bed level with Colorado Highway 82 and, according to USGS mapping and on-site observation, is more than 15' above the Roaring Fork River. E. The developer proposes to use wells for the water supply which would intercept ground water tributary to the Roaring Fork River at a point where there is still water available for appropriation.
