when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 81-295
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY EVELYN MCKAY.
WHEREAS, the Board of County Colimlissioners of Garfield County has received an application
from Evelyn McKay for a special use permit for industrial support facilities, as specified in
previous Resolution #81-207, with the addition of a portable concrete batch plant and storage
building on the following described tract of land:
A tract of land situate in the SW4SW4j Section 1, Township 7 South, Range 96 West,
6th P.M., being more particularly described as follows:
Commencing at the SW corner of said Section 1, from which a witness corner (an iron post
with brass cap) bears N88°21'31"W 220.00 feet; with all bearings contained herein
being Colorado Grid Bearings (Central Zone). True bearings are abtained by rotating
all bearings herein counter clock -wise Ol°37'28"; thence along the westerly section
line of said Section 1 N06°29'20"E 1336.05 feet to the NW corner of said SW%SW; thence
S50°26'52"E 580.83 feet to the true point of beginning; thence S50°26'52"E 429.28 feet;
thence S39°37'28"W 355.22 feet to the northeasterly right-of-way line of County Road
No. 215; thence along said county road right-of-way line N48°00'00"W 336.44 feet;
thence along said county road right-of-way line along a spiral curve to the right, the
chord of which bears N45°38'35"W 93.55 feet; thence N39°37'28"E 333.01 feet to the
true point of beginning, containing 3.41 acres, more or less.
Together with and subject to an easement for ingress and egress over and across a
tract of land being more particularly described as follows:
Beginning at a point whence said NW corner of the SW1�,SW4 of Section 1 bears N50°26'52"W
520.83 feet; thence 251.40 feet along the arc of a 60.00 foot radius curve to the right,
having a central angle of 240°04'20" and subtending a chord bearing S20°24'44"E 103.89
feet; thence S39°37'28"W 283.54 feet to the northeasterly right-of-way line of County
Road No. 215, thence along said county road right-of-way line along a spiral curve to
the right, the chord of which bears N45°38'35"W 60.21 feet; thence N39°37'28"E 278.57
feet; thence 62.76 feet along the arc of a 60.00 foot radius curve to the right, having
a central angle of 59°55'40" and subtending a clrord bearing N09°35'18"E 59.94 feet to
the point of beginning.
WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the
14th day of September, 1981, upon the question of whether the above described special use
permit should be granted or denied, at which hearing the public and interested persons were
given the opportunity to express their opinions regarding the issuance of said special use
permit; and
WHEREAS, the Board on the basis of the evidence produced at the aforementioned hearing,
has made the following determinations of fact:
1. The proposed use is compatible with he uses existing and permitted in the district in
which it is to be located, provided that certain hereinafter contained conditions be complied
with.
2. That neither the impact on traffic volume and safety or on utilities, or any other
impact of the special use will be injurious to the established neighborhood or zone district
in which the special use is to be located.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado, that a
special use permit be and hereby is authorized permitting the use of the above described tract
of land for industrial support facilities, upon the following specific conditions:
1. That the use of the tract of land comply with all present and future regulations of
Garfield relating to industrial support facilities in the zone district in which the property
is now or may later be located;
2. That, prior to the issuance of the authorized special use permit, the above described
tract of land shall be severed from any other tract of land upon which there may exist a prin-
cipal use, unless such other such principal use has been terminated at the time of the issuance
of the special use permit; and further

3. That the Planning Department Staff receive adequate evidence of public
notice in the form of a Proof of Publication and certified return mail
receipts from adjoining property owners prior to issuance of the Special
Use Permit.
