HomeMy WebLinkAbout5.0 Resolution 2008-631111 11111 1 Reception#: 747979 06/06/2008 02:04:44 PM Jean Rlberico 1 of 3 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 14th day of January, 2008 there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi Houpt , Commissioner Don DeFord , County Attorney Jean Albirco , Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2008-63 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT TO ALLOW AN INDUSTRIAL SUPPORT FACILITY INCLUDING WAREHOUSE/STAGING FACILITY ON A PROPERTY LOCA I'ED ON OWNED BY HARRY AND RHONDA NAUGLE (PARCEL NO. 217325100022) WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received a Special Use Permit (SUP) request to allow an "Industrial Support Facility Including Warehouse and Staging Facilities"; and WHEREAS, the subject property contains approximately 36.336 acres, is located in Section 25 in Township 6 South, Range 95 West of the 6th PM and is practically located at the Interstate 70 Rulison Interchange in the Resource Lands: Gentle Slope Lower Valley Floor zone district; and WHEREAS, the Board of County Commissioners opened a public hearing on the 14th day of January, 2008 upon the question of whether the above-described SUP should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said SUP; and WHEREAS, the Board of County Commissioners closed the public hearing on the 14th day of January, 2008 to make a final decision; and 1I11 ri. 1'iWhilINI AIlf i ALIO . ' 11111 • Reception#: 747979 05/06/2006 02:04:44 PM Jean Alberico 2 of 3 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO WHEREAS, the Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: 1. That proper public notice was provided as required for the hearing before the Planning Commission. 2. That the hearing before the Board of County Commissioners was extensive and complete and that all interested parties were heard at that meeting and that all pertinent facts, matters and issues were submitted at the meeting. 3. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on determination of facts set forth above, the SUP request to allow an "Industrial Support Facility Including Warehouse/Staging Facilities" is approved with the following conditions: (1) That all representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless explicitly altered by the Board; (2) That the operation of the facility be done in accordance with all applicable federal, state, and local regulations governing the operation of this type of facility; (3) That all proper building permits are obtained for the structures associated with the operation of the Industrial Support Facility; (4) The Proposed Industrial Support Facility shall be constructed and operated as represented in Exhibit F, a letter and attachments from Ron Liston, Land Design Partnership, dated August 24th, 2007; (5) The Applicant shall provide a current State Highway Access Permit allowing for the proposed use or a letter from Colorado Department of Transportation stating an access permit is not required prior to the issuance of the Special Use Permit; (6) The Applicant shall provide a Reclamation Security in the amount of $18,000 prior to the issuance of the Special Use Permit; (7) The Applicant shall provide a copy of the Stormwater Management Plan for County records. ■III !i�'i t�i�II �MHI� �Ih ,,I�YG�1�1+�4' Iwr! l'�.��� 11111 Reception#: 747979 05/06/2008 02:04:44 PM Jean Alberico 3 of 3 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO Dated this 643' day of YVI:cn , A.D. 2008.
