As we informed you at the meeting, the economics of the application now look very unfavorable, and we intend to concentrate our efforts and resources toward developing a major underground hydraulic coal mine on our leased site. Storm King's $500.100 check, which was deposited on February 8, will therefore not be refunded. Gray President Storm King Mines, Inc. 5335 West 48th Avenue Denver, Colorado 80212 Dear Mr. Gray: The Division has reviewed Storm King's application to conduct exploration in Garfield County. The application proposes the removal of more than 250 tons of coal. As such, the Division must review the application in accordance with Rule 2.02.4 of the coal regulations. The Division's initial review (2.02.4(1)) must determine if the proposed activity qualifies as coal exploration or surface coal mining operations. In this, case as part of the application, Storm King was advised by the Division to provide documentation substantiating the need to remove 18,000 tons of coal for test -burn purposes. Presumably such demonstration would, at least partially qualify the proposed activity as "coal exploration". Documentation, considered confidential by Storm King, was submitted with the application to satisfy this requirement. Upon review, the Division has found that this documentation does not adequately demonstrate the need to remove 18,000 tons of coal for test - burn purposes. Therefore, the Division can not find the proposed activity to qualify as coal exploration. The proposed operations are therefore considered surface coal mining operations and the application must be returned to Storm King. This letter constitutes the written determination required by 2.02.4(1) and the application is available for Storm King to pick-up at this office. 423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. To do so, a written request must be made so that the appeal can be placed on an agenda for the Board's regular monthly, meeting. If should be noted that the effect this determination is to prohibit the conduct of any activities described in Storm King's application until a valid written approval is obtained from the Board or Division. In the past month, we have also accruired a ne- = coal lease of 4000 acres immediately east of State Highw•ny 13 erne 709, just south of Meeker, Colorado in Rio Blanco County. This new lease is also in the Grand Hogback (we have no maps =available to senc' you as yct) . For the next two or three years, we will ha undertaking the exploration only of this lease, employing five to ten people wino would live in Meeker or Rifle. We feel this coal mining property has the potential of producing 700,000 -- 800,00 tons of coal per year., with production beginning aonrorim71tely 1983 Lpd utilizing 75 to 85 emp lovees who would also reside in .t the same two communities. The information was developed by Storm King and its consultants to provide information required for an exploration permit from the Colorado Division of Mined Land Reclamation, and for a Garfield County Special Use Permit. Every effort has been made to provide a clear, factual description of exploration activities and their probable environmental, social, and economic impacts. The coal to be extracted under this permit for test burning is an important element of Storm King Mines' exploration program. The results of these test burns significantly influence the economic feasibility of the entire Storm King project. It is very important to Storm King that this submittal and the accompany- ing application for a Garfield County Special Use Permit receive timely consideration and approval. With that consideration in mind, Storm King remains at your disposal to attend an on-site inspection visit at your earliest convenience and to provide any additional information you may require.
