satank with the understanding we would be living in a single family zone' we believe
that a change to allow duplexes would significantly and adversely affect our property
values, and the enioyment ofour home'
While we understand lhat there are many technical consideratior6 to rne made in a
Special Use permit, some of which we wilt try to address, we have four overriding
concems. First, that an app.oval of these dupiex rental apartme.nts would set a precedent'

My name is Kevin Cyr. My wife Barbara and I live at 0160 Pine St" in the town of
Cooperton. We have lived here since 1978. I have raised my family and have enjoyed
living in this quite neighborhood for several years.
I am writing this letter to plead that you do not grant the special use permit tbat
Mr. IefflVadley is requesting. I fiod it interesting that a perEor rvio calls himself a
general corrtractor and "constructionalist" is applying for a special use p,ennit, years after
Ihese buildings have been erected (under questionable circumstances). Hopefirlly, this is
not a practic€-in Garfield County Commissioners to issue special use permits after the
fact. f hopethere is not a presideot setting eve!fi. From my perspective it seems like Mr.
Wadley wants to legalize his commercial duplexes that he has already built and is
orrently, by all indications, renting.
These actions creote a tremendous sfiain on the limited resources in the towr site
of Cooperton. As you well know we have tro sewer service in our community. Therefore,
we rely on septic iystems to dispose of household waste. Several of us bave underground
wells io zuppty us wder. With the passiag ofthe variarts it would potentially allow more
ground wder pollution to the wells.

trecessary to come to the Commissioners and ask for the special perrrits before he built

the addition of more vehicles using 106 road not as a thoroughfare but as a parking lot.

I am writing to you as I will be unable to attend the public hearing on I August 2005.
The two parcels in question sounds as if Mr. Wadley is going to build two buildings
to be used as duplex units, which in fact have already been built with the intent to be used
as duplex units and have been rented alread-v in the past.
I have two main concerns in this matter. First is the water for the units in question.
Our by laws for Coopertown, state that there will be one water tap per single family home,
and these units were clearly built as duplex homes.
My other concern is Mr Wadleys parking for said parcels. At the present time there
is barley room to park two vehicles for said units.
I sincerly hope that you as Commissioners will take the time to look very carefully
ingthis r4ue.st before making a final ruling on this request.

Dear Commissioners:
Since the August 1't hearing on the referenced Application, the Board of Directorsof the Satank Water Association ("Association") has careflrlly reviewed our
organizational documents and oru agreements with the Town of Carbcrndale in order to
determine the Association's ability to provide water to multiple family dwellings.
As background, prior to 1993, there was an agreement between the Town of
Carbondale and an informal organization known as the West Carbondale Water Users, b1,
which the Town provided water to some of the residents of Satank. In August, 1993, the
Satank Water Association was formed as a Colorado corporation for the primary purpose
of obtaining the funding to construct a new 8-inch water main (the "Association's Line")
between Carbon.lale's water delivery system and Satank. At the same time, the pre-
existing water agreement with the Town was amended so that the Association would
replace the old, unincorporated West Carbondale Water Users as the entity that would be
responsible to the Town for the payment of water service fees and the administration of
water delivered from the Town's system, through the Association's Line, and then to
homes in Satank.
Under our agreement with the Town, as amended, the amount of water that the
Town will deliver to the Association's Line is limited to fifty-one (51) water taps. Under
the Association's organizational documents, in order to receive water from the
Association's Line, a property owner has to be a member of the Association. Each
member of the Association must sign a written subscription agreement which says that
each member agrees '1o be bound by such rules and regulations of the corporation as now
exists or may be adopted in the future." Mr. Wadley is a member of the Association and

has signed the Association's Subscription Agreement.
The Association's Rules and Regulations clearly state: "Each standard size tap
shall provide water to no more than one (1) single family dwelling unit." Under these
documents, the Board of Directors of the Association has concluded that the Association
is not authorized to provide water to anything other than single family dwelling units.
For that reason, the Association cannot commit to provide legal water service to the
structures located at I 16l and 1151 County Road 106 if they are converted to two family
dwellings.

This letter was in response to SWA letter dated September 21,2005, enclosed, which did
not address completiy the issues discussed at the BOCC Hearing of August 1" 2005.
Please Refer to Exhibit N, SWA Rules and Regulation, VI- Fees, Charges and
Assessments, paragraph2,"Any dwelling unit containing two (2) or more perrnanent
kitchens shall be billed (1) water service fee for each such kitchen." I have paid for two
water services per each house since day one under the direction of a previous SWA
board.
Please find enclosed a Town of Carbondale Utilities letter dated August 9,2005 which
clarifies the number of taps I have at these locations.
The front yard set back issue has been clarified and resolved with Ron Van Meter of your
office. Both buildings were correctly placed on the sites.
I believe I have addressed all of the County's issues.
Now I will get legal counsel to put some clarity on the issue with the SWA.

The applicant requests the Board of County Commissioners grant a Special Use permit (SUp) for(2) Two Farnily Dwelling Units (Duplexis) in the Salank area of CarUonaae. In this case, theapplicant owns the two abutting lots. one duplex is proposed for each property. Each requestedduplex is considered a separate application. goth applications will be addressed in this staffreport.The Board of county commissioners will need io make two separate motions for approval ordenial' The duplexes are in a two story single building providing one unit on the bottom level andone rrnit on the top.

family homes' The applicant claims there was some misunderstanding on the process ofconverting these two homes into drrplexes. The applicant was made aware ofthe process and isnow appearing before the Board t9 bring the duplexes into compliance. The requestedduplexes, currently in use, are a zoning vio'iation.
The two single family homes were issued certificates of occupancy as single family homes.Since that time, the applicant has retrofitted the homes with additional kitchens, walls, separateentrances, etc', converting them into duplexes. The construction converting the units was notdone under the supervision of the Building Departrrent through the permit process and as aresult is a vioration of the 2003 Intemational Building code.
II. APPLICABLE REGULATIONS
A' special use Permits are zubject to the standards set forth in $ 5.03 of the zontngResolution.This section states that utilities adequate to provide *uto and sanitation service, skeetimprovementl,^and design ofthe proposed use to minim rzeimpactthroughvarious means shallbe provided iffound necessary.
B' Zoning Resolutio-n: A Two-Family Dwelling Unit is a special use in the RLUD zone districtpursuant to $3'04'03 of the ZonngResolution of lgTs,as amended. The application mustaddress the general SfIP review requirements in $5.03, as well as the specific standards thatapply to duplexes-cg.ntalned throughout the county zomngResolution. These standards arelisted below in bold italics fonowed by Staffcomments.

Dear Mr. Wadley,
Thank you for the information provided to this office on April 25,2005 regarding the
water issue for the proposed two-family dwellings. It is evident upon review of the
information submiuei in a letter from thi Satank Water Association that the Association
will not provide two (2) water taps per property based on membership rules. Further, the
Town of Carbondale piovided aleu"r whiih only affirms that while the Town provides
water to Satank, the Satank Water Association administers how that water is distributed
through Satank and not the Town.
Based on this, it is evident that you cannot presently demonstrate that each unit in the
proposed two-family dwellings can obtain legal physical and legal water from the Satank
Water Association. As a reJult, this offrce cannot deem your application technically
complete.
Therefore, the purpose of this letter is to place you on notice that unless you can
demonstrate that you can obtain adequate legal and physical water by May 27,2005, the
matter shalt be referred back to the Zoning Compliance Officer who will refer to matter
to the Board of County Commissioners to determine if legal action is necessary to have
the zoning violation corrected.
Again, once you have adequately addressed this issue as well as the issues noted in my
privious letter dated March 4,}d}s,this office will resume review of the application. Do
not hesitate to contact this office should you have any questions.

The Satank Water Association's Board of Directors met on April 13, 2005. We discussed your request to allow
you to use each of your existing water taps to serve 2 separate dwelling units. We concluded that this is
prohibited by our i.ules and Regulations. Section IV - STANDARDS OF INSTALLATION includes the
iollowing paragraph: ..5. A standard size water tap shall be3/o rnches or less. Each standard size tap shall
provide water to no more than one single family dwelling unit."
We went on to discuss the possibility that the Association may be able to get permission from the Town of
Carbondale to sell you additional taps. (This would require a payment to the Association of $2000 for each tap,
plus additional tapiees to the Town. It would also require you to extend additional %" seryice lines from the
water main to the house, so this would be an expensive option.) It appears that this is also not possible, because
of the following language in Article V of the Aisociation's Articles of Incorporation: "To be eligible for
membership a person or entity must be a record owner of... any parcel or tract of real property which is located
in... Satank... Each parcel or tract of land so eligible is entitled to one and only one membership in the

tV . STANDARDS OF INSTALLATION
The following standards shall apply to all taps onto the Association's Water Delivery
System:
1. No tap shall be made or service line installed between November 1 and April
1 of any year due to frozen ground'

experienced, competent contractor, appio:"g by th; Association' The Member causing a
tap to be made onto the Dstrict's Water Delivery System shall be responsible for any and
all damages which may result therefrom. Prior toierforming any.excavation work involving
the Association's Wui", Delivery System, or any tap or ttti"" iin" toontcted thereto' the
person performing such excavation shall call foi all jine locations as required by applicable
state law.
3. All taps and new service lines shall be inspected !Y a.qualified Association
Board Member or Uy a qualified Carbondale Water Department Employee upon forty-eight
(a8) hours request.
4. New service lines shall be installed at a depth of at least 6 feet to avoid
freezing.
5. A standard size water tap shall be

Dear Mr. Wadley,
Thank you for the application materials received by this offrce on February 28, 2005.
Upon initial review, the application has been deemed technically incomplete for the
reasons stated below. In addition, while you are the owner of both Lots B and C of Block
7, each separate property requires a stand alone application to be submitted to this office
along with separate filing fees of $400.00 for each application. As mentioned, please
address the following additional points below. Once you have adequately addressed these
issues, this office will resume review of the application.
1. Please provide o site plon that clearly delineates landscaping and oarking spaces for
each property. Note that Section 5.01.02(t) of the Zoning Resolution of 1978, as
amended requires that I parking space be required per every 600 square feet offloor
areo in a dwelling unit or I space per dwelling unit whichever is greater. Please
show the provided parking spaces that satisfy this requirement on a scaled site plan,
2. While the application indicates the units have water service provided by the Town of
Carbondale, no proof of this water supply was submitted. Please provide proof fromthe Town of Carbondale that you have legal water service for alt four proposed
dwelling units. This is commonly in the form of a letter from the Town indicating they
are providing water to the four units.
3. Submit a copy of the appropriate portion of a Garfield County Assessor's Map
showing all mineral rights owners of the subject property ond public and private
landowners adjacent to your property (which should be delineated). This information
can be obtainedfrom the Assessor's Office.

4. As mentioned earlier, each property should have its own SUP application which
includes a separate fee of $400.00 fir each application. Please provide this ffice with
an additionil $400.00 Base Fee with a new application to cover the second property
atong iitll a second application with a signed "Agreement for Payment" form'

The Nature and Character of this
Special use request
My residence of 1161 Co. Rd 106 and my other house at 1151 Co. Rd 106 are zoned
R/LruD which by Special Use Permit two family residents units.
I first must apolo gize as I have the cart ahead of the horse, so to speak, as I have two
family units in each one of these houses now. I admitted this to county officials with the
intent to correct. Therefore I am before you in hopes ofbeing granted a special use for
two family residents in each of these houses. This request is not in response to any
complaint but rather my desire to be compliant.
This was by necessity in many respects that I placed a second family in these units. I
initially, was trying to supplement housing for Firefighters and Emergency Medical
Technicians for the Carbondale & Rural Fire Protection District's need to have people in
a reduced response time distance to their primary f,tre house.
It realistically is the only way I and my family could possible afford to stay in this area.
I have provided much needed housing to much needed persons in our community such as
teachers, fireman and EMT's, as well many others, in an affordable manner for them as
well.
My up most concern has been to respect the integrity of the neighborhood and to
maintain the enjoyment of our setting, by minimizing the impact to the neighborhood.
I have always responded immediately to any concern expressed to me by a neighbor. I
have always worked very hard to resolve the concerns to their satisfaction, pertaining to a
second families presents in these homes.
I have tied to meet or excided the life safety issues relative to two family dwellings.

To Garfield County Commissioners:
I am writing this letter as a concerned resident of Satanlq not as a member of the Satank
Water Association.
several years ago a group of students contacted me. They were signed up for summer
classes and could not afford housing in the valley. They wanted to camp in my field for
several weeks' I agreed, and once we had a portable outhouse in place, they set up their
tents and got on with their studies.
A neighbor or neighbors turned me in to Garfield county and I immediately received a.
letter from the county threatening me with hefty fines or even time in prison if I did not
get rid of the students. The students departed.
Meanwhile three buildings were constructed at u5r, u6r and, rrTrcounty Road 106 in
Satank' All three buildings were permitted as single-family residences but became murti-
unit buildings' These illegal buildings have been described as..doubles,, but recentry I,ve
been informed that at least one (maybe all three) is in fact a three-unit structure.
Mr' wadley's neighbors were apparently more patient and torerant than mine. To their
regret they did not turn him in' once Garfield county became aware of these viorations
no action was taken for some time. when the county did eventuaily notify Mr. wadrey
that he was breaking the rules, his response was that the problem was his neighbors had
failed to report him to the county when they first realized he was operating ilegar
buildings' These neighbors are volunteers helping to manage a water line in Satank. They

are not "professionar water nazis,, and I\4r. wadrey was counting on them to beaccomrnodating neighbors and not to cause trouble.
:Recently 141" wadley informed the neighbors who are vorunteering with the Satankwater Association that he is prepared to sue to force them to suppry water to his,regaloperations' using i\,r' wadley's line of reasoning the satank water Association courdblame Garfield county for not informing the association when it first knew of theinfractions' Tfus is' of coursq ridiculous. It is neither Garfierd county nor Satank waterAssociatio* which is responsibre for M.. wadrey,s predicament_ it,s l\ft. wadrey.Garfield county can put an end to this whole sordid mess by making it crear thatMr.wadley is subject to the rules of the county (iust as I am and a, the other residents of thecounty are) and so he must make his three buirdings conform to the permits issued forbuilding them: single_family residences.
