As background, prior to 1993, there was an agreement between the Town of Carbondale and an informal organization known as the West Carbondale Water Users, b1, which the Town provided water to some of the residents of Satank. In August, 1993, the Satank Water Association was formed as a Colorado corporation for the primary purpose of obtaining the funding to construct a new 8-inch water main (the "Association's Line") between Carbon.lale's water delivery system and Satank. At the same time, the pre- existing water agreement with the Town was amended so that the Association would replace the old, unincorporated West Carbondale Water Users as the entity that would be responsible to the Town for the payment of water service fees and the administration of water delivered from the Town's system, through the Association's Line, and then to homes in Satank. Under our agreement with the Town, as amended, the amount of water that the Town will deliver to the Association's Line is limited to fifty-one (51) water taps. Under the Association's organizational documents, in order to receive water from the Association's Line, a property owner has to be a member of the Association. Each member of the Association must sign a written subscription agreement which says that each member agrees '1o be bound by such rules and regulations of the corporation as now exists or may be adopted in the future." Mr. Wadley is a member of the Association and EXHIBIT has signed the Association's Subscription Agreement. The Association's Rules and Regulations clearly state: "Each standard size tap shall provide water to no more than one (1) single family dwelling unit." Under these documents, the Board of Directors of the Association has concluded that the Association is not authorized to provide water to anything other than single family dwelling units. For that reason, the Association cannot commit to provide legal water service to the structures located at I 16l and 1151 County Road 106 if they are converted to two family dwellings. Rd 106 and my other house at 1151 Co. Rd 106 are zoned R/LruD which by Special Use Permit two family residents units. I first must apolo gize as I have the cart ahead of the horse, so to speak, as I have two family units in each one of these houses now. I admitted this to county officials with the intent to correct. Therefore I am before you in hopes ofbeing granted a special use for two family residents in each of these houses. This request is not in response to any complaint but rather my desire to be compliant. This was by necessity in many respects that I placed a second family in these units. I initially, was trying to supplement housing for Firefighters and Emergency Medical Technicians for the Carbondale & Rural Fire Protection District's need to have people in a reduced response time distance to their primary f,tre house. It realistically is the only way I and my family could possible afford to stay in this area. I have provided much needed housing to much needed persons in our community such as teachers, fireman and EMT's, as well many others, in an affordable manner for them as well. My up most concern has been to respect the integrity of the neighborhood and to maintain the enjoyment of our setting, by minimizing the impact to the neighborhood. I have always responded immediately to any concern expressed to me by a neighbor. I have always worked very hard to resolve the concerns to their satisfaction, pertaining to a second families presents in these homes. They were signed up for summer classes and could not afford housing in the valley. They wanted to camp in my field for several weeks' I agreed, and once we had a portable outhouse in place, they set up their tents and got on with their studies. A neighbor or neighbors turned me in to Garfield county and I immediately received a. letter from the county threatening me with hefty fines or even time in prison if I did not get rid of the students. The students departed. Meanwhile three buildings were constructed at u5r, u6r and, rrTrcounty Road 106 in Satank' All three buildings were permitted as single-family residences but became murti- unit buildings' These illegal buildings have been described as..doubles,, but recentry I,ve been informed that at least one (maybe all three) is in fact a three-unit structure. Mr' wadley's neighbors were apparently more patient and torerant than mine. To their regret they did not turn him in' once Garfield county became aware of these viorations no action was taken for some time. when the county did eventuaily notify Mr. wadrey that he was breaking the rules, his response was that the problem was his neighbors had failed to report him to the county when they first realized he was operating ilegar buildings' These neighbors are volunteers helping to manage a water line in Satank. They EXHIBIT E are not "professionar water nazis,, and I\4r. wadrey was counting on them to beaccomrnodating neighbors and not to cause trouble. :Recently 141" wadley informed the neighbors who are vorunteering with the Satankwater Association that he is prepared to sue to force them to suppry water to his,regaloperations' using i\,r' wadley's line of reasoning the satank water Association courdblame Garfield county for not informing the association when it first knew of theinfractions' Tfus is' of coursq ridiculous.
