At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on Monday , the 9th day of August A.D. 19 99 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 99-081
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION LARRY & VIRGINIA SCHMUESER TO ALLOW TIMBER HARVEST
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has
received application from Larry & Virginia Schmueser for a Special Use Permit to allow for
Timber Harvest the site identified in the application:
WHEREAS, the Board held a public hearing on the 7"' day of June 1999, upon the
question of whether the above-described Special Use Permit should be granted or denied, at
which hearing the public and interested persons were given the opportunity to express their
opinions regarding the issuance of said Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:

1. That proper publication and public notice was provided as required by law for the
hearing before the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing.
3. That the application is in compliance with the Garfield County Zoning Resolution
of 1978, as amended.
4. For the above stated and other reasons, the proposed special use is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of
the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow
Timber Harvest in the manner indicated and at the site(s) and route(s) as identified in the
application, upon the following specific conditions:
1. That all representations of the applicant, either within the application or stated at
the hearing before the Planning Commission, shall be considered conditions of
approval.
2. The Special Use Permit shall be issued when all conditions are met, and shall
expire on August 1, 2000.
3. All activity shall be in compliance with the application as submitted.
4. Prior to mobilization and/or cutting, the applicant shall obtain approval of all
proposed crossings of County Roads from the Garfield County Road and Bridge
Department including appropriate notification of the public as may be necessary
for road closures or other activities as required.
5. Prior to mobilization and/or construction, the applicant or the applicant's
contractor(s) shall obtain overweight vehicle permits (if applicable) from the
Garfield County Road and Bridge Department.
6. The existing road bond shall remain in place with the Road and Bridge
Department to be used for the repair of CR 312, from possible damage caused by
the logging activity. The bond shall remain valid for the period of logging activity,
and any subsequent use of the county road for a period of 30 days following
closure of the principal logging activity.

7. The haul route for the timber and overweight vehicles must be approved by the
County Road and Bridge supervisor prior to commencing activities.
8. All revegetation shall be done using a weed free seed mix.
�. The applicant shall follow the Best Management Practices, as indicated by the
Colorado Forest Stewardship Guidelines for all logging, restoration and road
building activities.
10. The applicant shall buy permits to haul at 80,000 pounds.
1 I . The applicant shall inventory the existing condition of the affected County Road.
12. With the first signs of damage, the hauling weights shall be reduced to 70,000
pounds, and the applicant shall pay for all repairs required. The work shall be
undertaken by a qualified contractor as negotiated by the applicant with the
County's approval as to scope of work and type of repairs. The paved portions of
the road shall be re -paved with a three (3) inch hot -mix asphalt and appropriate
sub -grade materials. Repairs to the affected County Roads shall be made within ten
(10) days calendar days following notification by the County.
13. Truck speeds shall be posted by the applicant to the satisfaction of the County and
all trucks shall pull over to allow two (2) or more smaller vehicles to pass.
14. The applicant shall provide dust retardant measures at the direction of the Road
and Bridge Department.
15. The applicant shall provide signage along the County Road at the direction of the
Road and Bridge Department.
