The following items are required by Garfield County for a final inspection:
3. A final Electrical Inspection from the Colorado State Electrical Inspector;
2. Permanent address assigned by Garfield County Building Department posted where readily
visible from access road;
3. A finished roof. a lockable house, complete exterior siding, exterior doors and windows
installed, a complete kitchen with cabinets. a sink with hot & cold running water, non-absorbent
kitchen floor coverings, counter tops and finished walls. ready for stove and refrigerator, all
necessary plumbing;
4. All bathrooms must be complete, with washbowl, tub or shower, toilet stool, hot and cold
running water, non-absorbent floors and walls finished and a privacy door;
S. All steps outside or inside over three (3) steps must have handrails, guard rails on balconies or
decks over 30' high constructed to all IBC and IRC requirements;
6. Outside grading done to where water will detour away from the building;
7. Exceptions to the outside steps, decks and grading may be made upon the demonstration of
extenuating circumstances, i.e. weather, but a Certificate of Occupancy will not he issued until
all the required items are completed and a final inspection made;
8. A final inspection sign off by the Garfield County Road & Bridge Department for driveway
installation, where applicable; as well as any final sign off by the Fire District, anchor State
Agencies where applicable.
A CERTIFICATE OF OCCUPANCY WILL NOT BE ISSUED UNTIL ALL THE
ABOVE ITEMS HAVE BEEN COMPLETED.
****CANNOT OCCUPY OR USE DWELLING UNTIL A CERTIFICATE OF OCCUPANCY
(CD.) IS ISSUED. OCCUPANCY OR USE OF DWELLING WITHOUT A C.D. WILL BE
CONSIDERED AN ILLEGAL OCCUPANCY AND MAY BE GROUNDS FOR VACATING

I . Is a site plan included that identifies the location of the proposed structure or addition and distances to
the property lines from each corner of the proposed structure prepared by a licensed surveyor and has
the surveyors signature and professional stamp on the drawing? Properties with slopes of 30% or more
must be shown on site plan. (NOTE Section 1061) Any site plan for the placement of any portion of
a structure within 50 ft. of a property line and not within a previously surveyed building envelope on a
subdivision final plat shall be prepared by a licensed surveyor and have the surveyor's signature and
professional stamp on the drawing. Any structure to be built within a building envelope of a lot
shown on a recorded subdivision plat shall include a copy of the building envelope as it is shown on
the final plat with the proposed structure located within the envelope.

County, Colorado, for approval of a Rural Lands Development Option application for the division of
a 105 -acre tract into a total of six (6) lots more practically described as follows and contained in
Exhibit A attached hereto;
Lot 1: 3.742 acres
Lot 2: 4.450 acres
Lot 3: 4.325 acres
Lot 4: 3.541 acres
Lot 5: 5.186 acres
Lot 6: 84.193 acres (Encumbered by conservation easement with Aspen Valley Land Trust)
WHEREAS, the property is located within the Agricultural/ Residential / Rural Density
(A/R/RD) zone district and is also located in Study Area 3 of the Comprehensive Plan of 2000 in an
area designated as "outlying residential"; and
WHEREAS, Section 8:81(A) of the Subdivision regulations of 1984, as amended, states that
" Lots may be created under the provisions of the Rural Lands Development Exemption Option from
any eligible property parcel, as that parcel was described in the records of the Garfield County Clerk
and Recorder's Office on October 16, 2000 except where land was added to a previously eligible
parcel, in which case, changes to the legal description reflecting the added land may have occurred at
any time without jeopardizing the eligibility of the property. In the case where lands are added to an
existing property the existing parcel must have been at least 70 acres in size prior to the lands being
added and must have otherwise been eligible for development under the Garfield County's
Subdivision Regulations and Zoning Code. Owners of property otherwise eligible for the Rural
Lands Development Exemption Option may also seek approval of an application for exemption from
the definition of subdivision to the extent allowed in Section 8:52 (A) of these Regulations.
Application for the 8:52 (A) exemption may be processed either concurrently or separately from the
application for the Rural Lands Development Exemption Option_ A request for exemption under
Section 8:52 (A) may also be processed at any time without jeopardizing the eligibility of the
balance of the property for consideration under the Rural Lands Development Exemption Option,
and not affect the eligibility of the parcel as it existed on October 16, 2000 for either process"; and
WHEREAS, Section 8.81(B) of the Subdivision regulations of 1984, as amended, states that
"the number of lots that may be created by the Rural Lands Development Exemption Option, in
addition to the Remainder Parcel, shall be one (1) lot for every thirty-five (35) acres contained in the
eligible property plus one (1) lot for every one hundred (100) acres contained in the eligible property
plus one (1) additional lot A maximum of forty-two (42) lots and the Remainder Parcel may be
created under the provisions of the Rural Lands Development Exemption Option, including lots that
may be or have been approved by exemption from the definition of subdivision more specifically
described Section 8.52 A. of these Regulations"; and
WHEREAS, Section 8.81(D) of the Subdivision regulations of 1984, as amended, states that
"not less than eighty percent (S0%) of the total area contained in the property to be divided by the
Rural Lands Development Exemption Option shall be reserved as contiguous open space and or

agricultural land, which shall be restricted in use according to the provisions of the Development
Agreement. The remainder parcel may not be used for a public or private golf course"; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that the proposed division does not fall within the
purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason
that the division does not warrant further subdivision review; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating
domestic water on each of said parcels, that there is existing ingress and egress to said parcels, that
the location of septic tanks will be permitted by the Colorado Department of Health, that the
requested division is not part of an existing or larger development and does not fall within the
general purposes and intent of the Subdivision Regulations of the State of Colorado and the County
of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and
"subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; and
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the
basis of substantial competent evidence produced at the aforementioned hearing, has made the
following determination of facts:
1. Proper public notice was provided as required for the hearing before the Board of County
Commissioners;
2. The hearing before the Board of County Commissioners was extensive and complete, all
pertinent facts, matters and issues were submitted, and all interested parties were heard at
that meeting;
3. The above stated and other reasons, the proposed Rural Lands Development Option is in
the best interest of the health, safety, morals, convenience, order, prosperity and welfare
of the citizens of Garfield County;
4. The application is in conformance with the Garfield County Zoning Resolution of 1978,
as amended; and
5. The application is in conformance with the Garfield County Subdivision Regulations of
1984, as amended.
NOW THEREFORE, BE IT RESOLVED, by a vote of 2 to 0 (Commissioner McCown
absent), that the division of the above described 105 -acre tract is hereby exempted from such
definition of subdivision with the conditions set forth below and may be conveyed in the form of
"Lots 1— 6 of the Turgoose Ranch Rural Land Development Plat" with the lots being more
fully described in Exhibit A attached hereto, and that a copy of the instrument or instruments of
conveyance when recorded shall be filed with this Resolution and that the following conditions of
this approval required by the Board of County Commissioners have been completed.

1. That all representations of the Applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval.
2. That the applicant shall have 120 days to present a plat to the Commissioners for signature
from the date of conditional approval.
3. Prior to the signing of a plat, the Applicant shall be required to conduct a well pump test that
demonstrate the following points for each of the two domestic wells serving Lots 1 — 6:
a. That a four (4) hour pump test be performed on the well to be used;
b. A well completion report demonstrating the depth of the well, the characteristics of the
aquifer and the static water level;
c. The results of the four (4) hour pump test indicating the pumping rate in gallons per
minute and information showing drawdown and recharge;
d. A written opinion of the person conducting the well test that this well should be
adequate to supply water to the number of proposed lots;
e. An assumption of an average of no less than 3.5 people per dwelling unit, using 100
gallons of water per person, per day;
f. If the well is to be shared, a legal, well sharing declaration which discusses all
easements and costs associated with the operation and maintenance of the system and
who will be responsible for paying these costs and how assessments will be made for
these costs;
g. The water' quality be tested by an independent testing laboratory and meet State
guidelines concerning bacteria and nitrates.
h. For water supplies based on the use of cistern, the tank shall be a minimum of 1000
gallons.
4. That the following plat notes shall appear on the Final Plat:
a) No further divisions by exemption from the rules of Subdivision will be allowed.
b) No open hearth .solid fuel fireplaces will be allowed anywhere within an exemption. One
(1) new solid fuel burning stove as defied by C.R.S. 25-7-401, et. sew., and the
regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling
units will be allowed an unrestricted number of natural gas burning stoves and
appliances.
c) All exterior lighting will be the minimum amount necessary and all exterior lighting will
be directed inward and downward, towards the interior of the subdivision, except that
provisions may be made to allow for safety lighting that goes beyond the property
boundaries.
d) Foundations and Individual Sewage Disposal Systems shall be engineered by a
Professional Registered Engineer within the State of Colorado.

• e) Colorado is a "Right -to -Farm" State pursuant to C.R.S. 35-3-101, et seq. Landowners,
residents and visitors must be prepared to accept the activities, sights, sounds and smells
of Garfield County's agricultural operations as a normal and necessary aspect of living
in a County with a strong rural character and a healthy ranching sector. All must be
prepared to encounter noises, odor, lights, mud, dust, smoke chemicals, machinery on
public roads, livestock on public roads, storage and disposal of manure, and the
application by spraying or otherwise of chemical fertilizers, soil amendments, herbicides,
and pesticides, any one or more of which may naturally occur as a part of a legal and
non -negligent agricultural operations.
f) All owners of land, whether ranch or residence, have obligations under State law and
County regulations with regard to the maintenance of fences and irrigation ditches,
controlling weeds, keeping livestock and pets under control, using property in
accordance with zoning, and other aspects of using and maintaining property. Residents
and landowners are encouraged to learn about these rights and responsibilities and act
as good neighbors and citizens of the County. A good introductory source for such
information is "A Guide to Rural Living & SmaIl Scale Agriculture" put out by the
Colorado State University Extension Office in Garfield County.
g) One (1) dog will be allowed for each residential unit on Lots 1— 5 and the dog shall be
required to be confined within the owner's property boundaries.
h) Vegetation should be removed from near any structures in order to provide a safe zone in
the event of a wild land fire.
i) Private access roadways shall be a minimum of 12 feet in width. In order to obtain a
building permit, the owner of a lot must first receive the Rifle Fore protections District's
approval of the driveway design.
J)
Addresses are to be posted where the shared driveway intersects with the County Road
as well as where the individual driveways intersect with the shared driveway. Letters are
to be a minimum of 4 inches in height and i inch thick in width and in contrast with
background colors.
k) All building envelopes shown on the final plat cannot be adjusted without the explicit
permission from the Board of county Commissioners.
1) Lot 6 is subject to a perpetual conservation easement granted to Aspen Valley Land
Trust, recorded as Reception No. ( kW V of the Garfield County, Colorado records.
Future•activities on this lot shall comply with the conservation easement, the terms and
conditions of which are incorporated herein by this reference.

m) All agricultural improvements, including arenas, barns, sheds, and other agricultural
structures located on Lot 6, shall be confined to not more than one (1) of the 4 -acre
building envelopes shown on this plat. Only one (1) single-family residence shall be
permitted on_ Lot 6. The single-family residential use, together with additional
improvements accessory to single family residential use, may be located only within
either of the 1 -acre building envelopes or within the 4 -acre building envelope containing
the agricultural improvements.
5. Because Lots 1- 6 will share two domestic wells as well as raw irrigation water, the Applicant
shall establish an unincorporated Homeowners Association (with associated declarations and
protective covenants) to own and manage the shared components of the shared water system as
well as any associated water rights such as those managed by the Triple C Ranch Water Users
for the Rifle Creek Canon Ditch. This HOA shall determine how physical elements and
associated rights of the shared water system (well, water lines, easements, maintenance and
repair obligations) are to be owned and managed for each future owner of Lots 1 — 6. This
document shall be provided to the County for review as part of the final plat submittal.
6. Regarding the management of noxious weeds, the document, "Grant of Conservation Easement
in Gross", on page 4, item 4 D, under prohibited uses, reads: "The intentional introduction or
failure to prevent the introduction or spread of noxious weeds such as those identified by the
Colorado Weed Management Association...." This language shall be changed to add the
statement: "or `spread of noxious weeds as designated by Garfield County and the State
Department of Agriculture."
7. The Applicant shall establish protective covenants to be administered by a Homeowners
Association that specifically provide covenants that assigns responsibility for weed
management on common areas, as well as individual lots. This includes providing language
that is consistent with the weed management role taken on by Aspen Valley Land Trust as
described in the Grant of Conservation Easement in Gross for Lot 6.
8. Staff will require the Applicant establish a HOA to govern the use, maintenance, and fiscal
obligations as they relate to the access easement that provides access to Lots 1 — 6. This
information shall be submitted with the final plat documents at final plat.
9. The Applicant shall improve the access easement from CR 293 to the end of Lot 6 from its
current condition of a 12 -foot dirt road to a gravel road condition prior to final plat. This
improvement shall be reviewed and approved by the Road and Bridge Department.
10. The Applicant shall improve the access easement / shared driveway off of CR 293 so that the
drainage ditches are re-established to keep the water from running down CR 293. A 30 x 10
asphalt apron should be adequate. In addition, the Applicant shall install a stop sign at the end
of the shared driveway at its intersection with CR 293. The Applicant s all construct these
improvements prior to final plat. The Applicant shall obtain a letter from the Road and Bridge
Department indicating these improvements have been constructed to their satisfaction.

.11. The Applicant shall include the dust retardant plan submitted with the application as an
element in the protective covenants to be managed and enforced by the HOA. The Applicant
shall include provisions to this effect in the covenants to be submitted as part of the final plat
submittal.
12. The Applicant shall provide a fully executed (signed by all parties) "Grant of Conservation
Easement in Gross" with Aspen Valley Land Trust (AVLT) as part of the final plat submittal
documents to the County. In addition, the Applicant shall submit a letter from AVLT
indicating that they are satisfied with the irrigation water arrangement and that they have
enough to satisfy their needs regarding the easement.
13. The Applicant shall work with Mr. Ken Latham and Mr. Dale Coombs to locate their irrigation
water lines that cross the Applicant's property. Subsequently, easements for these water lines
that cross the Applicant's property shall be graphically shown on the final plat.

General Provisions
1) The applicant represents all parties in interest, and affirms that the driveway approach (es) is to be constructed by
him for the bona fide purpose of securing access to his property and not for the purpose of doing business or
servicing vehicles on the road right of way.
2) The applicant shall furnish all labor and materials, perform all work, and pay all costs in connection with the
construction of the driveway(s). All work shall be completed within thirty (30) days of the permit date.
3) The type of construction shall be as designated and/or approved by the Board of County Commissioners or their
representative and all materials used shall be of satisfactory quality and subject to inspection and approval of the
Board of County Commissioners or their representative.
4) The traveling public shall be protected during the installation with proper warning signs and signals and the Board
of County Commissioners and their duly appointed agents and employee shall be held harmless against any action
for personal injury or property damage sustained by any reason of the exercise of the Permit.
5) The Applicant shall assume responsibility for the removal or clearance of snow, ice, or sleet upon any portion of
the driveway approach (es) even though deposited on the driveway(s) in the course of the County snow removal
operations.
6) In the event it becomes necessary to remove any right-of-way fence, the posts on either side of the entrance shall
be surely braced before the fence is cut to prevent any slacking of the remaining fence and all posts and wire
removed shall be turned over to the District Road Supervisor of the Board of County Commissioners.
7) No revisions or additions shall be made to the driveway(s) or its appurtenances on the right-of-way without
written permission of the Board of County Commissioners.
8) Provisions and specifications outlined herein shall apply on all roads under the jurisdiction of the Board of County
Commissioners of Garfield County, Colorado, and the Specifications, set forth on the attached hereof and
incorporated herein as conditions hereof.
9) Final inspection of driveway will be required upon completion and must be approved by person issuing
permit or representative of person issuing permit.

Specifications
1. A driveway approach is understood to be that portion of the county road right -of way between the pavement edge
and the property line that is designed and used for the interchange of traffic between the roadway and abutting
property.
2. At any intersection, a driveway shall be restricted for a sufficient distance from the intersection to preserve the
normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum
intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be
provided.)
3. All entrances and exits shall be so located and constructed that vehicles approaching or using them will be able to
obtain adequate sight distance in both directions along the county road in order to maneuver safely and without
interfering with county road traffic.
4. The Applicant shall not be permitted to erect any sign or display material, either fixed or movable, on or
extending over any portion of the county road right-of-way.
5. Generally, no more than one approach shall be allowed any parcel or property the frontage of which is less than
one hundred (100) feet. Additional entrances or exits for parcels having a frontage in excess of one hundred 100)
feet shall be permitted only after showing of actual convenience and necessity.
6. All driveways shall be so located that the flared portion adjacent to the traveled way will not encroach upon
adjoining property.
7. No commercial driveway shall have a width greater than thirty (30) feet measured at right angles to the centerline
of the driveway except as increased by permissible radii. No noncommercial driveway shall have a width greater
than twenty (20) feet measured at right angles to the centerline of the driveway, except as increased by
permissible radii.
8. The axis of an approach to the road may be ata right angle to the centerline of the county road and of any angle
between ninety (90) degrees and sixty (60) degrees but shall not be less than sixty (60) degrees. Adjustment will
be made according to the type of traffic to be served and other physical conditions.
9. The construction of parking or servicing areas on the county road right-of-way is specifically prohibited.
Commercial establishments for customer vehicles should provide off -the -road parking facilities.
10. The grade of entrance and exit shall slope downward and away from the road surface at the same rate as the
normal shoulder slope and for a distance equal to the width of the shoulder but in no case less than twenty (20)
feet from the pavement edge. Approach grades are restricted to not more than ten percent (10%).
11. All driveways and approaches shall be so constructed that they shall not interfere with the drainage system of the
street or county road. The Applicant will be required to provide, at his own expense, drainage structures at
entrances and exits, which will become an integral part of the existing drainage system. The Board of County
Commissioners or their representative, prior to installation, must approve the dimensions and types of all drainage
structures.

of Approval noted on Page 5 of 5 herein, I/We will be cited by the BMSA/AC in written citation
form at the time of discovery. In extenuating circumstances a Variance may be requested from
the BMSA/AC, provided such Variance request item is within the purview and approval
jurisdiction of the BMSA/AC. If a Variance is not granted by the BMSA/AC and if the Non -
Conforming Items are not corrected within 60 days after the date of written citation, UWe will
be served Notice and opportunity for a Hearing before the BMSA Board of Directors, and if I/We
are found in violation of these Non -Conforming Items at the Hearing will be fined a minimum -
of S500 per Non -Conforming item.
Failure to pay fines levied as determined at the Hearings may also result in a Lien being placed
on our Property or Litigation Process initiated by the BMSA Board of Directors to secure
conformance with this full Application and its respective Conditions Of Approval.
UWe further acknowledge that any subsequent field changes which I/We may desire to the
Homeplans or Improvement Projects of this original Application Submittal and the original
Conditions of Approval issued by the BMSA/AC will require an additional Revised Application
Submittal on our behalf, and that I/We will not proceed with any subsequent field changes until

CONDITIONS OF APPROVAL
1. No aitework or building construction may proceed on any Lot (including no ptel'uninary► site Bearing, grubbing,
grade alteration, storing of material, foundation excavation, extension of underground utilities, etc.) until the Project
has received a Project Approval from the Architectural Committee and has been issued a Building Permit (as
required by Garfield County for New Home or Renovation projects).
2. All genal building and site improvements construction for any Project shall be completed and shall have issued
a Certificate of Occupancy from the Garfield County Building Dept. no later than oat ill year atter the issuance
date of this Aryhitectural Committee Anoroval.
3. The completed landscaping and revegetation of the improved Lot, to specifically include the front, side and rear
yard areas, shall be completed no later than six (6) months from the date of Certificate of Occupancy. An
additional maximum four (4) month extension may be granted by the Architectural Committee if the Certificate
of Occupancy was issued shortly prior to the non -growing winter months such that landscape construction could
not diligently proceed; however, in any event, the landscaping construction shall be fully complete no later than

GAS INSTALLATION
Proceed once the vent Installation is complete.
1. Move the fireplace into position and secure using the
nailing tabs and/or secure to the floor through the 114'21
holes located at either end of the base.
2. Route a 3/8' N.P.T. black iron gas line. 1/2' type -L cop-
per tubing or equivalent to the fireplace.
3. For ease of accessibility, an optional remote wall switch
or millivolt thermostat may be installed in a convenient lo-
cation. Route 2 -strand (solid core) millivolt wire through
the electrical hole located at the bottom left side of the unit.
The recommended maximum lead length depends on wire
size:

18gauge 40 feet
Attach the one lead to terminal 3 (located on the gas valve)
and the other lead to the vent safety switch wire ( located
loose in the valve compartment). See FIGURE 3.
Do not connect either the wall switch, thermostat
or gas valve to electricity (110 volts).

4. Install rigid black pipe, 1/2' type -L copper tubing or, if
local codes permit, a 3/8' flex connector and shutoff valve
to the gas line and the fireplace gas valve. Seal and tighten
securely. An adapter fitting is required between the gas
valve and the copper tubing or flex connector. DO NOT KINK
FUMBLE CONNECTOR. FIGURE 6.
5. Check for gas leaks by brushing on a soap end water
solution. Do not use open flame.

6. Mark the appropriate boxes on the rating plate label to

Purge all gas lines with the glass door of the fire-
place open. Assure that a continuous gas flow is
at the burner before closing the door.
