l. FACILITY DESCRIPTI0N: The faci 1 ity is a gravel operation near
Rulison, Colorado. A maximum of 4,000 tons
of maLerial is expected to be removed per
day.
A crushing operation will be on site and the
generated wastewater from this process will
go to a single sediment pond for treatment,
along with pit water. The pond is designed
to get rid of excess water via seepage; no
surface discharge is expected other than
possibly during a Iarge storrn event.
At this point there is no activity at this
si te. I t i s anti ci pated that acti vi ty wi I I
begin in spring of 1982, following receip*.

dimensions are 150 ft. x 100 ft. The permi ttee
presently has a 5 year lease for the proPerty.

I I l. Special Considerations
A. Salinity
Salinity shall be sampled on a rnonthly basis until six samples have been
analyzed- Thereafter, monitoring shall continue on a quarterly basis.
Following submittal of the first six months of data, the Division shall
determine eligibility of a waiver of numeric limitations based on salt-
loading. lf a waiver is not granted, then the permittee has an additional
six months to submit a report addressing salt removal in accordance with
Regulations 3.10.0 - 3.10.5 and Appendix A.
B. One-t irne ana lyses
Page 4 of the permit details the sampling reguirements which are on a one-
time basis to denonstrate compatability of the discharge with existing water
quality standards.

B. MONlTORING AND REPORTING
l. Representative Sampl ing
Samples and measurements taken as required herein shal 1 be representativeof the volume and nature of the monitored discharge.
2. Report i ng
Monitoring results obtained during the previous 3 months shal I be
summarized for each calendar quarter and reported on appl icable
discharge monitoring report forms (EPA Form 3320-l), postmarked noIater than the 28th day of the month fol Iowing the completed quarter.
For example, for the Ist quarter (January, February and March) ttte
report would be mailed on or before April 28. lf no discharge occurs

3. Definitions
a. A "compositeil sample, for monitoring requirements, is defined as a
minimum of four (4) grab samples collected at egually spaced two (Z)
hour intervals and proportioned according to flow.
b. A r'grab" sample, for monitoring requirements, is def ined as a singlerrdip and take" sample collected at a representative point in the
discharge stream.
c. An'rinstantaneous" measurement, for monitoring requirements, is defined
as a single reading, observation, or measurement using existing monitor-
ing facilities.
A. Test Procedures
Test procedures for the analysis of pollutants shall conform to regulations
published pursuant to Section 304 (f,) of the Act, and Colorado State EffluentLimitations (10.1.4), under which such procedures may be required.
5. Recording of Results
For each measurement or sample taken pursuant to the requirements of thispermit, the permittee shal I record the fol lowing information:
a. The exact place, date, and time of sampl ing;
b. The dates the analyses were performed;
c. The person(s) who performed the sampl ing;

6. Calculations for all limitations which require averaging of
measurements shal I uti I i ze an arithmetic mean unless otherwise
specified.
Additional Moni toring by Permittee
lf the permittee monitors any pollutant at the location(s) aesignated
herein more frequently than required by this permit, using approved
analyti cal methods as speci fied above, the resul ts of such moni toring
shal l be inciuded in the calculation and reporting of the values
reguired in the Discharge Monitoring Report Form (feR no. 3320-1),
or other forms as requi red by the Division. Such increased frequency
sha I I a'lso be ind icated.
Records Retent ion
Al I records and information resulting from the monitoring activities
required by this permit including al I records of analyses performed
and cal ibration and maintenance of instrumentation and recordings
from continuous monitoring instrumentation shal I be retained for a
minimum of three (3) years, or longer if requested by the Regional
Administrator or the State Water Qual ity Control Division.

C. SPILL PREVENTION AND CONTAINITENT PLAN
The permittee shall, within sixty (50) days after the effective date of this permit,
submit to the State LJater Quality Control Division, a spill prevention and
containment plan, prepared by a professional engineer registered in the Stateof Colorado. Plans shall include information and procedures for the prevention
and containment of spills of materials used, processed, or stored, at thefacility which could possibly be spilled and might have a visible or otherwise
detectable impact on the waters of the State. The plan should include but not
necessari ly be I imi ted to the fol lowi ng:
l. A history of spills which have occurred in the three (3) years preceeding theeffective date of this permit. The history shall include causation of thespills and a discussion of preventive measures designed to prevent them
from reoccurring;
2. A description of the reporting system which will be used to alert responsiblefacility management, the State l.later Quality Control Division, the
Environmental Protection Agency, downstream water users, and local health
officials;
3. A description of preventative faci I ities (including overal I faci I ity plot)
which prevent, contain, or treat, spi I ls and unplanned discharges;
4. A list of all materials used, processed, or stored, at the facility which
represent a potential spi ll threat to surface waters;
5, An implementation schedule for additional facil ities which might be required
in (3) above, but which are not yet operational;
5. A list of available outside contractors, agencies, or other bodies which
could be utilized in the event of a spill in order to clean up its cffects;
7. Provision for periodic review and updating of the contingency plan.
The foregoing provisions shall in no way render inapplicable those requirenEnts
imposed by Section 3ll of the Federal Water Pollution Control Act Ar*cndments of 1972,
regulations promulgated thereunder, the Colorado l,/ater Qual ity Control Act, and
regulat ions promul gated thereunder.
Nothing herein contained shall be construed as allowing any discharge to waters of
the State other than through the discharge points specifically authorized in thispermit. Nothing herein contained shall be construed as walving any liability the
permittee might have, civil or criminal, for any spill.
lf this facility has an approved spill prevention and containnrent plan now in effect,
please submit a copy of this plan with an update, if necessary.

A. I.IANAGEI'4ENT REQU I REMENTS
1. Change in Discharge
Al 1 discharges authorized herein shal I be consistent with the terms
and conditions of this permit. The discharge of any pollutant
identified in this permit more frequently than or at a level in
excess of that authorized shall constitute a violation of the permit.
An'7 anticipated change in discharge location, faci I ity expansions,
production increases, or process modifications which will result
in new, different, or increased discharges or pollutants must be
reported by submission of a new NPDES appl ication or, if such changes
wi l l not violate the effIuent l imitations specified in this permit,
by notice to the State \-/ater Quality Control Division of such changes.
Process modifications include, but are not ) imited to, the introduction
of any new pollutant not previously identified in the permit, or any
other moditications which may result in a discharge of a quantity or
qual ity different from that which was appl ied for. Fol lowing such
notice, the permit may be modified to specify and Iimit any pollutants
not previously I imited.
2. Noncompl iance
(n) Definitions
(t) Upset: An exceptional incident in which there is unintentional
and temporary noncompl iance with technology-based permit
effl uent I imi tat ions because of factors beyond the reasonable
cont rol of the permi ttee.
Q) Bypass: The intentional diversion of waste streams from any
portion of a treatment facility.
(3) Severe Property Damage: Substantial physical damage to property,
to the treatment facilities to cause them to become inoperable, or
substantial and permanent Ioss of natural resources which can
reasonably be expected to occur in the absence of a bypass. lt
does not rnean economic loss caused by delays in production.
(a) Notification
(t) lf, for any reason, the permittee does not comply with or will be
unable to comply wi th any maximum di scharge I imitations or
standards specified in this permit, the permittee shall ' at a
minimum, provide the V',ater Quality Control Division and EPA with
the fol lowing information:
a) A description of the discharge and cause of noncompl iance
b) The period of noncomDl iance, including exact dates and times
and/or the anticipated time when the discharge will return to
compl i ance; and
c) Steps being taken to reduce, el iminate, and prevent recurrence
of the noncomplying discharge.

(3) The permittee shall report all instances of noncompliance not
reported in rrNotif ication", paragraph 2-(B)-(2) (above) , at the
time discharge monitoring reports are submitted (EPA Form 3320-1).
The reports shal I contain the information I isted in "Notification",
paragraph 2- (B)- (1 ) (above).
(4) Where the permittee becomes aware that it failed to submit any
relevant facts in a permit appl ication, or submitted incorrect
information in a permit appl ication or report to the Division,'
it shal I promptly submit such facts or information.
(c ) Bypas s
(l) The permittee may allow any bypass to occur which does not cause
effluent limitations to be exceeded, but only if it also is for
essential maintenance to assure efficient operation. No Division
notification is required, and this case is not subject to the
requirernents in paragraphs 2- (c)- (2) through 2- (C) - (4) , (uetow) .
(2) lf the permittee knou/s in advance of the need for a bypass, it
shall submit notice, if possible at least ten days before the
date of the bypass, to the Division and the Environmental
Protection Agency (EPA). The bypass shall be subject to
Division approval, and I imitations imposed by the Division and EPA.
(3) For an unanticipated bypass, see the requirements listed inItNotificationr', paragraph 2-(B)-(Z), (above).
(4) Bypass is prohibited, and the Division may take enforcement
act i on aga i nst a permi ttee for bypass , un I ess :

equ i pment downt i me or preventat i ve ma i ntenance; and

3. Rernoved Substances
Solids, sludges, filter backwash, or other pollutants removed in the course
of treatment or control of wastewaters shall be disposed of in a manner such
as to prevent any pollutant from such materials from entering waters of the
S ta te.
4. Faci I ities Operation

5. Adverse lmpact

impact to waters of the State resulting from noncompliance with any
effluent I imitations specified in this permit, including such accelerated
or additional monitoring as necessary to determine the nature and impact
of the noncomplying discharge.
6. Any discharge to the waters of the State from a point source other than
specifical 1y authorized is prohibited.
7. Reduction, Loss, or Failure of Treatment Facility
(A) The permittee shall, to the extent necessary to maintain compliance with
its permit, control production, or al I discharges, or both unti I the
faci l ity is restored or an alternative method of treatment is provided.
(B) This provision also appl ies to power fai lures, unless an alternative
power source sufficient to operate the wastewater control faci I i t ies
is provided.

activity is located or in which any records are required to be kept
under the terms and cond i t ions of th i s permi t;

be kept under the terms and conditions of this permit and to inspect
any monitoring equipment or monitoring method required in the permit; and
(C) To enter upon the permittee's premises to reasonably investigate any
actual, suspected, or potential source of water pollution, or any
violation of the Colorado Water Qual ity Control Act. The investigation
may include, but is not limited to, the following: sampling of any
discharge and/or process waters, the taking of photographs, interviewing
of any persons having any knowledge related to the discharge, permit,
or alleged violation, and access to any and all facilities or areas
within the permitteers premises that may have any affect on the
discharge, permit, or alleged violation'

3. Transfer of Ownership or Control
ln the event of any change in control or ownership of facilities from which
the authorized discharges emanate, the permittee shal I notify the succeeding
owner or controi ler of the existence of this permit by letter, a copy of
which shall be forwarded to the Regional Administrator and the State Water
Qual ity Control Division.
Avai labi I i ty of Reports
Except for data determined to be confidential under Section 308 of the Act
and Regulations for the State Discharge Permit System 5.1.8, al1 rePorts
prepared in accordance with the terms of this permit shall be avai lable for
publ ic inspection at the offices of the State Water Quality Control Division
and the Regional Administrator.
As required by the Act, effluent data'shall not be considered confidential.
Knowingly making any false statement on any such report may result in the
imposition of criminal penalties as provided for in Section 309 of the Act,
and Sect ion 25-8-610 C.R.S. 1973.

7. Civil and Criminal Liability
Except as provided in pe;-mi t condi tions on "Bypassine" (A-2-(C)) and
"Reduction, Loss, or Fai lure of Treatment Faci i i ty", (n-7), nothing in this
permit-shal) be construed to relieve the permittee from civil or crirninal
penalties for noncompliance. (See Fed. Reg. Vol. Jli, No. 98, 12?.6A).

9. State Laws
Nothing in this permit shal I be construed to preclude the institution of any
legal action or relieve the permittee from any responsibilities, liabilities,
or penalties establ ished pursuant to any appl icable State law or regulation
under authority preserved by Section 510 of the Act.
'10. Permit Violations
Failure to comply with any terms and/or conditions of this permit shall
be a violation of this permit.
'11. Property,Rights
The issuance of this permit does not convey any property rights in either
real or personal propertyr or any exclusive privileges, nor does it authorize
any injury to private property or any invasion of personal rights, nor any
infringement of Federal, State or local laws or regulations.
12. - Severability
The provisions of this permit are severable, and if any provisions of this
permit, or the application of any provision of this permit to any circumstance,
is held inval id, the appl ication of such provision to other circumstances,
and the remainder of this permit shal I not be affected thereby.
13. At the request of a permittee, the Division may modify or terminate a permit
and issue a new permit if the following conditions are met:(n) The Regional Administrator has been notified of the proposed modifi-
cation or termination, and does not object in writing within thirty
(30) oays of receipt of noti fication; and(g) The Division finds that the permittee has shown reasonable grounds
consistent with the Federal and State statutes, and regulations for
such modification or termination; and(C) Requi rements of publ ic notice have been met.
The filing of a request by the permittee for a permit modification,. revokation
and reissuance, or termination, or E notification of planned changes or
anticipated noncompl iance, does not stay any permit condition.
14. lt shall not be a defense for a permittee in an enforcement action that it would
be necessary to halt or reduce the perrnitted activity in order to maintain
compl iance with the conditions of this permit.
15. Signatory Requirernent
All applications, reports, or information submitted to the Division shall be
signed and certified.

SPEC IAL REqU I REMENTS
l. Nor withstanding the provisions of PART I l, paragraph A-l ihe permittee
shal I submit a written request to the Colorado Viater Qual ity Control
Division and the U.S. Environmental Protection Agency for designation of
discharge points. The designation of present discharge points*shall be
submitted to the Permits Section, Water Qual ity Control Division in not
more than 90 days fol lowing the effective date of this permit. New
discharge point designations shal I be submitted in not less than 90 days
prior to the proposed time of discharge. The request shall be accompanied
by area maps which shall meet the specifications set forth below. Each
discharge point shal I be numbered consecutively (OOt, OO2, 003, etc.) and
designated on the map, The Division shal I approve or deny proposed
discharge points in writing, or may in its discretion require that the
permittee accept different effluent I imitations as a condition of approval
or submi t a new permit appl ication. Approval of additional discharge
points shall not constitute a permit modification, and no public notice
or hearing will be required, unless the WQCD, in its sole discretion
determines that the change is significant.
2. Area maps shall be made from USGS topographical maps (7.5 or l5-minutes
series) or other appropriate sources as approved by the Colorado Water
Qual ity Control Division. Each revised area map shal I be 8-1/2 inches
by ll inches and reproducible by rapid printing methods or as approved
by the Division. \./here additional 8-l/2 x I I maps are reguired to show
the area of operat.ion, they shall be numbered and a key shall be shown
on the first map. The first map section shall have the comPany name,
nine/iob name, address, and NPDES number clearly printed thereon. Also,
one Iine of latitude and one line of longitude shall be marked on each
map section. The area map(s) shall del ineate the fol lowing, using the
graph i cs as i nd i cated:

The permittee shall submit a written request to the Colorado VJater Qual ity
Control Division and the U.S. Environmental Protection Agency to deactivate
a discharge point. The Division will grant or deny the request in writing.
The Division's decision will be based on whether grading of the disturbed
area has been completed to return the earth to the desired contour and
reclamation work has begun. lf the request to deactivate is granted, the
point in question shall not be subject to any NPDES permit requirements.

a GENERAL REQU I REMENTS
The permittee shal l not discharge after the expiration date of this
permit without authorization. ln order to receive authorization to
discharge after the expiration date, the permittee shall, no later
than I8O aays prior to the expiration date of this permit, submit a
new NPDES application and fees as required by the permit issuing
author i ty.
The permittee is requi red to submit an annual fee as set forth in
Section 25-8-502 C.R.S. 1973 as amended. Fai lure to submit the
required fee is a violation of this permit and wiI I result in the
suspension of said permit and enforcement action pursuant to Section
25-8-601 et. seq., 1973 as amended.
lrithin sixty (50) days of the effective date of this permit, the
permi ttee shal I fi le a statement with the Envi ronmental Protection
Agency and the State Water Qual ity Control Division which shal I
contain the names of the person or persons who are designated to
report conditions as noted in "Noncompl iance", Part ll, Section A,
Paragraph 2, and as referenced in "0il and Hazardous Substance
Liabil ity", PART I l, Section B, Paragraph 8. The permittee shal I
continually update this Iist as changes occur at the facility.
'v/ith in three (3) months af ter the ef f ect ive date of th i s permit, a
flow-meesuring device shall be installed at all discharge points.
At the request of the Regional ,Administrator of the Environmental
Protection Agency or the Director of the State Water Quality Control
Division, the permittee must be able to show proof of the accuracy
of any flow-measuring device used in obtaining data submitted in
the npnitoring report. The flow-measuring device must indicate
values within ten (10) percent of the actual flow being discharged
from the faci I ity.
5. Discharge points shall be so designed or modified that a sample of
the effluent can be obtained at a point after the final treatment
process and prior to discharge to state waters.

C. ADDITIONAL DEFINITIONS (Appl ies to Gravei Pi ts)
1. The term "point source" means any discernible, confined, and discrete
conveyance, including but not I imited to any pipe, channel, ditch,
tunnel, conduit, wel l, discrete fissure, or container from which
pollutants are or may be discharged into waters of the State.
2, The term "dischargeil means any addition of any pollutant or pollutants
to waters of the State, from any point source.
3. The term'r10-year, 24-hour precipitation event" means the maximum
24-hour precipitation event (usual ly indicated in inches) with a
probable reoccurrence interval of once in 10 years.
4. The term 'rdeactivated point" means any location previously speci fied
as a permitted discharge point, where active mining and mining-
related activities have ceased and where reclamation has progressed
to a state judged sufficient to the Water Qual ity Control Division.
Any location having been identi fied and classi fied as a .deactivated
point" in writing shall be considered as such for permitting, monitoring,
and enforcement purposes.
