Garfield County is a legal and political subdivision of the State of Colorado for whichthe Board of County Commissioners @oard) is authorized to act- B. On the 2nd day of Jarruaq, t979, the Board adopted Resolution 79-01 conoeming a Zoning Resolution for the County of Garfield, Stale of Colorado. C. Pursuant to Section 9.03.04 of tle Zoning Resolution of 1978, an application for a Special Use Permit shall be approved or denied by the Board of County Commissioners after holding a public hearing thereon in oonformaoce with all the provisions of the Zoung Resolution. D. The Board held a public hearing on the 17th day of Februaqy, 2009, upon the question of whether the above-described Special Use Permit should be.granted or denied, . at wbich hearing the public and interested persons were given the opportunity to express o O'i,'/L . E. The Board of County Commissioners closed the public hearing on February L7th,2009, and acted on the basis of substantial competent evidence produced at the aforementioned hearing. Resolulion No!V, TIffiREFORE, BE IT RESOLVED by the Board of counB Commissioners of Garfield County, Colorado, that the Special Use Pemrit is approved based on the following findings: A' The forgoing Recitals are incorporated by this referenoe as part of this Resolution. B- Proper public notice via publication pursuant to Section g.A3.O4 of &e Zoning Resolution of 1978, as amended, was provided as required by law for the hearing before the Board of County Commissioners. C. An app)icati9l fT a special use permit was made coasisterrt with the requirements cf Section 5.03 of the Garfield County Zoning Resolution of 1928, as amended. D- The public hearing before the Board of County Commissioners was extensive and complete; all pertinent facts, matters and issues were submitted; and a1l interested parties were beard at that hearing. The proposed Special Use Permit is in compliaace with the recournaendations set forth in the Comprehensive Pian for the unincorporated areas of the county. The proposed Special Use Pemrit is in the best interest of t}e health, safery, morals, convenience, order, prosperity and welfare of the citizens of Garfield Couoty. Volurne of sound generated shall comply with the standards set for-th in the Colorado Revised Statrites. Vibration generated: the Conn Creek II Compressor Coatrol Facility shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instrurnents, at any point of any bor:ndary line of the proporly on which the use is located. Emissions of particulate matter: the Conn Creek II Compressor Contol Facility shali be so operated so as to cornply with all Federal, State and County air quality laws, regulations and standards- Emission of hea! glare, radiation and fumes: the Cona Creek II Compressor Conhol Iracility shall be so operated that it does not emit heat, glare, radiation or flunes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard' No storage of heavy equipment or materials is ProPosed or permitted- Any tighting shall be pointed downward and inward to the properly ceater and shaded to prevent direct reflection on adjacent properly. Water pollution: in a case in which potential har.ards exist, it shall be necessary to install safegrrards designed to comply with the Regulations of the Environrnental Protection Agency before operation of the facilities may begin. All percolation tests or ground water resource tests as may be required by local or State Hea1th Officers must be met before operatiou of the faoilities may begin. iI. The Conn Creek II Compressor Control Facility is to be instalted on the site under this Special Use Permit. Proper building and grading permits arc to be obtained for tbe pad and struitures prior to the issuance of a Special Use Permit. 12. A re-vegetation bond of $4000 per acrs shall be submitted for the I.8-acre site dishnbance, as per the Garfield County Vegetation Maaager' If the use as a compressor plaat is ende4 reclamation shall be initiated within 60 days and meet the requirements set forth in the reclamation plan in place on the date the Special Use Permit issued, or the site reclamation standards in place at the time of use crcssation, whichever is more shingent. The reclamation standards at the date of permit issuance are cited in Section 4-06,4.07 and 4.08 of the Garfield County Weed Management Plan (Resolution #2002-94)" i3.
