Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO.9r-101 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR NORTHWEST PIPELINE CORPORATION. WHEREAS, the Board of County Commissioners ofGarfield County, Colorado, has received application from Northwest Pipeline Corporation for upgrading a natural gas compressor station and constructing a gathering line system on the following described tract of land: A tract of land Iocated in the NE% of Section 13, T7S, R94W and rights of way extending through Section 13,24,25,35 and 36, T7S, R94W and Section 1,2,4,9,10,1I and 12, T7S, R94W of the 6th P.M. (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the l3th day of November 1991, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Perrrit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: l. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. ) )ss ) --.;;'#. i ,, i';ll&b,"a i /-tL_/ Brior< 818 pAoEgZB That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the Garfield County ZonngResolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenienc€, order, prosperity and welfare of the citizens of Garflreld County. NOW, THEREFORE, BE m RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting the use of the above described tract of land for the upgrading of a natural gas compressor station and gathering pipeline system, upon the following specific conditions: All proposals of the applicants shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. The applicants shall have 120 days from the date of the Resolution of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use Permit shall be issued when all conditions are met and shall expire 120 days after issuance, unless construction or use has commenced. The compressor facility shall be operated in accordance with State noise standards. The applicants shall be responsible for 64inlaining the site in a weed-free manner in accordance with State and County regulations. The compressor facility shall be operated in accordance with State and Federal air quality standards. A C.D. of H. permit for a gas compressor station shall be furnished prior to the operation of the compressor. Prior to the commencement of construction on any portion of the pipeline, the applicants shall provide to County staffright of way and reclamation agreements for each individual landowner,-easements holder and ditch operators. This shall include private landowners, BLM, Highway Department and the railroad. The applicants shall provide written verification from the Army Corps of Elgineers waiving 404 permit requirements and authorizing use of a nationwide permit prior to the commencement of any river crossing. Only certified weed-free seed shall be used in reclamation efforts. Continued monitoring of the site using S.C.S. recorlmendations shall be conducted. The applicants shall provide a $100,000 bond prior to commencement of any work with;n the County right of way. All required building permits shall be obtained. The applicants shall submit the application to the State Geologist's Office for review, in particular in reference to the grade above the Colorado River. Written or verbal verification ofthereviewshall beprovided andanymitigation measuresrequiredbythe State Geologist's Offrce shall be considered conditions of approval. 3. l. 3. 4. 5. 6. 7. 9. 10.
